Teens do not all have the ability to understand their actions.

The latest scientific and medical data leads us to postulate that the brain essentially "rewires itself" during puberty.

The reason your kid acts like a he doesn't know what he is doing is because he may not.

Having 12 and 14yr old boys I tend to believe this. Their behavior over the last few years has changed so radically that they are almost completely different kids.

That would mean that musicmatch should have won their case.

They let peopel "upload" CDs to their service and access them from anywhere. The physical posession of a CD was the proof of license.

If a CD was already uploaded the new user would not have to upload it, just insert it for initial verification.

Since there were controls inplace to prevent copyright infringement, there is therefore an explicit lack of intent.

However, I believe they were shut down just the same.

If any laws were broken here - who broke them?

Just because I leave the front door open does not
mean that anyone can enter and take what they

On the eve of his departure, he speaks with his successor telling him that if he has any problems there are three envelopes in the desk that were presented to him when he took the reigns of the company and that he should open one of them if he really needs help.

A year goes by and the company is having serious problems that our hero cannot resolve.
He opens the First envelope and reads:
    "Blame your predecessor."

He does this and is able to circle the wagons and work with existing management to resolve the problems.

2 more years pass and again the company is in dire straits. He opens the Second Envelope and reads:
    "Accept the blame for yourself."

He does this and is yet again able to circle up the wagons and working closely with management and employees is able to resolve the impending crises and bring the company back from the brink.

A few more years pass and we find our hero sitting at his desk gazing at a sealed envelope. The company is failing. people are leaving in droves. He has done all he can. With his last glimmer of hope he opens the third envelope and begins to read:

Look at the game console space.
The money is in the software not the hardware.
people are going to buy one console, and a handful of peripherals. They are then going to load up on the software.

It therefor makes more business sense for a company to give away the console (sell at cost) while building up a services group to provide the software, suport, and extensions to the original console.

First ID the need and fill it. The rest will follow.

Do not go the MS way and try to make all your cash up front OR make licensing the "tool" prohibitively expensive or illegal.

Encourage people to think of more ways to use your tool. The Internet was developed as a way to get noise data from atlantic to pacific. It was "released" to the public to help it grow faster.

Build it and if it fits a broad enough niche it will grow. As people invent new ways to use your "tool" the tool will begin to self evolve.

The more you give, the more the users will give back.
