    The suit turns on the question of whether Netflix should have known that their dataset's anonymity could be broken, two years before researchers demonstrated that.

    This is called a "state-of-the-art" defense, and generally doesn't work.

    State of the art defense is the defense that permits a manufacturer to avoid liability in a design defect case if at the time of manufacture there was no safer design available, or in a failure to warn case if at the time of manufacture there was no way the manufacturer could have known of the danger he/she failed to warn against.

    Lets say I was making Asbestos oven mitts, no one knew it was dangerous. The state of the oven mitt industry and materials science (the art) was that Asbestos was fine. Then, 50 years later we find out it's dangerous. The lawsuits will probably prevail because the "state of the art" defense doesn't stand up to strict liability.

    On the upside, she'll probably make some new friends in PTA. And who doesn't love hot buttered soccer moms?

    No, for sure. The are used for voice and simple data like text and coordinates. But they are the best of the best of 1990's military commo...

    I don't think we were saying "just throw a Prick-119 in the thing", just saying that highly encrypted and frequency hopping communications are ubiquitous in even grunt units....it should be a simple deal for flash-bang gear like predators and reapers.

    The SINCGARS is the standard today, though a few versions later.

    This has nothing to do with open formats.

    If you encrypt and digitally sign (aka DRM) your OO.org files, and loose the ability to decrypt them, you are in the same boat.

    This is a story about DRM, not formats. A story about the forgotten idea of key escrow idea and of DRM cert servers, not file formats.

    If only satellite data of North America existed before the logging industry swept in!

    If you look at North America, the forests didn't disappear because of logging, suburbia expanded into, through, and right past the forests. Population growth will destroy every inch of nature.

    But by all means, blame the "evil logging industry" like you don't use paper or live in a building that required wood or space to build it. And if you had over 2 kids, it really is YOUR fault.
