    By USA law, the songwriter gets eight cents per track for any copy of a sound recording. In your pricing scheme, this means the songwriter would get eighty percent, leaving little to nothing for the performers and those who provide the service.

    I cannot recompile Photoshop because Adobe does not provide the source code for its applications. Heck, I don't even think Adobe could "just recompile" signal processing cores written in assembly language.

    I thought big3 refered to Ford, Chrysler and GM.

    After having merged with Daimler-Benz of Germany, Chrysler Corporation is no longer a USA owned automobile manufacturer.

    Microsoft is the only American owned major console manufacturer. (NOA and SCEA are wholly owned subsidiaries of Nintendo and Sony, Japanese corporations.)

    off the record, Nintendo, et al. aren't too concerned about importing of games (and DVDs, etc), compared to piracy.

    What about homebrew software development for Nintendo consoles such as the GBA? Here's what I've gathered about Nintendo's behavior in practice:

    • Devices designed for region modding, such as NES, SNES, and N64 region adapters and GCN modchips: Blind eye.
    • Devices that make piracy easy, such as flash carts with the same memory map as official carts: Lawsuit.
    • Devices designed only for homebrew development, such as the MBV2 cable produced by Lik Sang Manufacturing: Blind eye.

    We just have the region locks to keep the suits happy

    Specifically, 1) to distinguish 50 Hz (Europe/Australia) and 60 Hz (Japan/America) consoles, and 2) to solve the "Peter Pan problem", where different entities own a particular franchise in different markets. (Barrie's Peter Pan is in PD in >=1923 USA and life+50 Japan but not in life+70 EU.) So why did Nintendo put Japan vs. America region locks on the NES, Super NES, N64, and GCN consoles, but not on the GBA system?

    Not necessarily. In the United States and Canada, it's not illegal to reproduce sound recordings onto Compact Disc Digital Audio Recordable (CDDA-R) media, because the makers of CDDA-R media pay a levy to the government, which gets distributed as royalties to songwriters and recording artists. US statute reference: Title 17, U.S. Code, chapter 10.

    However, mass market acceptance wasn't the only factor in calling 16-bit 44.1 kHz stereo "high fidelity". The field of psychoacoustics advanced greatly at that time, and it became apparent that DC-22 kHz frequency response with 110 dB dynamic range and 90 dB signal-to-noise ratio (the difference is due to noise-shaped dithering, which was also developed around that time) was enough to fool the best of human ears.

    If you use a product such a vmware, it's a simple matter to start up windows in a virtual machine with a virtual sound card i.e. vsound.

    Recent versions of Windows Media running on Windows ME and Windows XP will not play copy-restricted audio over unsigned drivers. The driver for VMware audio is not signed.

    "So apply to get the driver signed." Microsoft won't sign a driver unless it turns off all cleartext digital outputs when playing copy-restricted audio, which means that the virtualizer would have to open a Secure Audio Path on the host operating system.

    "Then just use an older Windows OS." And risk newer versions of WiMP not installing.

    "Then just use an older WiMP." And lose support for new proprietary codecs such as Sony's, which is (knowing Sony) probably based on MiniDisc ATRAC3.

    "Then try something else." And risk doing several years of hard time in prison the next time you step into the UK or the USA, both of which have banned circumvention of access restrictions.

    That may work in general, where anybody can run a server, and the dial-up users can SELECT ip_addr FROM hosts WHERE min_connection <= 48000. On the other hand, Xbox Live returns no results for that query.

    At Rose-Hulman, every residence hall's network ports are switched. Thus, if you have few matches between one dorm and the other, and you don't go on Xbox Live (which is prohibited according to a strict reading of the ToS), that's not much of a problem.

    You refer to 17 USC 506, which defines criminal copyright infringement. However, the courts have interpreted "private financial gain" under 17 USC 506 to include gaining the value of the copy itself, even if no money is involved.

    Not necessarily. It's possible for a software developer to use a Mac to emulate the aliens' computer well enough to get a virus working. It's also possible for such a developer to write a custom protocol stack in Open Transport.
