    Retail copies of Mac OS X are essentially upgrade copies, they're only licensed to run on Apple hardware and all Apple hardware ships with OS X pre-installed. This would be roughly the same as a computer manufacturer installing upgrade versions of Windows Vista on a computer. Now whether those provisions in an EULA are enforceable is a different question, it looks like they probably are though.

    I don't think this is an issue of first sale either as Psystar is not merely reselling a purchased copy of OS X, but installing it in violation of the EULA. Maybe if they shipped the computer without an OS and shipped a boxed copy of OS X you could make a first sale argument.

    More importantly with regards to Psystar, they're hosting and distributing modified versions of Mac OS X updates. This very clearly is a violation of Apple's copyright on those updates. Best case for Psystar in this is Apple gets an injunction preventing Psystar from hosting updates. Psystar can still sell computers with OS X, but customers are completely on their own in terms of updating. Not good for anyone really.

    Pystar is also redistributing modified OS X updates. The case was filed the day after Pystar started distributing a modified version of the Mac OS X 10.5.4 update. EULA aside, this is clearly a copyright violation. Pystar will lose.

    No, partially hydrogenated and hydrogenated are not the same. Just because something has been artificially hydrogenated, it does not make it a transfat. If something has been partially hydrogenated, it will be. A hydrogenated fat is indistinguishable from a saturated fat, they are the same. Your body doesn't know or care where the hydrogen came from, it just knows that it's there.

    And that's how it works. Eat less and do more. That is the secret to weight loss. Most people fail to lose weight on traditional diets because they make temporary changes to their eating habits. They'll eat less for 6 months, and exercise, and lose the weight they wanted. After the 6 months is up, they go back to their old life-style of eating too much food that has way too many calories and not exercising and they gain the weight back. The way you lose weight is to change your lifestyle permanently. You need to start eating healthier and exercising more with the intent of doing it for the rest of your life. Then you will lose weight and keep it off.

    A trans-fat is essentially an asymmetrical fat. These rarely occur in nature. They occur in processed food by partially hydrogenating unsaturated fats so that some of the carbon to carbon double bonds break into single bonds, then reform essentially rotated 180 degrees. A fully hydrogenated fat is not a trans-fat, it is a saturated fat (saturated with hydrogen). Food manufacturers love saturated fats because they're usually solid at room temperature, and extremely stable. Unsaturated fats can become saturated with other atoms like sulfur or oxygen which cause the fats to go rancid. Saturated fats have already been saturated with hydrogen so they keep for an extremely long time. I think a big push in using partially hydrogenated oils is that they are derived from plant sources and much cheaper than saturated fats from animal sources. Also, I think for a long time, "partially hydrogenated soy bean oil" sounded better than "lard". Even if the lard probably was better for you.

    It's 4 bonded cable channels not lines (ie channels 100, 101, 102, and 103). I believe the current development models are literally 4 cable modems working in unison, so there may be 4 lines going into the box to make things a bit easier. The final version will have a single cable going into the box.

    Division is defined in math by multiplication. a/b = x is defined as b*x = a. If you let a = 1, b = 0, and x = infinity you get:

    1/0 = inf is equivalent to 0*inf = 1.

    This obviously doesn't hold, zero infinities is still zero. It's all non-sense. Division by zero doesn't work. The solution to a/0 is undefined in math. You can't say 1/0 is equal to infinity, you can say the limit of 1/x is infinity as x approaches 0 from above. The post I was replying to made the claim that 1/0 is infinity, and that's simply not true.

    My point was that my proof was wrong. So is yours. It's wrong starting with the assumption that 1/0 == inf. 1/0 == undef, or NaN if you like. It is not infinity though.

    I suppose if I'm going to be a pedantic bastard I should add that for my above limit, a must be greater than 0. So the limit of a/x as x approaches 0 from above where a is a real number greater than 0 is positive infinity.

    a/0 is undefined. The end. The limit of a/x as x approaches 0 from above is positive infinity, but the two statements are not the same. Division by 0 breaks a number of rules and can be used to "prove" all sorts of things that aren't true. If 1/0 == inf, then inf * 0 == 1, but any number multiplied by 0 is 0, so inf * 0 == 0, therefor 0 == 1. It just doesn't work. a/0 is undefined. As best as I can tell all this guy is doing is assuming that 1/0 == inf, -1/0 == -inf, and calling 0/0 something else.

    This whole thing is stupid. Did anyone even read the article? Apple is trying to block two trademarks from being issued that they feel are likely to cause confusion with the iPod. The letter even states that Apple has no intention of trying to block the use of the term "podcast." Trademark law requires this kind of behavior. Trademarks must be defended or else they can be lost.

    Do the students actually get anything for agreeing to the terms of the TII EULA? IIRC, no contract is enforceable unless both sides get something of value. The school certainly gets value from the service, but I could see a good argument being made that the students aren't getting anything. There's also the issue in high school that most of the students are going to be under 18 and unable to legally consent to any contract. Additionally, I question how legal it is to force students at a public school to agree to something like this as a condition of handing in an assignment. With private institutions I'd imagine all of these arguments fly right out the window and the students are essentially SOL.

    That is what you said. You said 1024x576 is a PAL DVD resolution, and that it usually makes it on to the disc as 720x576. This implies that it sometimes makes it on as 1024x576, that is wrong.

    1024x576 is not a DVD resolution. PAL DVDs are 720x576, NTSC DVDs are 720x480. 1024x576 maybe what 16:9 PAL DVDs are scaled to, but the video on the disc is 720x576.

    Except that's not what this does. It grabs the decrypted, but still encoded file from iTunes' memory. You get an exact copy of the file without the encryption (or any of the meta data, but that's probably just a matter of time).

    24/7/365 access is very expensive. To pull it off you'd need three of just about every system (primary, backup, test). Are you willing to pay for that? Also, it is 100% unreasonable to expect that your PC "just work" all the time. Do you expect your car to work 100% of the time? Do you expect a doctor to never have a patient die?
