    I'm sure since you linked to it, you read the rest of the words on that page, and while i agree that the idea of fair use is on the books, it seemed clear that was not regarding digital media, as almost all of the examples listed were regarding textual sources, and the few that weren't are almost not about copyright at all.

    In fact, if you want to claim fair use, just make sure your favorite music is being played in some news report, and i think you're fine.

    I'm not saying that fair use can't apply to digital media, as certainly the main concern on slashdot, but that legal/judicial precedent is much more valuable in this case than the actual law.

    No, like everyone else, they were motivated by money.

    Seriously, when designing the rover and the instruments, pretty early on you get an idea of how long the thing is supposed to last. it drives all sorts of engineering things such as materials, power supplies, and data retention. Had they needed this thing to last 5x it's normal lifetime, they would have to test it a hell of a lot more, spend much more money on more expensive parts and materials, and probably would only send one of the things.

    And i doubt the engineers had a realistic view of how much damage they could take. Maybe they knew what they could take in earth conditions, but that's a far cry from mars- but any type of in situ instrument, such as the rover, comes with some inherent doubt about what it will run into. You don't think the engineers at JPL (who built the rovers for NASA) are just as amazed as we are?

    "We're never gonna hire those yolks again" rarely plays into it from the engineer standpoint... the project manager, though, is a completely different story.

    It's interesting that we don't really have any idea what their patent actually says yet we all know it's incredibly obvious! Why wasn't it patented earlier? Maybe they do something differently? Maybe it's not that fact that they can do it, but rather how they accomplish it that is patented.

    You can patent dropping rocks on the ground if your method is new, better, or improved upon the earlier design. a catapult would be a terrific way of "dropping" rocks on the ground.

    I won't even get into how the rest of your analogy doesn't apply in the slightest. Plus, it doesn't involve cars.

    I'm replying to this one, but i mean to reply to all the idiots here. I know you actually read a summary for once, but the punishment is not using windows. That was a clever, incredibly biased remark by the submitter/editor.

    He can only use windows because part of his probation is to be monitored. If he doesn't personally purchase/install his own windows, then he simply cannot use the internet/computer. As for "I'll do this once they leave" ideas... are you guys really that dumb? I'm sorry, but you don't think that they would monitor his usage? If nothing is being monitored, you've got two options:

    1. he's not using the internet.
    2. he's subverted the monitoring.

    A pirate uploading material is probably damn well used to the internet, and will probably use it because it's hard not to use it once you have.

    MAYBE if he used windows for some time, and then used Linux... maybe he could get away with it by showing legitimate monitored windows usage. But then he's still using windows which is apparently like pulling teeth.

    Lastly, if it was you, would you risk going back to prison for 5 months just to use Linux over windows? Or maybe i should ask that question here...

    They aren't forcing him to do anything, they are telling him if he wants to do something, he has to do it a certain way.

    Unfortunately, it's not just bombs and guns that we should worry about when it comes to classified information (or even sensitive but unclassified, SBU). What about information that would take away a competitive advantage for the company? Disclosing blueprints of bridges could do this. Materials and weights/densities could also prove to lose both monetary and human assets if it gets into the wrong hands.

    It's important to realize the wrong hands aren't always trying to hurt people. And calling this movie fascists is quite silly. comparing it to Hitler is even worse. I work on sensitive projects at work and there are specific rules set up about talking about nearly every aspect of my job. Is my employer facsist? Or are they just trying to maintain security about the work we do?

    West coasters don't have accents, I've found, but it's more the words they use. Such as "hella" or the "surfer" lingo (what the hell exactly does "swoop danky gnar" mean?). But i suppose that's true of all places, such as the wicked awesome speak of the east coast. It's hella cool.

    So yuo demand proof, he gets some, and now you will ignore his opinion? I'm not sure why you even asked for proof in th first place.

    I'll agree it's not "common fucking sense" but he is not alone in this idea. I am well aware of the impact PS2 had on the DVD market, and you can see by Sony's strategy with the blu-ray player that they are too. It will jsut be time before we see if the strategy works again.

    Lastly, how does it read more like a press release? I mean, it's like you are struggling to argue at this point. i guess we can ignore your opinions, too.

    I disagree, while they are happy that Halo 3 is coming out, their projections of units sold took into account the release of GTA IV, a very different game than halo3 (and thus attracts a different demographic), and will therefor have implications on bottom line, and shareholder expectations.

    With everything going on recently, including the extended warranties, reversal on Xbox 360 not needing an HD, and GTA IV not being released... Microsoft can't be very happy about much right now.

    Gamers on the other hand, can be happy about a lot of cool games coming out, regardless of GTA IV.

    The problem with CSS - and I find it a healthy challenge - is that no two browsers render it the same. The more browsers my patron is aware of, the more duplicate work must be done.

    So you consider doubling the amount of certain effort to be a healthy challenge? No offense but that's my definition of "tedious and pointless". Would you miss the challenge if all browsers rendered things the same?

    Also, i highly doubt web developer jobs will be going overseas in the software programming sense. Especially if it is something like html/css front end stuff. Creativity is a huge part of front end design, and that isn't emphasized in most countries like it is here. I'm not saying this is bad or good, i'm just saying that American education emphasizes literacy and 'how do you feel about x' curriculum as opposed to a good healthy dose of science and math.

    The built in IIS server comes disabled. And do you really think that thousands of home users are going into their admin consoles and setting up IIS and have no idea of what apache is?

    They probably don't even know waht notepad is because word is so prevalent, right?

    On an aside, i don't think MS really cares what netcraft says, as netcraft can't see the thousands of intranet sites running IIS, the bulk of Microsoft services run behind firewalls.

    Why game companies think they can pinpoint a release date when more then 65% of commercial aps that go through (apparently) little to no QA can't even hit their deadlines is amazing to me. Are there certifications for gaming studios such as CMMI or iso-9000? I'm sure that will never happen but just imagine the kick in the pants they'd feel when they get a cmmi level 0 rating.

    Of course, often times it's the publisher that drives deadlines, so who knows if that will/can ever be fixed.

    I think i enjoy settlers of catan more than counterstrike. I just don't have enough people to play Catan with. great game- give "Puerto Rico" a try. But classic (video) games are in a different light than other varieties. Think about it- While a lot of people will eventually play chess, or checkers, or tic tac toe- if you missed duckhunt, there is a good chance you'll never play that game, it's weird how technology has made the past... more obsolete.

    What happens when it's given as a gift? I don't expect the receiver to hold onto a piece of paper for very long... I don't like this idea. Unless you can definitely determine that someone else is using the ipod improperly- this seems like a bad idea. But if anyone can figure this out, it's apple.

    It'll be interesting to see what happens. I learned threading by building an OS in school, and i'd imagine many other have done or will do the same. As for thread specific coding, i'm not sure if classes will teach an intel approach, i suppose that will depend on how much money is donated to their school.

    I don't think the Xbox market is going after PC gamers. No offense, but why do you think they release these games on PC? The publisher's know it's a different demographic. And your point about halo is correct, but you forgot to mention the fact that it could be anywhere between one and 2 years before halo 3 comes to the PC. I'm not saying that it cheapens the value of the game any, just it's a game 1-2 years old. Imagine being a die hard Final Fantasy fan and having to wait 2 years after everyone else played it to play... that person might buy a playstation 3.

    But that's hardly the point, while you might not find value in a 360, you're hardly who they are selling it to. Besides what the xbox offers is a constant uniform hardware that you can spend 400 on and be sure you can play all these games. a top of the line (bleeding edge) graphics card could cost you more than that alone.

    WE might not have them, but i've realized every kid (and their mother) owns one of these things. i'd pick one up but i'm just not sure where i'd play it besides work...

    i'll get one tonight.

    Also, Assassin's Creed is also coming to the xbox 360, s, you know, that's another reason not to get a ps3 now.

    ^^Exactly. When i saw this article and that it had 200+_ comments, i was thinking: What exactly could they be discussing... Should've known it's just people hating on Microsoft. I'm fine with vista having good sales records, i don't have vista, and wouldn't plan on getting it just yet, but i mean... it's not like it's the devil.
