What FISA crap? FISA has been around for decades. The problems came when the president decided he no longer needed FISA approval.

Apple has a limited set of hardware they need to target, and Linux/BSD have communities of millions dedicated to reverse-engineering, writing, and testing drivers.
Windows has no such community and no limited set of hardware to target.
Even if it did have people to write the drivers, it has no easy mechanism for approving of/ distributing them.
No one really likes DRM however there is little effort on the Anti-DRM Camp to come up with a solution that fixes the companies problem, of illegal piracy, or sharing a copy with your friends.
