I mean, malware could divert the checksum of his own memory bytes to the hard-drive and then divert many other bytes there too just to confuse the detector.
Well, according to the wikipedia article linked, they HAVE made that decision some times before. They have already said NO to it, it's just that people keep reopening the case for them to consider with "new evidence".
In my opinion, they're just giving a fair and thorough consideration of every bit of information given to them... before they say No a fourth time, hopefully.

If you want to open your arsenal to the public -with legally owned weapons-, I certainly hope you WILL be punished if one of those guns is to kill somebody, even if it's in the hands of an ignorant teenager who just grabbed it and started shooting.

So you expect a big company to develop brand new technology, which would imply a lot of research money, building new plants (or completely revamping the current ones), expending loads and loads of money to finally release a product that they would be forced to sell for the same price as the old one? They would much rather put bows and whistles to the old stuff until they ran out of adhesive tape.
Of course, there's a vast difference between the Computer industry and more basic things like food and transportation, which is where your example fits.
The problem is that big corporations have the resources and the hired great minds. They completely control the market and are the ones shaping the future and all they seem to want is for us to keep buying their old black and green CRTs so that they don't have spend money to build new plants.
They want to keep us in 1990's technology for their own benefit! They're hampering technological advance just to buy a new pair of shoes.
I wonder if there is going to be some sort of unbiased, uncorrupted, unidiotic government organism regulating this.
I mean, if the Industry is going to have complete control of this, it'll mean cheaper and more effective way for organisms such as the RIAA to terrorize customers. They won't even need lawyers anymore!

They need to THINK before buying their 8yo a game with hookers, violence and drugs. Make it mandatory to present an ID to buy mature games, just like with alcohol, cigarrettes and pornography. After that, it's all the parent's fault and they should be held responsible.
Good figures, but Copyright enforcement has nothing to do with the quality of music (or quantity, for that matter) but rather with how much money the musician makes out of it.

I can be angry without being biased. I can do my job in a respectful, fair manner, no matter what my mood is.
