3D Realms Sued Over Failed Duke Nukem Forever Plans

Take-Two Interactive has now sued 3D Realms over the cancellation of Duke Nukem Forever . Take-Two did not provide continuous funding for the game, but they did pay $12 million for the publishing rights to the game. A Bloomberg report quotes Take-Two's complaint as saying that 3D Realms "continually delayed the completion date" and "repeatedly assured Take-Two and the video-gaming community that it was diligently working toward competing development of the PC Version" of the game. (The complaint refers to 3D Realms as part of Apogee Software, Ltd., not to be confused with Apogee Software, LLC, the publisher behind the still-forthcoming Duke Nukem Trilogy.)

      2 DVDs filled with videos of strippers for reference material, 1 CD-ROM containing training for weapons and explosives, 20 sci-fi magazines about aliens, 1 small "cheezy phrase" booklet, 30 artist sketches of what the monsters would look like, and 1 bag of tepid air to be used for marketing.

      I sure know which out of the two I'd want if I was Take Two!

      Those two DVDs seem to be interesting, and you never know when you need a bag of tepid air.

      I think it's more likely that they are trying to get a cut of any assets sold by 3D Realms, either physical or intellectual. I could see them making a grab for Duke Nukem copyright, handing it over to another developer, and putting it out under the Duke Nukem Forever title...

      That's 12 million theoretical dollars, or a mostly-completed vaporware with legendary amounts of buzz surrounding it and a large, dedicated fanbase. Sell it to a studio that isn't run by tall babies and it won't be vaporware anymore.

      Uh, no, it's nothing short of retarded to pay 12 million for someone else's incomplete code because you'll ultimately wind up scrapping it all and rewriting it from scratch; theoretically programmers should leave detailed comments in their code along with extensive documentation to make things easier for anyone who's going to maintain their product - but they generally don't, instead they leave behind a convoluted, undocumented mass of horror because a) they were rushing for the deadlines and b) have no interest in making things easier for anyone who's going to replace them/pick up where they left off because they were fired for missing deadlines/stepping on the wrong toes/failing to be a "team player".

      Take Two will get more out of the deal if they demand their money back, spend two million licensing the Unreal engine and hiring particularly juvenile developers (which I'm sure they have no shortage of), and blow the rest of the ten million on hookers and drugs for the reviewers.

      I was with Duke for twelve years, Dr. Hirnficker. We always made plans to go out at nights, but he always had to work late every night. I know kicking alien scumbag asses is a tough job, but every night?

      One day I found a receipt on the floor; it must have fallen out of his wallet. When I read the "new models" and "better engines" line items, I suspected that his staying late on the job wasn't really for more work. I think he was flirting with other technology.

      But despite what you say, Duke never laid a hand on me, I swear. The bruises are just from walking into doorknobs and cupboard handles. Really, Dr., it's true! Duke was always good to me. He was always my friend, my love and my soulmate. We were meant to be together. Forever.

      There were certainly bad project managers at 3D realms but there were also pretty bad investors behind. Who would invest $12 million in such a never ending project?

      The project was started somewhere after the completion of the Duke Nukem 3D game (1996-1997). That game was pretty successful, and so 3D Realms looked like it might be worth investing in. I'm guessing Take Two didn't invest all that money in 2009.

      Furthermore, 3D Realms released some rather credible video trailers for the game, once in 1998, and again in 2001:

      So clearly, even going as far as 2002, you could still believe 3D Realms was going to release *something* eventually...

      They have the Duke Nukem Intellectual Property, as well as whatever other games 3d Realms has produced over the years. Winning that in court would allow them to produce games, as well as movies or anything else. In the long term, it could be worth well north of the 12 million.

      I believe Apogee Software, Ltd. (the company; "3D Realms" is essentially a brand name under which all of their development was done) has assets (including the trade name "Apogee", and its library of IP, currently licensed to Apogee Software, LLC). A financial judgement against Apogee Software, Ltd., could force them to liquidate those assets to satisfy the judgement.

      Also, Apogee Software, Ltd., is a Limited Partnership, which means it has at least one general partner and one or more limited partners. Generally speaking, the general partner(s) are jointly and severally liable for the debts of the partnership, so if Apogee Software, Ltd., doesn't have assets to satsify a judgement, the general partner(s) will be on the hook for the judgement.

      I don't know... When Prey (another 3D Realms title that almost became vaporware) was finished by Human Head, it was pretty damn good, in my opinion.

      I'm seriously hoping that another competent studio will pick up the IP and make something just as worthwhile.

      Yep. They already likely have a very substantial number of skinned alien models for DNF, as well as their textures and light models. They've got levels, explosions and other rendered things.

      All they've got to do now (I assume) is import all this data into a better render engine, improve the lighting models, etc. and they're likely to have all the special effects they'd need to make a movie. Write, cast, shoot on a bluescreen, and impose Duke (and strippers) into the "game" (movie) world. Voila, you've got a movie which would net you > 12M.

      If 3DR has gone bust, then presumably all the IP is just sitting around and will be acquired by another company. Unlike most games companies that fold, it doesn't seem 3DR was up to its neck in debt or anything like that, so it won't be handed over to some cold-hearted administrators and will more likely than not get snapped up by a rival.

      Maybe it was just me, but judging by the 'leaked' demo footage slashdot had posted a week or so back it looked to me like it was just high polygon models and a whole lot of really stupid pre-scripted events.

      Honestly it looked like it wouldn't have any more replayability than any FPS I have from the 2000 era (Which coincidentally is about when it SHOULD have been released.)

      What makes you think any of that stuff even exists? They've released a few dozen pieces of concept art, a few game play movies (that could easily have been faked in other engines with modding tools), and-- well that's it.

      My guess is that the only thing Take Two has to show for their $12 million is a really high score on the 3DRealms breakroom pinball machine.

      The whole Duke Nukem Forever thing was a complete scam from day one, IMO.

      I didn't seem anyone mention replayability. Just fun and personality. A game that's quality to go through the first time doesn't need collectables, or multiple paths, or any of that other shit. You play it again not for completion's sake, you play it 'cause it's frakking FUN!

      Oh yeah, that's good clean American fun right there. I hope that it does get released, even if its just all the current code/models/etc as open source. After 12 years they owe the gaming world SOMETHING.

    3D Realms don't have $12 million. If they did they wouldn't have gone belly up. A game developer has virtually no tangible assets. Computers will add up to the tens of thousands at most, devkits are owned by the console manufacturers, offices are leased. The IP is typically not going to have anyone wanting to buy it.

    The only exception to that last point is Take Two. They have a vested interest in making this game a reality. Presumably the point to this is that they become creditors and so will have a claim on the aspects of DNF that have been completed.

      But getting rights to finish developing the DNF game could be worth more. Currently, the name alone, would sell like hotcakes. Not to mention, I would venture a guess that some fans would purchase to support the franchise, to make sure it continues.

      In other words, duke in take two's hands is the best thing that could happen to both take two, and the fans, at this point.

      It's not about money. Take 2 did agree(albeit verbally) to give 3DR $5 million. However they later decided not to, and instead to pay 3DR $30 million if they sold the IP to Take 2. They declined, and thus closed.

      T2 did not offer to buy it for $30m. They offered 3DR $5m for continued development if they handed over all the rights in return and said if 3DR didn't like it they could get the publishing rights back if they paid them $30m, meaning any other publisher would have to come up with $35m to see the game finished.

      This is clearly a tactical move by T2 to acquire the Duke rights.

      Not entirely surprising. They've had the $12m for over a decade now. Inflation-adjusted since 1997 that's $17m in today's money. It would only have needed an 8% interest rate in an investment to be $30m by now. If they'd invested the money in other games then they'd be quite likely to have made at least that. All Take Two are doing is saying that, if 3D Realms wants to treat the $12m as a loan then they have to pay interest on it.

      Late reply, but...

      T2 didn't give 3DR $12m. They gave Infogrames $12m because they thought the rights were worth that much. 3DR saw none of that money.

      Aside from a "small advance" (no specifics besides that statement, given the sums + timeframe involved plus what publishers were giving out back then a few tens of thousands is a safe assumption) from GTI in '97, DNF has been entirely self-funded by 3DR.

      This is just an attempt by T2 to grab the Duke rights from 3DR now that they have no money to defend themselves. They'll most likely argue "bad faith" because the publishing rights they bought clearly had no development schedule or milestones attached. I'll bet there's a fair amount of ego involved too, what with GeorgeB3DR telling T2 to "STFU" back in either '01 or '02.

      Not possible anymore (for a while now). Look at the credits of any major 3D action game. You are going to do that all on your own? Good luck with that. Maybe you can do an initial version of Wolfenstein (2.5D) on your own, anything requiring more game code and/or graphics is off limits for a single developer.

      I think everyone is having a hard time finding any pity for 3D Realms. Honestly, how could there be? After dragging the community (and Take Two) along for so long, while poking fun and EMBRACING the fact that nobody thought it was going to come out and laughing at the fact that people called it vaporware, they then went out of business?

      Really, no words can put into perspective the amount of irony in play here. While I laughed when I saw 3D Realms was going under, I also was really pissed, considering all the leaked footage and little "trailers" they used to tease us the last few years.

      I hope that somehow, Take Two get's their money along with every last scrap of code and data for DNF and shops it to a RESPECTABLE company that will, no doubt, be able to crank out the game in a years time, tops. As long as I get my Duke, i'll be satisfied with whatever outcome comes to pass. I think everyone is at that point now too.

      All that work in 10+ years? It's at least POSSIBLE. You'd think with a handful of people (like 3-5) you'd be able to do it in 3-5 years. Look at all the indy developed games out there: most of them have teams smaller than 10 people. 3D Realms had 10 years and barely had a trailer out for us to watch. Granted the leaked footage shown recently shows a game that is a bit more finished than even I thought was done, but still...I don't think it is out of the question. 10 years is a long time.

      Well, who says that? I think it's entirely possible. You just do not have to blow up the graphics like crazy. The sole fun, and balancing, and game mechanics, etc? For sure!
      Just use a well-made engine. It already has nearly all of it. Start with the most basic 1-hour-in-3dsmax models, and some basic rooms, to test out the concepts.
      Then gradually improve the game. Do not focus on high-res stuff. That's what eats up nearly all of the resources. You see, most modern shooters are not much more complex in terms of game mechanics, than Quake 1 or Quake 3.

      And: Yes, I know such things.

      He meant the resolution of modern models, maps and textures. But I think that is secondary. Look at how little Flash games on Kongregate vastly outperform even some huge multi-million game projects.

      I would do just focus on ingenious funny concepts. The Duke always was about his attitude. But it was limited. Go full-fledged berserk on this. Make it deliberately offensive to conservatives, just for the fun of it. Booze, drugs, Coughing Nails (the same of cigarettes in System Shock 2), a red-light-district, and comedically retarded aliens. Explode large buildings, hell, add tons of huge explosions and overly big guns to it. Add everything to the game, that lets him show his ego and attitude. :)

      Just do not go the way of Serious Sam. That's when you know you went too far. ^^

    I can see why they are angry.. I can even see why they might want to sue but aren't they leaving a bit late? 3DR has already gone bankrupt, so they unlikely to be able to pay them any substantial cash anyway.

    The whole DNF failure is largely 3DR's fault - they were the guys with their fingers on the keys, but Take Two have got to accept some responsibility for letting them get away with consistently failing to produce the goods for such a long time - I mean a few delays are to be expected in any project of this size but surely t some point you've got to get the distinct impression that all is not well. And I would have thought that would have been, y'know - in less than twelve years. Surely if nothing else the continual industry ridicule must have been a small clue?

    What most people don't realize is that Take 2 NEVER paid 3D Realms directly for development on DNF. 3D Realms self-funded ALL 12 years of development. The money they're suing them for was for publishing rights purchased from GT Interactive and Infogrames several years ago. This is completely separate from 3D Realms.

    Most people assume this is a typical publisher-developer relationship, but it's not. Take2 doesn't own the rights to the game or any of the content in it... only the rights to publish it whenever it's done. 3D Realms ran out of money, asked them for some, were denied, and had to close down for lack of funds and all their employees are now looking for new employment in a horrific economy.

    It's a shame 3DR couldn't have gotten it together sooner.

    I don't really feel that I missed out on too much because Serious Sam filled much the same niche in my mind... first person shooter with lots of humor and non-stop waves of baddies, an arsenal of weapons, piles of gibbs, and a chain saw for when things go really pear-shaped.

    2) give Infogrammes crap for selling them a pig in a poke

    Yeah, that's what we need, DNF to finally be released as some slapped together pile of tech demos by Take Two code monkeys. The only hope of a worthwhile release that I can see, and it's a very long shot, is that what currently exists of the game is released to Duke Nukem fans, who hopefully make up for in love and enthusiasm what they lack in expertise, to make something out of.

Eventually you have to provide a product and not feel strung along. In this case I think Take2 patiently waited through the good economic times, and now it was time for them to recoup their investment.

    i wonder what will the dnf designers/developers do now? when they apply for a job in some other graphic/game designing, what will they say they have done in the last 12 years? looks like they milked the cow too long.

    A preliminary injunction has been filed, I would guess to keep the IP from being idly sold off in the bankruptcy, but no lawyers for 3DRealms has been noted on the site. "Disposition deadline" is in August 2011. How swift is that?

    Take Two may be using this suit to establish a claim it can take to the bankruptcy court. Once there, however, it'd have to swim with the other creditors in the pool and fight for whatever morsels it thinks is coming to it.

    Careful, at some point there was the possibility for DNF to be completed. I remember seeing TV commercials about it but it just never happened. I never saw a single TV commercial for Blizzard's Starcraft: Ghost, and you know what, that game never happened. So if you see a commercial for Duke Nukem Forever, after the great success of Duke Nukem 3D, and playing Duke Nukem 1 and 2 (side scrollers) as a kid for hours, what would you think....THEY'RE MAKING DUKE NUKEM FOREVER. Fast forward quite a few years, we've passed through many iterations of Half-Life, id Software was reborn and moved on, the Unreal team moved on, Call of Duty was rediculous, computers for the most part, all but lost the gaming wars and that is only because games like WoW exist on the computer.
