    That is a crucial difference.

    As for your suggestion, that is diametrical opposed to the entire structure of a Republic. What you suggest could leave a single area of a state with a majority of the representation. Since this is Federal Representation, needs to follow the Federal structure of a Republic. Feel free to elect your state legislatures this way.

    Correct me if I'm wrong, but Political affiliation isn't a protect class.

    To insist that the redistricting somehow represents the greater population is the usurpation of redistricting task by the courts.

    I admit this is a fairly fundamentalists interpretation, but what objective measurement are the courts using to discern Good O'l Gerrymandering from "Insidious"?

    Redistricting is not like pornography.

  3. Admittedly this is from my mere two semesters of Business Law, but the Courts are limited to ruling on Legal issues...laws.

    Redistricting is an administrative thing. The process is not a law, but simply rules of the legislative body...similar to rules on filibuster for instance.

    But that is only two semesters of business law.

    No, the "Courts" should not.

    If you want that, change the Constitution. Strictly speaking, the courts involvement in this at all is unconstitutional. Redistricting is a task left to the Legislature in the Constitution.

    There is a political solution to all of this that has worked many times. It worked in 1994 when the Republicans won back Congress despite Democrat Gerrymandering.

    You can't have the courts always stepping in because you don't think something is "fair".

    "Fair" has nothing to do with Law once it is passed.

  5. Gerrymandering is, by definition, the manipulation of the Congressional districts in a way to assure an outcome beneficial to one party of another.

    What makes it "insidious" or not is beyond speculation. That is is just a stupid, inflammatory adjective on the Judge's part.

    BTW, Gerrymandering has been happening since the beginning of the Republic.

    So your position is that you can't make money laying your own lines...like the company that did it previously.

    Business is hard. Most fail.

    But if you have the Government standing in the way keeping anyone from even trying, then what's the point?

    Get rid of the monopolies and THEN you can talk about Business models, investments, etc.

    Case in point...Power companies are researching sending signals over the power line. Regardless of where they are at, it's legally conceivable that they would be prevented from using that technology to offer services.

    Other options, erecting local WiFi towers. There could be a perfectly viable business case there. But then again, if the Local government won't let it happen then there's no point to even trying.

    All this fuss over the FCC, FTC, and Net neutrality is stupid and unproductive.

    What's holding back internet speed and greater access is local monopolies. Even if the FCC did, "take immediate action to accelerate deployment of such capability by removing barriers to infrastructure investment and by promoting competition in the telecommunications market." It still wouldn't enable a city or small business from starting their own internet provider company and put up lines in neighborhoods.

    Simply eliminate all local monopolies on internet access and you will see all manner of companies jumping into the fray.

    BTW, these monopolies are created by local governments. So instead of whining about the Feds, call up City Hall and give them a ration of shit.

    The A380 is facing the same fate.

    It may take another 5 years, but with the new planes like the 787 and the other Airbus planes, the need for huge aircraft is going by the wayside.

    For the last 30 years programming languages have been stuck in spin cycle.

    In the late 80's early 90's, "4th generation" languages were eagerly anticipated, saving people from having to code the same shit over and over again Those that DID show up were a great disappointment because they were pretty much limited to building forms for data entry and reporting for databases. Reporting packages have made great headway, but they are all still rather obtuse.

    We are still spinning away with countless 3gls coming and going, Every one nothing more than the reshuffling of syntax, different key words and new ways to obfuscate (object oriented) code, making debugging a HUGE pain in the ass.
