  1. Re:The Rub is the Sentencing Guidelines... on Does Hacking Grades Warrant 20 Years in Jail? · · Score: 1
FTA "The charges in the indictment are only allegations, and the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt."

Sure, one can say that there was identity theft involved, but, what -really- happened?
That's what the court case will do. They can't release anything else because I'm sure the accused aren't going to tell the "real" store if they *are* guilty...
Sentencing guidelines are just that... guidelines. TFA doesn't mention what the minimums are either, so it's possible they could get off easy

have judges doing the sentencing based on the facts of the case and the real severity of the crime
That's pretty much the job of the judge at the sentencing hearing...
The sentencing guidelines are the involvement of the legislative branch creating the laws and guidelines that the judiciary branch is supposed to enforce. Do you want the judges to have unilateral power?
  2. Re:Three holders of the same patents? on Vonage Settles With Verizon for at Least $80M · · Score: 1

I was thinking the same thing. I haven't looked at all the cases, but it does seem odd that Vonage is violating so many patents from the big telcos. You'd think at least a small patent troll company would have rights to something.

Sure seems odd that all the big boys are taking turns on the little guy. It makes me think that they are worried that if VOIP takes off, then they will lose their control over their local monopolies.

I mean, if all they could charge you was an internet access fee, and us consumers won on net neutrality, then they'd have to find another way to extort money from us consumers and that would be too much work!

I think Churchill agrees with you, but only in part. "It has been said that democracy is the worst form of government except all the others that have been tried." We will see how this trial goes for Australia. In regards to your ideas, I highly doubt any new laws would get passed at all. I know families of 5 that can't figure out what place to go for dinner, how would a city, state, or nation be able to always pass 90% and actually have the law be enforceable?

Maybe, just maybe (though I think he's really just completely lost it) he might be trying to see just how much he can get away with before they actually do dis-bar him. (I think that's the term)

Think of the book he could write afterwards about all the crap he did, and how much the system kept him in place? I'll bet there's even more stuff that we haven't even heard about (and plenty I'm sure we don't want to hear about.

Either way, I just wish the media would stop covering him (that'll make him stop more then anything).

They are working on a better system. Check out: http://wiki.secondlife.com/wiki/Architecture_Working_Group A comparison (with pictures!!) of the current setup and what they hope to transition to http://wiki.secondlife.com/wiki/Proposed_Architecture Tao Takashi reported this info, but spent more time focusing on the fact that they are trying to develop the whole architecture openly. If done right, I think it could even help games like WOW and EVE perform better (imagine the performance improvement if everything in SL was pre-made and optimized by game professionals for people who just wanted to go there and play?)

Wouldn't be a shocker if she was a gamer, but I'm the gamer. My wife's gaming activities are usually ones like the frog that spits colored balls.

She watched me play the demo and she wanted me to get it FOR HER! Unfortunately I have trouble getting her off the 360 when I want to play or watch TV. In fact she will probably beat it before I will at this rate.

It thought that before the storm NASA was saying that these dust storms were likely to kill the rovers more then anything. I'm excited to see the rovers go as far as they have and further, but I'm thinking that maybe NASA just wanted to keep everyone's expectations low so we over joyed when it beats them. All in all, I'm really glad they are doing so well.

  15. First thing learned on Why Myths Persist · · Score: 1

TFA seems to indicate something that I'm pretty sure is already known. That the first thing mentioned is what is remembered. Whether it is a myth or not, I don't think it matters. I think I remember this from a writing class, but I don't remember much else (so I suppose it could be a myth that just never was busted.)

  16. Lost revenue on Latest Music Piracy Study Overstates Effect of P2P · · Score: 2, Insightful

Yes, there may be a link to lost revenue, but I agree with Ars that is isn't 1:1. Also in this case, it isn't a physical good that once stolen, couldn't be sold again. If someone stole something from a store, it can't be sold by the store and the sale is "lost". Downloads are different in that they equate that the person would have purchased it in the first place. I don't agree with stealing content, but the study is lacking some connections.

Ok, I can download the demo for 2.50... OR I can go rent the full version for a week for $4-5. I'll go with option 2 where the game won't quit on me and give me a bunch of stupid splash screens after 5 minutes on why I should buy it!
