You are confusing TCP/IP with the term "public internet". The protocol is different to the concept. Public interconnected networks, no matter the protocol, seem to fall under this FCC Policy.
On top of this, if you are serving up TCP/IP packets to the user but the technology in between is not TCP/IP, well, there is no difference as far as the user's perception. Add to this that interception of traffic goes against laws (at least where I live it is), and you've got a very strong case for knocking down any interference in the service.
I've had a phone company here in Australia try to claim that internet traffic on a phone isn't internet traffic and therefore they didn't need to update the usage meter under ACMA (Australian Communications & Media Authority) regulations. After a year of the TIO (Telecommunications Industry Ombudsman) investigating I was advised I wasn't liable for the charges that were acrued due to their meter not updating. Their case of "it's data not internet" didn't wash. I'd like to see how a case like this goes in the US where you don't have consumer protection like we do in Australia.
And no, I didn't have to pay any legal fees, or even turn up to any court hearings. The TIO investigates and refers the matter to the ACMA for enforcement. The company that did this was not only told to fix the usage meter, they were charged a minimum of AU$1500 for the case going to a level 3 investigation (which was much more than the amount they would have received from me).
He was also on Q&A (another show like Insight, but on ABC http://www.abc.net.au/tv/qanda/) last week saying the same thing. Pretty much he's merely using this to support his denial that the list leaked was a real list.
He even states the list is only 1300 sites big, rather than the 1600 that ACMA state. Pretty much it's not a backdown so much as a side step.

I tend to agree with this. I did, once upon a time upgrade my Windows machines regularly, but now it's more of a wait-until-there-is-a-new-generation-and-upgrade sort of game. I don't know anyone who upgrades their machines anymore.
I've had non-techies ask me about upgrading, most of the time I say "well, you can't do X because you don't have Y, and it's actually more expensive to get components that are compatable with Z". The only retailers or wholesalers that have older components have hung on to them to jack the prices up for business' that are running outdated machines.
I bought a Mac Mini recently for my 2nd screen because I wanted a machine just for mail, web and music. It sits there on my desk, doing it's job and not skipping a beat. Sure it cost a little more than other machines (about AU$200), but I know I won't have to screw around all the time with it like I have had to with cheap Windows machines (they have a tendancy to have components die at inopportune times). I'm never going to have to upgrade it, never going to have to fuck around with it, just leave it there and let it do it's job. Plus, it can fit ON my desk rather than taking up room under my desk where, you know, my legs should be.
