    Any VP8 patent that applies to H.264 may itself get nailed on grounds of prior art.

    It's almost a textbook definition of prior art when you already have a patent that covers the technology another patent is trying to cover.

    That's because NOTHING can defend you from a frivolous lawsuit when you still have to pay your own legal expenses.

    They are effective however, in much the same way as a stockpile of nukes. Mutually assured destruction and all that.

    However, when you have either a madman bent on world destruction, or just a regular asshole who wants to abuse the legal system, well, you're on your own.

    YouTube DOES have a community based flagging system, and admins are paid to review those.

    Up until the point where you got hired the work was entirely yours.

    At the moment they picked you up, your contributions became work for hire and they became a secondary contributor with you as their agent.

    The code is jointly owned by you and the university.

    Them hiring you doesn't trump any of the work you did solo before getting the job.

    Just the same though, getting your neck breathed down by a high powered legal department can change things in a hurry. Unless you have solid proof you worked on it before getting hired they will most likely be able to muscle you out of your rights anyway.

    As long as MPEG LA is threatening all competing codecs equally with patent suits, we can't really win on ideology front, so let's go with the codec that is most popular and also happens to have ubiquitous hardware support.
