    Incorrect. Motive and mental state are often used to determine punishment. Manslaughter, 1st degree murder, 2nd degree murder, etc.

    Except that Apple doesn't have a monopoly on portable music players. You might be able to argue about the iTunes Store but there are plenty of companies churning out players.

    usually because the ones that caused the problem in the first place (in this case CC and the police) will usually not apologize or admit any kind of wrongdoing. Leaving the court system the only option in teaching them that it is not acceptable behavour.
