    That's a good point, once they know it is there they can fabricate some legal probable cause and go look for more. If they do find a lot more evidence, that would be admissible if the court did not know they had fabricated the probable cause.

    "Better" is somewhat subjective. The iPod, IMO, was far better than the competitors, like another poster experienced I used one for five minutes and immediately switched. I don't own any other Apple products, none of them had that sort of impact.

    Perhaps better would be to hold them liable for damages due to negligence, and nullify the absurd "as is" EULA. They can pay Brian Kreb's DDOS defense fees for the next ten years.

    Trademark isn't the same as copyright, it only applies to similar businesses or cases where there might be confusion as to the origin. So you are free to make a Windows line of children's toys.

    I have to agree with Trip Chowdhry on this. In my experience you don't see that many high level folks leaving a company if all is well.

    Not as far as I can tell. It seems like his worst sin is declining to rule it out. There is a lot to criticize him over, but it seems to me this particular issue is a creation of his opponents.

    Where is the racism? Africans synthesize a less D than Europeans, it's a particular problem in the winter with a lot less sun exposure.

    The character set used is not necessarily tied to this

    . Korea and Japan have used Chinese characters at some point in their histories and theirs are not tonal languages. Vietnam too but I think that is a tonal language.

    Thanks, I didn't know that about starch digestion. Brings me back to Jared Diamond's book "The Third Chimpanzee" which theorized that the need to consume tubers was a major driver in human divergence from other apes. Heck, starch might even have been mentioned in that book but I don't remember it.

    I tried this once using cups-pdf. After about 8 months I shut it off, I didn't get any print jobs submitted to it. Very disappointing, I was really interested in what sort of things I might get. I guess no one is scanning the Internet for printers to print to them anymore.

    I think more likely, Twitter et al will simply be driving away users if they use this ability too much, and they will then start to go the way of the New York Times.

  16. Would you say that a presidential order restricting speech could act in ways that a Congressional law could not? That would technically avoid violating the 1st, since Congress has made no law. Your general point is correct, that private entities aren't subject to the first amendment directly. But it's important to note that the US constitution is more than just the written document, it is also all the court precedents which surround it. The UK has *no* written constitution the way the US has, it is all precedent and tradition. My point is you don't need to be quite so tired.

  21. How can he break any promises, he hasn't even taken office yet. He has merely SAID he is going to break promises. I guess he's backed himself into a corner with that. Pretty clever, now he can swear he kept his promises and just ignore the other set on contradictory promises.
