New Zealand Spy Agency Deleted Evidence About Its Illegal Spying On Kim Dotcom

An anonymous reader writes "The latest news in this: GCSB appears to have deleted key evidence in the case in a ham-fisted attempt to cover up its illegal activities. Even more ridiculous, GCSB is trying to cover this up by claiming that the material had 'aged off' — implying that it was deleted automatically. New Zealand Prime Minister John Key claims that they had to delete the information under the law. Of course, there are a few problems with that. The first is that under New Zealand law, like most countries these days, parties have an obligation to preserve documents likely to be necessary in a legal case. But, even more damning is that there's video of John Key in the New Zealand Parliament trying to defend against an earlier claim that GCSB had deleted some evidence by insisting that GCSB does not delete anything ever:"

      I expect what's more likely to happen is that people will spam FUCK BETA and make similar posts in the comments sections of all stories. Comments are what keep people around Slashdot these days and if the comment sections falls apart, the site will follow.

      It's much more likely than a boycott and since the idea of doing so seems to have spread rather quickly across Slashdot, people like feeling like they're part of a group of protesters who might actually be able to make the change they're after.

      Which other site should I enable? I have /. and fsdn unblocked. Doubleclick is advertising (Which is disabled anyway), as is the two Google sites, and RPXNOW is social login. I don't see any others listed.

      You are responding to an AC who lately seem to spamming /. with IMHO stupid comments. If they have a legit issue why don't they create an account and vote. Oh wait they are an AC.

      I have seen the Beta and I personally don't find any issue with it. Sure it is different but it not so different that that this site becomes unusable. Personally when you are a Professional IT person you should be able to accept change sometimes for the better and in some cases for the worse.

      Well I guess I can't do much moderation at the moment because I don't really like rating AC's as "Flamebait" and Troll" since IMHO it is a waste of moderation points.

      I totally agree. I only visit Slashdot for the comments (the news is often posted elsewhere up to 2 days earlier). No comments, no slashdot. And I noticed that the comments section is pretty bad in the beta (far less comments fit on screen, with much more whitespace, making it more difficult to browse the comments).

      Just tried it. It's far from unsalvageable but it has a couple of simple, but massive flaws. One is the skinny comments section. That sucks hard, make it full-width. The next is that Slashdot seems to be following the trend of many sites to become more like Instagram. Lay off the pictures, don't put a big pic with nearly every article for the sake of having pictures, which is exactly what's happening. If it's really relevant use a small one, not some giant pic I have to scroll past taking up big chunks of valuable content space.

      Last one, and it's not a big one, I'm not sure I like the more minimalist content section. I'd definitely miss the comment ID link and friend/foe indicator.

      I don't know what your beef seems to be with anonymous posting. Why not try judging people based on the content of what they post instead of what name they chose to post under? If you have a problem with the content of a post, then say that. Choosing to post anonymously or not has nothing to do with whether someone has something legitimate to say or not other than there might be a few more off-topic AC posts (and even that's not exclusive, there are plenty of off-topic and silly posts coming from non-ACs).

      Well I am using Chrome (32.0.1700.107 - latest stable release) on Fedora 20 and don't have any issues. On the off chance I ran this on firefox (27.0) and still don't have any issues. Ok I will try Konqueror under KDE 4.11.5 ... Nope still don't have any problems. I even tried the Beta without logging in and I still did not have problems.

      I won't deny that the Beta display is not the same as the original /. display but IMHO it is not that bad.

      Of course if I hold my control button down and scroll I can get can get something approximating your picture but why would I want to do that.

      That is not zoomed in nor out. And I don't know why you would think it was zoomed, the ratios would still be the same; only about half of the window's width is actual content, ie. comment text.

      No my beef is not with AC's in general since some do produce quite good comments and as a moderator I will mod them up. My main beef is with AC's who spam this site and what they are doing at the moment is spamming or if you like, writing ridicules amounts of "off topic" comments. Yes there are off-topic and silly posts coming from non-AC's but they are normally moderated as such.

      You do notice that I am responding to you since you have an account and giving you the curtsy of a reply explaining why I am annoyed with the AC's who are IMHO spamming, however it appears that some AC's are being quite nasty with no reason given except a child's reply of "F**k You" but I suspect I have ruffled some feathers which is fine with me since /dev/null works perfectly on my system.

      Okay; I'm reading the beta now, on my tablet. Trying to give it a chance. The fact is that, I tried it before and it is better than the puke making state it was in before. However the sad fact is that this just gives me the chance to see how awful the changes really are.

      In posting mode I can't see the comments in the article. There isn't even a button to quote the parent which I normally have. In the end the main thing ends up being the thought that the "fuck the beta" people are right.

      However I'm a positive, creative kind of guy so let me instead say something about where they should go. The most insightful article to explain what they are doing wrong is Joel Spolsky's Things You Should Never Do, Part I. Fundamentally this project needs what Joel calls "adult supervision".

      Where to go from here? A fundamental is the need to learn from both new and old

      • The old code is clearly achieving the business aims of running Slashdot better than the new. Start with that as the base of the future Slashdot.
      • Make automated tests for all features.
      • if there is a need for a new format, restructure the code so that both can be supported indefinitely from the same code base
      • make the decision to shut down only at the point where almost all old members have moved voluntarily because the new site is better

      The parent post is right. Comment density on screen is what makes Slashdot more readable than the average newspaper comments section. intelligent comments which actually reply to their parent are also crucial. The Beta seems to be ready to wipe out both.

      I just realised; there isn't even a preview button. All errors are beta's responsibility.

      Hey there - I often read slashdot on my phone but - always - with the phone turned on its side and desktop mode selected. The 4 word lines in the beta design are REALLY annoying !! I am completely mystified as to how such an awful design idea ever got any traction at HQ - it was always obvious it was goinging to be widely and quite rightly detested.

      Judges don't take kindly to things like this, plus Evidence Tampering is a separate crime.

      Then there's the fruit of the poison tree argument. I don't know about NZ, but here in the US all evidence that comes from illegal evidence is considered illegal. So if the original evidence against Dot Com was illegally obtained by the GCSB, then everything, including all the search warants, is inadmissible. That's probably why it was deleted. When Dot Com's lawyers go to make that argument expect the government to say something like "you have no proof."

      I was one of the happy few 'til yesterday when I decided I should take a look. I took. And I was kinda glad I didn't have lunch yet or it would have been a waste of money.

      Slashdot beta looks like, well, pretty much any mediocre news aggregation site out there. Not really awful, but it feels a load slower and it looks like someone took a course in some kinda edgy new technology and now feels the urge to show it off. Remember when the AOLlers found out about HTML and how many bells, whistles and FLASHING gadgets you could fill a page with? Like it or not, that was the first thing that popped into my mind when I saw it. It sure felt like someone wanted to do a "wow, look at me" stunt.

      I might be an old nerd, but to me, less can be more...

      What I like about the "old" Slashdot is not only that it's faster. That's an additional goodie. But first of all, the pictures are smaller and the text gets more real estate on the page. Yes, I like it that way. If I wanted a picture book, I'd turn to the son of a friend of mine, he's 3 and he has plenty of them. I don't need a news page that looks like it's aimed at 3 year olds. I feel kinda insulted that way. I know, it's the trend with newspapers and online magazines all over, and guess what the net effect was: I STOPPED READING THEM.

      It seems the makers of /. fall for the same fallacy the makers of MMOs all over the planet fall for: WoW did it a certain way, so we have to, too, because WoW is the biggest out there. Possible. But you will not attract the players of WoW because, guess what, they already have what they want! The only thing you can accomplish by becoming more like them is to lose those that are with you exactly because you're NOT like them and because they hate what they are.

      But I trust the market in this very special case. As soon as /. is no longer useful, something else will pop up to fill the void. As I usually say when it comes to others that piss their users off: They need us. We don't need them.

      However , the US may have a copy of everything, or maybe one of the other 'eyes'.
      The right question to ask, is can you not retrieve this evidence from tour partners?
      If the answer is no the maximum damages should/must be awarded, PLUS a declarative judgement that all transmitted evidence is null and void, and at law, permanently declared hearsay, upon penalty of perjury (of nz.gov).Slap on a permanent injunction, and them Mr dotcom can go for broke on commercial damages. libel, and the works.

      Illegal conspiracy caused untold damages, the evidence was then destroyed - Why would you not expect a severe unfavorable outcome.

      Note: In .au, the destruction of tobacco related evidence - was allowed after the claimant died with Clayton's 'retention policy'.

      Probably not. I am however pretty sure that they have something that serves exactly the same purpose under a different name.
      Even if you go back to old monarchies there are documents regulating what a king may or may not do, how a new king should be elected in the cases where it wasn't hereditary and such.
      It is mostly a matter of semantics.

      In my nation there is no document called a constitution. There is however a document serving the same purpose and there is a constitutional council that has to make sure that the government doesn't create laws that are against the fundamental law.

      The beta needs work. The comment forum is problematic. Images are a bit too big for my taste and they're not well selected to fit the theme of each story - but that's an editorial problem, not a software glitch.       I remember when the current look came in several years ago. I think it had round corners and a different color scheme. I didn't like it at first - cosmetic change is as hard for nerds as math is for Barbie - but I soon got used to it. Hopefully that can happen again if necessary. If not, sayonara Slashdot.

      You're correct but it's not obvious that the law will actually be applied in this case. Clearly, the NZ and US both really, REALLY want to crucify Dot Com and are willing to break the law, cheat, lie, steal, defraud and everything else in order to do it.

      As an American, I can tell you that US definitely wants to get him as it's what our overlords in Hollywood (including the RIAA) want. It's really difficult for me to see why NZ would care much at all, but I can understand that the US might use pressure to make them care. However, I have to agree with what another poster said in saying that NZ might be deliberately screwing up as a way to (secretly) protest being goaded into action by the US.

      I am from NZ and I seer this from the inside, the problem is the Govt has been caught doing something illegal so now its face-saving time, I very much doubt that the documents have been "lost" or "Aged off" Simply because the documents are not that old (your supposed to keep your Tax receipts for 7 years) I doubt that any information was deleted with no other sources.

      The Govt is getting increasing pressure from the US to extradite him so they can lock him up (after a wonderful show trial, prob televised) The US can and does influence NZ quite a-lot, we have been forced (and I do mean forced, though threat of embargo) To approve of quite a few US policies, Hell we are still made to buy surplus US military equipment. The US is a major trade partner for us the loss of their Custom would cost us dearly.

      On the other side of the Coin, Most NZ'ers are outraged that Kim has been target (esp by the US) and are doing Our best to try and stop him being deported, but sadly there is little we can do apart from try and drag this out in the open and slow down the court system. We will most likely lose, he has done nothing wrong by NZ law but with billions of dollars in trade at stake we have little say, In the end it comes down to money.

      We have hope though, if we can stall long enough till november (ish) our next set of elections roll around and with any luck the dominant party will change to labour, if this happens they will most likely stop the cases and allow him to say as a political "we're better than you stun in national face"

      The beta commenting system is so bad I couldn't even preview and post from there. But I'm sympathetic to beta fuck ups. What's actually broken will work out in time and the stylistic issues people dislike will either lead to an exodus or be resolved in some unexpected way. For example, I dumped Final Cut Pro when Apple went to X and have been pleased with Adobe Premiere. But I have to admit that Apple has resolved many of the initial complaints made about FCP X. I'd reconsider now, even though l'm happy with Premiere. /. admins have to do something. They're getting eaten alive by Reddit /r/technology and the site is arguably a better service with more interesting comments. I'd like to see a resurrection of /. as a tech news aggregation power site. Reddit is showing real problems with mod abuse. There's an opportunity retune and challenge for audience share here if they get it right. The admins don't have to target all of Reddit. Just the slice they're perfect to steal market share for.

      Competition is good.

      If you were a desk-jocky in NZ law enforcement, why would take the risk of destroying document and potentially go to jail, when you could simply not both, and have only your career on the line. It's not like they fire public servants.

      Sometimes I think the screw ups in these operations are a result of ground level employees deliberately doing their job instead of following orders that could get them arrested.

      IANAL, but there is such a thing as negative inference. In other words if you don't produce evidence that you could or should be able to produce, the judge has to assume the worst. So if they delete evidence, the judge has to assume that had it been produced, it would have been worst case for you.

      It could be a little of both. If you were an investigator/prosecutor/advisor/etc and the case is against a genuine criminal, you care about catching/convicting them; this is why you became an investigator/prosecutor/etc. You are going to push for an effective investigation, follow every lead, and try to prevent screw-ups which will harm the investigation/prosecution.

      But if you feel the case is due to political pressure by the US and obsequious douches in government, you just don't really try very hard. That "I don't care" factor amplifies the apparent incompetence, even if there isn't active sabotage.

      [Plus the people who want to be assigned to political case are usually the most suck-up-kick-down douchebags. And they are often that specific type of arrogant-incompetence that causes things like this.]

      I find it hard to believe that the government of NZ is subjecting itself to ridicule, expense and possibly legal jeopardy to protest the actions of the US. They have diplomats to protest whatever they want to the highest levels of the US government anytime they like. No, I'd guess that they really are just that incompetent. That US, entertainment industry, pressure and bribes caused them to ride rough over NZ's laws. With their actions starting to come out into the open and be seen by the NZ public they are working to mitigate the damage and or cover it up. Whether that effort will work remains to be seen.

      Whatever happens here I think the significance of Kim Dotcom's case is that it shows how these intelligence agencies are actively being abused by governments. You can bet that this isn't the only case that sort of thing is being done. This is just the one where they got caught.

      i agree with the outrage, but I guess today i'm feeling particularly pessimistic because I honestly don't think anything we do will matter. After all, as long as they maintain ad impressions that's all that counts. Who the fuck cares what the site is about, that can be changed anytime. Just keep those ads coming.

      The primary problem with "classic" slashdot is that it devotes entirely too much of the available space to comments when it could have more space for branding and advertising. What the fuck were the morons who developed slashdot thinking? That they were providing a forum or something for people to post in?

      I was able to fill out the proper "comment on slashdot beta" questionaire.

      Strangely, the options in the multichoice ballot dont have a suitable "No, I REALLY dont like it" toned option, while providing a "OMG, YES, I LOVE IT WHEN IT ENTERS MY ASSHOLE! ALL THAT BLOATED WHITE SPACE INSIDE MY CAVERNOUS BOWELS FEELS BETTER THAN AN IPHONE5 ON VIBRATE!" toned option. The bias is clearly evident on the ballot in how it is designed and worded.

      Be that as it may, I basically told them that if the UI cant be rendered correctly and cleanly using the old UI paradigm in something simplistic like Dillo, they are doing it wrong, and the only things that Slashdot really needs for features are the ability to edit posts for registered users, and unicode support. That's it.

      When asked what I like about Beta, I gave a terse one liner.

      "I don't."

    I have spent ages here, and took part in some very intelligent discussions.

    Slashdot has always been about the highly educated user base, you could always count one at least one knowlegable person in the comments getting to the heart of TFA.

    It has been in decline the last few years, maybe because new users find reddit first (and then they are reduced to drooling zombie basement dwellers) or maybe because the editors are worse (though complaining about the editors is nearly as old als /. itself), I don't know.

    But this site redesign will be the end of it once and for all. The main selling point of slashdot is it's userbase. Scare them away and all you're left if is a generic 'news' rehashing site.

    But the stubborn pushing of this disastrous beta (office politics? nobody wants to be mean to the nice new designer?) makes shure it will at least go out with a bang and not slowly fade away.

    I watch with a sad sort of amusement as if my old college dorm where I spend so many good parts of my life is burning to the ground because the homeowner thought it would be a good idea to replace all woodwork with cardboard.

      I'm surprised nobody gets this. The new slashdot isn't for you; it's not for the current userbase. They want a more marketable userbase. They want companies to pay to have stories posted (speculation, but I get that impression from the new layout since the focus is more on the posts than the discussions.) Why? because good community driven discussion sites simply aren't profitable enough.

      The new site doesn't "suck"; it is designed for more consumption and less interaction. Of course it actually sucks, but that doesn't matter. Dice is counting on a new wave of less sophisticated consumers to replace everyone that will leave. Those consumers are accustomed to the kind of website Dice has made, and Dice is betting that those users will be more profitable than the current userbase.

      So there is no real point in bitching about it. The decision to switch to the new beta was made last year, and that decision had nothing to do with the quality of that beta site. I wonder if this beta plan was being kicked around years ago when Rob left....

      Slashdot is dying. Let's not waste the last few months of it's existence bitching about something we cannot change. Instead, lets enjoy what time we have left.

      In my opinion, dice have taken a look at the amount of ad revenue they get from /. and decided it's not worth it. A very sizeable percentage of people here will run adblockers and the click-through rates of the ones that don't are almost certainly minuscule, and the community here has been traditionally very wary of paid placements masquerading as news, shills and all the rest of it. People come here for the discussion, yes, but that doesn't make dice any money.

      So the decision was undertaken to alienate the existing community into leaving, and once they're gone expect heavy cross-promotion from other dice sites to get those users here as well. The comments will remain a meaningless mess but that doesn't matter since the beta seems expressly designed to make having a conversation as frustrating as possible.

      This all probably sounds a bit crazy conspiracy nut to be honest, but given the continuing beta, ignoring of all feedback and no response from the admins themselves about the beta's many, many issues, it appears to be a fait accompli.

      Sufficiently advanced malice is indistinguishable from incompetence.

      When a nation has conflicting laws it tends to cover illegal activities as any court can choose to take the view that supports the government. The US has loads of similar conflicts such as a constitution that gives all people the right to carry a gun and then passes all kinds of laws that restrict the right to carry a gun. Then to make it worse we have really bizzare laws regarding using that gun. The founders intended us to be able to use guns and not tote them about as jewelry or hip ornaments. We will see a bunch of hoots and hollers over the 71 year old, retired, police chief in Florida who shot a young man in a theater. He has a perfect stand your ground defense. First there is a conflict over a phone used in a theater. The senior citizen is screamed at and then popcorn is thrown in his face. That is enough to cause great fear in a 71 year old man and use of deadly force is completely justified under Florida law. In essence when a person reaches 65 the law provides very special protection. To cause a senior to feel fear is in itself an assault. The battery is the popcorn. All it takes to get shot in Florida is to display an angry face or posture and act as if an attack might occur. Now watch the public reaction. Yet the founders intended that rude behavior was sufficient to use a gun.

    I remember reading the hate back then too. The vitriol this time is much more pronounced, and empassioned. Last time, there still somehow managed to be comments that were on topic to the story submissions, and a fair amount of people that liked the new UI layout.

    This time? I haven't seen a single taker for somebody that likes it, and have only seen troll type posts complaining about the complainers. We have well respected 4dig UID members openly endorsing the hate.

    The best part about Slashdot for me was really the people who visit it. This site has had one of the most intelligent communities around. This is how the site is successful IMO. Really good people massing together behind it. Finding and promoting articles is one thing but the commentary is where it really takes off. Almost every time I view a story what I find more interesting is the story that develops below it. I really don't know of another site where I can attempt to follow a debate about nuclear fusion, and find a debate about Apple only a page apart. This is about to be taken away as the best and brightest around here are going to leave as they are fed up with these beta changes, and Slashdot as a quality site will die. The new site takes away from the comments and the user driven atmosphere and plasters it with pictures and wasted space. This protest may seem futile at first to the bigwigs at the top here, but like I said the best part about this site is the comments. Therefore, if the only comments left are ones complaining about beta, its going to be a very accurate view of the future of Slashdot from here onward if the beta continues.

    I agree that the hatred here is much deeper.

    And I suspect the reason is that the "upgrade" to Beta isn't actually upgrading anything. There's not a single new feature or improvement.

    The change to the current UI added things like collapsible threads, reply windows within the thread, etc. Beta is struggling merely to keep standard features like threads, moderation, or even the most basic stuff like displaying fonts correctly. Once they have code which broadly replicates most of the current functions, but in the new idiotic blog-style they've chosen, they'll call it done and push it out. All that effort and hatred for what amounts to - if we're lucky - a re-skinning.

    I've already sent an email stating that, if beta becomes permanent, I will be deleting my account and not returning to Slashdot. If everybody gives their feedback about the Beta, perhaps they'll realize that they're going to lose all their money when we stop visiting.

    I have been a regular visitor to Slashdot for around 15 years. For that, I get the checkbox to disable ads, though I browse with Javascript disabled so my browser does not slow down.

    I come here for the discussions, and often read comments at +5, changing that only if I find a discussion interesting and warrants reading at a lower level.

    The new beta uses JQuery for the comment threshold selector, and changes that on the fly. This means all the comments are loaded, but not visible, and processing any page with considerable number of comments will slow down MY computer! If I have a few tabs open to read later, my computer will be unusable.

    What is worse it that they require you to click on the slider on every article to change the threshold! This is just insane!

    If they insist that I enable Javascript to browse the site at the threshold I want, then they will lose me as a long time. I imagine that others long timers will hate the site too.

    Dice have to remember that this site has two unmatched features, interlocked: a moderation system that is good at cutting down the trolling, spamming, and noise, and a comment section that is frequented by many people who are passionate about technology and other nerdy stuff.

    If they wanted to intentionally ruin the site and drive people away, they would not have done any worse than what they are doing now.

    If they manage to aggravate a lot of their users, the comment section will no longer be attractive to the audience. Perhaps we should revive kuro5hin?

    I wrote the above in a feedback form that I filled a while ago, and I am emailing this comment to their feedback@slashdot.org. Please send them feedback too.

    And mod this up so Dice can see what they are getting themselves into.

No amount of absolute proof publicly stated about the hilarious inconsistencies in the lies of their masters will prevent the NZ sheeple from 'voting' (the act of empowering the elites), or slurping up the sh*t produced daily by the mainstream media.

    When Tony Blair first came to power, he understood that the problem with the world was that no person had ever DARED to exploit the sheeple to the maximum extent made possible by the modern nature of the world. Blair set about introducing programs in every sheeple space to rectify this. Getting the USA to fight ground wars again was a no.1 priority, and when Blair failed to achieve this with the Kosovo War, 9/11 became necessary- a new 'Pearl Harbour' as Blair's Neocon allies exactly described it prior to the date of the false-flag.

    Blair spent more time than any American politician travelling the World, and propagandising the need for Blairite changes in the aftermath of 9/11. Blair ensured that the Intelligence Agencies of the West (and by association, the agencies of ALL nations with the ability to operate such) would undergo a program of expansion without financial limit, exploding the powers of the police state across the entire planet.

    Most of Blair's allies, like the Human garbage that rules New Zealand, are moronic, vicious, low quality chancers. It's like any mob operation. The need to have people on board is greater than the need for 'quality'. Would Blair prefer his NZ goons to lie better? Of course. But Blair knows in the greater scheme, the worst that happens is that a small percentage of sheeple, destined to wake up sooner or later, are awoken a little sooner than later. Blair's is a numbers game, but also a game of dis-empowering those that, in previous times, might have rallied against his plans.

    Organising against government corruption is as dangerous in NZ as it is in Saudi Arabia. You, the sheeple, are encouraged to think ONLY about the absolute penalties (so, how can NZ be as bad as SA, if NZ doesn't behead or whip?). But, the actual penalties don't matter to Blair, just their effectiveness in neutralising opposition. The right to effective protest, regardless of public support, has been wiped out by Blair's co-ordinated actions across the globe after his 9/11 action. And this isn't just true in nations like the UK and USA. Blair's influence is present in every other nation- where draconian laws (like those just imposed in Saudi Arabia) are justified by referring to governmental actions in the UK and USA. .

    The new BETA design is GREAT in the eyes of the business people behind revenue generation at slashdot, All the white space they created is just a place holder for all the advertising spam thats going to fill it gradually. I highly doubt the designers of BETA were thinking how can we make the users happy by making it more readable. Unfortunately for them and for us, increasing their revenues at the expense of user's happiness is a mistake that will only hurt them long term. Plenty of other good news sources to choose from.

    The judges have so far been surpisingly enlightened in their handling of things related to Dot Com. While other parts of NZ government have been busy following the Hollywood script the judges rulings to date have called the police etc out for law breaking. If the judges stay to form then the GCSB are going to have difficult time in court.

    It promises to shake things up from the stale old party options. They will get my vote. It will be interesting to see if they can break the 4% threshold to get in parliament. Given how close Labor (left) and National (right) are if he can get enough votes DotCom's party could hold the balance of power. Unlikely, but not impossible, it would be the ultimate irony that DotCom could have a significant measure of influence on those who wronged him..

    Most of us Kiwis don't see the need for a spy agency either. They are generally benevolent data sleuths so the media feels safe enough to rip a new one out of them every time they do something stupid. Very occasionally something genuinely bad happens, such as the bombing of the Rainbow Warrior by French secret services, and then it's nice to have some smart guys on our side... Actually, I think they stuffed that up too and released the French secret agents back to France, where they spent the rest of their careers teaching the next generation of agents! BetaFuck GCSB!
