The people being sued had 1,000+ songs for download, with a most likely intent to violate copyright laws.
The RIAA holds those copyrights, and has every right to protect the value of the copyright.
The RIAA, with the exception of the vast number of subpoenas issued, is following the standard procedures in the law.
This law has been around longer than the RIAA.
When the RIAA sued Napster, et al. you all said, "Sue the filesharers, not the company!" After they did that, you objected to that saying it was unconstitutional, etc. Do me a favor: Remember what you said a year ago, and stick with your convictions. You said it, they did it. Deal with it.
Here are ways to help not support the RIAA, and not seem like a total jackass:
Purchase USED CDs from RIAA labels only.
Purchase music produced from non-RIAA labels.

That just means you aren't the target market. The thing that you get with the iPod is decent storage space, decent hardware, and really great system integration.
It is pricey, but so are Plasma TVs. If it's out of your price range, it isn't for you. It's for the millions of people who do buy them. It's ok to not want to buy something, for whatever reasons. I have an Archos mp3 player, it has 6GB of storage. It has good battery life, it's integration is mediocre and it's footprint is fairly large. It still works perfectly fine for me, as it's just a USB hard drive and I don't need iTunes to listen to music.
The iPod isn't for me. I'm ok with that.

A lengthy trial brings in negative press, lawyer fees, and other expenses that can easily go into the several millions. My guess is they figured that the $23M was a cheaper route than taking it to trial.
They could have just used Linux if they wanted an alternative but now they realize that companies like SCO are in Linux picture so they want something of their own.....
Or maybe Linux is a kernel, and not an operating system. Then, they can use the Linux kernel and build an entire operating system on top of it.
