    The real problem is that successful open source funding models do not work in all areas of software. You can't point at the kernel and say SEE LOOK COMMERCIAL SOFTWARE CAN BE OPEN SOURCE when for areas like games and niche business software no similar funding exists. Where is the open source answer to Black OPS? Who is going to fund open source software for real estate agents in the field? Stallman underestimated the world's growing demand for software when he created his movement. He assumed that software would be mostly ran by geeks and at the command line. His plans are completely unrealistic and his philosophy should be dropped. It's fine to use the GPL but expecting that all software be open source eventually is like expecting Marxism to work eventually.

    There are areas of software where OSS clearly can't compete. If the goal is open source everywhere then OSS philosophy needs to be re-thought. Games for example are still more than 10 years behind.

    Most guys I know bought the iphone for the game selection which is undoubtedly superior. It's called freedom to choose from better games. Freedom is relative to what you value. There is no loss of freedom if you needs are met 100%. The freedom that matters is being able to choose from a variety of devices.

    That SPARC machine might be fast but only a tiny fraction of businesses need that kind of performance. I also don't see how that makes them an evil corporation.

    Itunes sucks on Windows but it could be rewritten. MS can make development easier but itunes already has a massive library and market share.

    I'm not counting out MS, they just have a massive hill to climb to get even 25%.

    That Android magazine ban is the lamest thing I have seen in years. Who the frig cares about Oracle, there are so many DB options these days and both Java and OpenOffice were already underfunded with Sun. Just be glad someone bought Sun and didn't let its assets rot in bankruptcy court.

    It isn't 1999 anymore. What are you suggesting they would do anyways? Require a WP7 device to be plugged in for Windows to boot?

    Ubuntu has required 2 year old systems to perform a major update just to get a newer version of OpenOffice. The system sucks, stop pretending it doesn't.

    For every 1 guy that uses this for homebrew there will be 100 that use it to pirate games so they don't have to send their money to teams of geeks (game companies) and can instead spend it on important things like car speakers or pot.

    As much as geeks have a reputation for being smart they sure act like fucking idiots when it comes to doing what is in their best interest.

    Not only is piracy unethical but it also tells people like Uwe Boll that there is actually demand for his terrible movies.

    Netflix streaming is only $8 per month and turns people on to smaller producers.

    Hollywood and other big producers make the bulk of their funds from theater and retail blu-ray/dvd sales. The profits from Netflix are pennies on the dollar in comparison. Support Netflix, not piracy.

    People that support the worst of big screen garbage in any form should be reprimanded. They have probably seen a few of these movies in the theater.

    Netflix streaming is only $8 a month and has a lot of great works from small producers. The pirates should be fined and the funds should go to student film projects.

    Let's face it, pc gaming took a punch to the stomach this gen and hasn't recovered. There isn't a slew of amazing pc games to make consoles look bad. PC gaming has better hardware but doesn't get the same amount of exclusives.

    Have fun playing upscaled console ports.

    I'll go back to pc gaming when it goes back to 1999. Right now it is more like a console with the best hardware but is also most likely to get the shaft by developers.

    No I have just read through the cases and can see that they did not target p2p pirates at random. It makes sense to go after the heaviest p2p pirates first and that is what they did.

    But I can provide links if you would like. Take the case of Tenenbaum who admitted to having 800 files in his shared Kazaa folder but was only prosecuted for 30. It's just a legal strategy to focus on a subset of files.

    for Oracle. So you don't consider that a bad thing? Taking the work of others and profiting from it? This was a pretty egregious case, SAP has already admitted culpability and tried to settle with Oracle.

    These megacorps have billions in cash, a fine of 50 million might as well be a rounding error. Punitive damages against these companies should be relative to their annual profits. These types of rulings need to set a precedent, not just account for damages.
