AOL has a more fundamental problem - churnAOL's problem is that only new users sign up for AOL, and in time, they leave for better providers. With the market saturated, the supply of new suckers, er, users, is small. AOL thus can't grow. And their whole culture, especially their earnings estimates, was built on growth.
Pop-up ads seem to have been part of AOL's desperate, and possibly criminal, attempt to inflate earnings. AOL ran into an "ad inventory problem" - there wasn't enough space for banner ads on the main pages. Pop-ups allowed them to inflate their ad space.

lost the link?
Mr. Olman was speaking in favor of the Sonny Bono Public Domain Pillage Act (also known as the "Copyright Term Extension Act"). He bewailed the loss of revenues such Communists and anarchists as the Boy Scouts cost the poor, abused Content Cartel every year. (Blatant plug: The Post published my reply. Like a schlub, I've lost the actual WashPost link.)
I guess you didn't try hard to find it... the WashPost link was right there on the page you did link to! -
Re:well...This is GOVERNMENT. It won't happen.
Almost every time political boundaries need to be altered (for representatives), these people don't move the border around a few houses, they rewrite the entire map to best suit their own agenda. Legislative Redistricting causes this problem (known as Gerrymandering) in elections again and again and again ALL OVER THE USA.
You are right about no rational people wanting it. There are many rational people who have offered ways to restructure boundaries that offer the biggest human benefit and lowest government cost. These ideal solutions segment the groups by physical boundaries and population density. But government is not a rational entity.
There are countless smart was to divide it up. Clusters of people should rationally be served by the same set of government. People between clusters should be separated by distance to the clusters and other boundaries (hills, rivers, roads). In dense population areas, map the location of a current road, or a side of the road, as the boundary -- not the line between where two rivers meet and where another river enters a lake bed.
And of course after two counties or states go to court fighting it out -- costing millions of taxpayer dollers -- They will put out big press releases saying either "We saved tax money by moving these buildings outside of our county!" or "We increased tax revenue without increasing taxes!", overlooking the fact that they wasted millions in the process.

It's Mugabe's fault....
In addition the the article the Post also has an editorial today which explains how President Mugabe has run the country into the ground, including the agricultural industry.

Re:Slashdot misses the point
Excellent post, way to put it in perspective.
However,
I take issue with this point:
The United States is the one making a very large donation to a poor company for almost no (if any) self-benifit, yet it is painted as the bad guy for not agreeing to mill the corn as well!
Let's look at the actual cost of this corn.
The article quotes a ship arrive each day for 2 days with 10000 metric tons of corn, each costing $95. Let's say the US does this for a full year (which seems like the outside limit to me). This would cost $347 million, a trivial sum of money for this country.
I won't bother with the usual comparison to the US gov't national budget. Instead, let's compare that to the amount of money a private investment corporation, JP Morgan, was willing to put into Enron as of November last year: $1 billion. See this article. This after Enron revealed that it was in very poor financial shape as a result of extensive book-cooking for years. From this point of view, $350m is bargain basement.
What we gain:
We will have fed 12 million starving people at a time when many peple in the world thinks the US is full of greedy bastards.
Furthermore, we will have shown Europe, and other large trading partners that we are willing to go against the demands of our corporations sometimes, also at a time when many people inside and outside the US have doubts about the trustworthiness of those corporations.
As for your point that the Europeans are also involved here because they are placing restrictions on imported foodstuffs, that's a fair point. For African countries, the burden of meeting US and European food importation standard is a very heavy one. Europe is full of double-talk on this issue - if they wanted to help, they could indeed make some concessions here.
Of course we could do an end run around all of this by formally granting Zimbabwe permanent indemnity from IP claims by Monsanto (or at least until the average standard of living is something comparable to the 1st world). Hell, if Monsanto was really good faith about all this, it could grant the indemnity itself. Talk about a publicity steal for Monsanto - for the price of a tiny bit money they'd be hard pressed to collect anyway, they get to claim that their GE seeds "helped save 12 million Zimbabweans from starving". -

Jon, the Al-Qaida and the FBI
What does it take, a minor miracle to get a good story posted on Slashdot? Yes, it's grousing, but dammit, it's a decent read. That's 11 out of 11. Sheesh.
2002-07-30 20:40:46 Jon, the Al-Qaida and the FBI (articles, internet) (rejected)
Jon Messner had a very good, not to mention devious idea: Hack a known Al-Qaida website, take it over and set up shop as an intelligence gathering operation. Then he involved the FBI and that's where things went wrong. A facinating look into governmental internet readiness and how easily your privacy can evaporate if you belong to the right group. -
What about the 'commercial partnerships'?I'm sure you've read the proposals much more carefully that me, but what I saw was simply that every company was (rightly) trying to emphasise how they will be reliable and have the experience to handle this. In a lot of cases, of course, this translates to "we're reliable because of our for-profit experience".
What I find more disconcerting is the raft of 'nonprofit but with commercial partners' type of applications - which seem to be just a non-profit front for commercial operations. For example, the DotOrg Foundation have already agreed to outsource all the work to register.com at $5.20/domain, and then charge Joe Public $6. Why not let register.com put in an application themselves? (To answer that myself, they have put in their own application as 'Register Organisation Inc.'). Similarly 'UIA' seems to be just a front for Verisign.
These semi-non-profit organisations then seem to have bizarre ideas about what to do with all the filthy lucre they accumulate: from giving a fraction of it to good causes (justifying overcharging by donating a tenth of their profits to charity), to using the money to develop tools which they will then sell to
.org registrants (WTF?).I would personally prefer a proper (open) non-profit organisation to run it, but wouldn't mind an accountable for-profit company. Having an open, non-profit, well-run shell organisation who shovel all the money into some shadowy forprofit partner seems a recipe for disaster.
Incidentally, the most amusing(worrying?) application seems to be the '.Org foundation' who claim "We want to make sure that [dot-org] is representative of the larger world and not just representative of U.S. organizations," - and follow this up by: 'Microsoft has tentatively agreed to help fund The
.Org Foundation if it wins the contract, Rogers said. Details of that arrangement are still being worked out.' -

Re:good ideaBlockquoth the poster:
I suspect that industry would be more receptive to these online libraries if goverments extended such programs into this area.
Quite the opposite, actually. Publishers have hated the idea of public libraries for literally centuries. They have done everything they can to restrict, reduce, and eventually rub out libraries. Only the fact that the public library is so patently a public good -- that it engenders warm, fuzzy feelings in John Q. Voter -- has protected it so far.In the DMCA hearings, who was just about the only group looking out for anything close to what we might call the average citizen? The librarians' group.
Doubt me? Ask a former Registrar of Copyright, Ralph Oman, who in a letter to The Washington Post bewhined that
"A long list of special pleaders now gets free use of copyrighted works, including small businesses, veterans' groups, bars, scholars, restaurants, fraternal groups, marching bands, Boy Scout troops, nursing homes, libraries, radio broadcasters and home tapers" (emphasis added)
Like a schlub, I've lost the actual WashPost link.)The evidence is, the Content Cartel would prefer to see libraries go gently into that dark night of perpetual copyright extension, indefinite "access controls", and a denuded public domain.

Been there, done that.
Oh, come on. We all noticed this one, right? UFO With Fighter Escort Over DC!
...News at Eleven. On a side note, of course Boing and NASA are sinking money into this; Just like several well known companies sank money into the Internet via Powerlines scam. If it pans out, your looking at a real society changing event, not some auto-balacing scooter hype. If not, they'll try to sue the guy's butt, legs and arms off and walk away with their tail between their legs. Life goes on. Further, you won't see this in civilian applications anytime soon if it is the real anti-gravity McCoy. Ever see Evangelion? Notice how they were always (until the later eps) attatched to a giant extention cord? I suspect your power-hungery anti-gravity unit is either going to be teathered to one of these or have it's own mini S2 nuclear plant. At least until we develop Mr. Fission, that is. -
Re:right idea, wrong media. Not quite. Newspapers have their own reporters and their editors chose a mix of stories from those reporters and the news services based on newsworthiness (a story about a snowstorm in Illinois might be important to Chicago-area papers, but most people in San Diego could care less).
Most U.S. newspapers are affiliated with the AP and Reuters, though a smaller number use the Agence France-Presse, which is more popular internationally. Then there's United Press International, which is practically dead, so few papers use it.
Knight Ridder and Gannett are different animals altogether. They are huge corporations which own dozens of tiny newspapers you've never heard of and a few larger papers (USA Today is Gannett's flagship paper, while the San Jose Mercury News is KR's, though KR's Miami Herald is a better paper). One of the "advantages" of these giant corporations is that they share stories with other papers in the corporation, which enables a paper in Fargo to cover an event in San Francisco without having to put up the money for a regional bureau.
Better papers (New York Times, Washington Post, Wall Street Journal, Los Angeles Times, etc.) maintain their own bureaus outside their hometowns (for instance, the Washington Post has about 10 bureaus in U.S. cities outside DC [Chicago, New York, Los Angeles, etc.], and about 12 bureaus in international cities [London, Tokyo, Moscow, etc.]), so they use a far higher percentage of their own content, but they still use the AP, Reuters and AFP for stories they can't afford to cover themselves or don't have the time to reach. However, you won't see a Knight Ridder story in a paper like the New York Times.
The big difference here is that aggregators/metabrowsers are computers that display headlines without discretion. Newspapers employ editors who have been trained in the art/science of news judgment. For this reason, a metabrowser will quickly become exceptionally boring and irrelevant.

Re:Unconstitutional on it's face
This is not true for two reasons:
1) the video was Osama's IP, it is not just an image and it was taken by him, not you.
2) failing that, I refer you to this article an another topic, but relevant here:
Lawyers unconnected to the case say it's a blurry area. Jonathan Band, an intellectual property expert in the District, says technically, Gore's speech was comparable to a theatrical production. "If he's taping it, he's infringing and copying her public performance."
It seems like a strech, but technically, it can be done. You taking the video can violate IP, you having a video he took definitly could violate IP. Great system, eh? -
Re:What's the problem?
Wrong. How would the black box be any different than keeping a journal? As I said before, the car is your property (just like the journal) and is protected via the same rights.
You might want to check with former Senator Bob Packwood or Unabomber Ted Kaczynski before you boldly state that the U.S. legal system will respect the privacy of your journals. Today the court system barely even recognizes your right to keep private records; your odds of keeping private the data collected by a "flight recorder" attached to your car are, precisely, zero.
Your Fourth and Fifth Amendment rights have been withering away for almost a century. If they were enforced as the Founders intended, it would be impossible for the IRS to collect income tax; the government's search and seizure powers were reinforced in every major 20th century court decision on the subject, and by now your right not to hand over information to the government is barely even recognized, much less enforced by the legal system.
Keeping a black box would not be any different than keeping a journal; your error is to believe that your journal is somehow protected. It's okay if you want to believe that -- but I wouldn't count on it, and I certainly wouldn't expect a U.S. court in this day and age to acknowledge my right to withhold the data recorded by a "black box" on my car.

Unless I misunderstand...Unless I'm not understanding the article, an Italian citizen living in Italy was forced by Italian police to shut down his web site, which happened to be hosted in the United States.
So... What's the big deal again?
Sure, it offends me that the Italian government discourages free discourse, but that's a matter for the government and the citizens of Italy to work out. Just because the site was hosted in the US does not extend legal protection to the person running the site. This would be as if I, say, obtained a copy of the Solaris source and kept it on a server in Iran, and the US forced me to delete it in order to avoid jail time. Regardless of if you think the laws involved are intelligent, I am still subject to the laws of my country.
If the Italian government had somehow forced the US hosting company to remove the speech in question, then we'd have a serious problem to discuss here. However, that now being the case, I don't see what the issue is.
Want something real to worry about? Try this: an American U student is charged with theft for taping a speech by Tipper Gore. They say he "stole" her intellectual property. I suppose from now on we'll need expressed written permission from Major League Baseball to describe what our political leaders are saying...

Morality of civil disobedience?
Mark this one under -1 Subversive...
Seriously, though, if you believe that corporatism on the Internet is evil and must be fought, then surely supporting an underground resistance movement to fight and deface the corporate internet presence is a valid response?
Consider -- you read something like Thoreau's commentary on civil disobedience and he basically says that paying your taxes under an unjust regime is in itself a crime, and NOT paying your taxes is a virtue. Now, considering that our options for resisting the corporate takeover are non-existent since laws and social institutions are in place to enable their power (ie: automatic deduction of taxes from income, which the government distributes to corporations as it sees fit (in other words, corporate socialism)) there is no way to deny them the money they feel is owed to them, as Thoreau says he thinks we should do. In that sense, can we not regard this as theft as retalliate accordingly?
For instance, if a company is promoting immoral behaviour and has a web presence, is it not justifiable to go after their web presence, if this is the only way I can fight back?
(Don't mind me, I'm just trying to see how fast I can get "wrinkledshirt" into an FBI file.) -
Financial snooping may pay off.Yesterday: "U.S. Customs agents have arrested a Jordanian-born man who was allegedly carrying $12 million in false cashier's checks, alarming counterterrorism officials who said the suspect may have been trained in al Qaeda terrorist camps in Afghanistan." This is significant. Apparently what's left of al Qaeda wanted $12 million in the US for something. It does indicate that attempts to cut off al Qaeda's money supply are working; these were false cashier's checks drawn on a non-existent branch bank, which is a desperation move.
So all this financial snooping actually does have some terrorism implications.

Re:Thanks?Quoting from this article:
I'd say AC had quite an impact, wouldn't you? Then came the power of AC. The House of Representatives was air-conditioned in 1928, the Senate in 1929. The White House got central AC during a renovation in 1930. Public office buildings followed suit. A few decades later, residences became air-conditioned. The town changed.
So, say some, did politics.
"Clearly," says Marshall Wittmann of the Hudson Institute think tank, "air conditioning was a lubricant for the Congress to enlarge the size and scope of the purview of the legislative branch."
In other words, if you think like Wittmann, it wasn't just the New Deal that brought about the era of big government. It was the installation of air conditioning.
"It not only enlarged the government," Wittmann says, "but also saved Washington from losing its position as the nation's capital. Can you imagine modern-day lobbyists and legislators enduring Washington sans air conditioning? Impossible!"
-
Washington Post Story
Here. And Washington DC is a town that really needs AC.

Re:Local music
There are several go-go bands listed at mp3.washingtonpost.com (it's an acquired taste - you really have to be from DC to "get it"). Funny - when I was younger people generally swapped go-go tapes...this pre-dates p2p by at least 10 years.
-
Washingtonpost.com legal agreementIf you read the downloading agreement then you will see that they (Washington Post Legal / boston.com legal) do not really permit you to do with the music what you might like to do.
For example, you are not allowed to distribute the music over a LAN. This means that I could not use my Rio Receiver to play the music over my hifi system. You are also not allowed to use the music to construct any kind of database. This probably rules out most fancy players that create nice indexes of your music. It may rule out all hardware based players as they will create a (small) database of the music stored internally to the player. It certainly rules out using JReceiver as my music server.
I understand that they want to restrict the use that people make of the band's music, but it does seem a little over restrictive.

Re:Seems like a bad ideathink about the holy hell that would get raised if you decided to charge a fee of $2500 a year to drive to Manhattan Island!
Guess What? The Port Authority of New York And New Jersey charges, get this-- Tolls!. I know, I couldn't believe it either, but apparently, if you want to enter Manhattan, you'll have to pay a toll of $5. What the bridge trolls charge That's $1300 a year. BTW, at the current exchange rate of £1=1.56, £1300 is only worth $2024. Foreign Exchange Rates

Hi, Piers.I have a hard time coming up with a question that you probably haven't been asked repeatedly regarding writing, and there will no doubt already be a number of questions about your experiences with Linux already asked in this interview, so I'd like to bring up a matter that has already been done to death on Slashdot but could use some insight from an established author.
There seems to be a movement within the current publishing industry (that parallels the ones within the movie and record industries) to shut down or hamper the abilities of consumers to, in my opinion, fully appreciate their Fair Use rights. Members of each industry are scared, quite understandably, by the capacity of peer-to-peer (P2P) file sharing networks and the Internet in general to allow their works to be shared on an unprecedented scale without compensating the creators of the works or holders of the copyrights on the works (this is usually labeled piracy, although this brings rather silly images to mind I'd prefer to avoid). I understand that this has happened with at least one of your books; another reason why I'd like to eventually ask you a question on the topic. However, I'm concerned that the direction some would like to take. For example, Pat Schroeder of the Association of American Publishers seems comfortable with the idea that public libraries might have to start charging patrons for access to continue offering the same services they do today.
Assuming you don't mind metaphorically throwing a rock into a hornet's nest, what are your thoughts on these matters? Are public libraries (or P2P) a greater harm to society by permitting hundreds of people to get by on the purchase of one book, or are they a boon for offsetting the damage 100-year copyrights do to the public domain (from which we have historically drawn our knowledge and inspiration for art and culture)?
BTW: I love your books.

Good point but...
If you fear bin Laden or Al Queda I think you're taking the threat a little too seriously. Since the attack on Tora Bora there simply haven't been any new bin Laden videos with actual new footage of the man himself.
On the other hand, America's enemies are not simply limited to crazy Arabic peoples bitter about America's hegemony. They include a very wary China, a not quite mentally stable North Korea, and a beaten but not cowed Iraq. The thing is, though, that they likely already have our secrets. So basically, it's way too late to worry about the possibility that this game is going to give away military secrets. -
Re:Why you don't always go to the Supreme CourtAs Phil Agre pointed out, Bush seems to be headed for a dispute with the Constitution itself. Bush is quoted in the Washington Post (skip to the last paragraph):
Bush said the ruling "points up the fact that we need common-sense judges who understand that our rights were derived from God. And those are the kind of judges I intend to put on the bench."
Which seems in contradiction to Article VI.3 of the US Constitution:Clause 3:
Interesting. The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.
As you'd expect from that, the Presidential Oath or Affirmation in Article II.1.8 is "merely"
"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States."
with no "so help me God" or anything like that... -
George Bush's (AWOL) National Guard Service: CitesTry these:
- Boston Globe
- Washington Post
- Dubya refused to release his military records, but pieces of them have been obtained through FOI requests.
- AWOL Bush has some interesting things to say on this topic.
