"Better" is somewhat subjective. The iPod, IMO, was far better than the competitors, like another poster experienced I used one for five minutes and immediately switched. I don't own any other Apple products, none of them had that sort of impact.
Perhaps better would be to hold them liable for damages due to negligence, and nullify the absurd "as is" EULA. They can pay Brian Kreb's DDOS defense fees for the next ten years.
Trademark isn't the same as copyright, it only applies to similar businesses or cases where there might be confusion as to the origin. So you are free to make a Windows line of children's toys.

Would you say that a presidential order restricting speech could act in ways that a Congressional law could not? That would technically avoid violating the 1st, since Congress has made no law. Your general point is correct, that private entities aren't subject to the first amendment directly. But it's important to note that the US constitution is more than just the written document, it is also all the court precedents which surround it. The UK has *no* written constitution the way the US has, it is all precedent and tradition. My point is you don't need to be quite so tired.
