Should an indepentendly produced and published game, released in January, that then gets picked up by a publisher in July, be exempt from any Indie awards for that year given in December?

There are multiple reasons for not getting things on the X-box

    1) Valve like giving things away for free. MS don't. There is a limit to what MS constitutes as a 'patch' and what is DLC. MS practically force DLC to be pay-for (I think devs get 1 or 2 free DLC's)
    2) X-box is a horrible environment for running the Hammer Editor (what is used to make Source Maps) - hell, it's quite clumsy on the PC (It's by no means the worst, but for my money UnrealED was always the easiest to use) They would have to develop a version that works using Console controls
    3) The sources for maps are also Huge. Downloading/storing them on your XBox where they're just going to sit and take up space that could be used for something decent is just silly.

there are many ATMs in the UK that use Windows XP as their OS of choice. Having personally seen crash screens and machines caught in a restart loop.

Why they are using windows, I don't know to be honest. Why they'd be using a Linux distro, I don't know. The banks probably don't know either, as far as I'm aware they get their ATMs from companies like NCR or IBM (or Diebold, as we've seen before) who are the companies who supply the software. It just so happens that the software they write is written for Windows Operating System. Remember, the cost of hiring someone who can programme for Windows is significantly less for someone who can programme for Linux (As they will likely also be able to programme for Windows, thus, with a larger skill-set they'll demand more money) And a bulk licence for Windows where they're churning out 1,000+ ATMs boils down to next to nothing.

The cheapest programmer, the cheapest hardware, a slightly costly OS. Something has to be a weak link, and the exploiters exploit it.

Sure, they've not done much post-sequel updates, but they've never had a sequel released this close to it's predecessor before. We don't know WHAT Valve will do with L4D once L4D2 comes out. This is uncharted waters for Valve, and the way they handle is is going to reflect on them as a Company in a big way. Ditch L4D and recieve the ire of long-time devotees. Warcraft has this problem, especially in towns. It can take between 30 seconds to two minutes to fully load Dalaran the first time you log in as it has to not only download everyones armour, but then read/decompress that off your disk. My friend - who has 48Gb of RAM - created a RAM Disk and loaded WoW's game files onto it (WoW's game files come to around 13Gb). It loads fast, and I mean lightning fast, since the RAM has a faster throughput than the HDD.
Most of the 'lag' in Warcraft comes from the user end, as opposed to any server creaking.

This has led to some humorous bugs in the game. For example, "The Naked Bug" - which tends to happen either in Cities or when going into an instance (25 man instances mainly) Where characters armour fails to load and your buddies are all running around in the nip. Anyone already in the instance is naked to you, and anyone joining after is normally fully clothed. And the only way to fix it is for you to exit and re-enter the instance, or for each naked person to exit and re-enter (for example, by dying).
