If the US gov't had the policies of the Chinese gov't, this hypothetical somebody would need to apply for permission to move and face the prospect of not being allowed to do so because of bureaucratic whim.
In actuality, rather than base one's freedom of movement on government permission, the US and many other countries utilize a somewhat less discriminatory set of criteria called "affordability."

No. Hong Kong has its own civil code that grants all those liberties we're supposed to have in Western countries. This code will remain in effect until 2047 when HK completely falls under the Beijing government. Or until the HK government decides to change it of its own accord.
