I don't believe most of the modding community is bothered by the ban from XBL. But this recent ban wave also cripples some offline capabilities as well. For example, if you've been banned you can't install games to your local hard drive anymore.
I have an Audigy2 and I use the emu10k1 driver in Linux. It runs perfectly in Gentoo with 2.6.12 driver (I have been running it since at LEAST the first 2.6.x kernel)
Like the last story, this law will only really effect the spammers who are already following good practices. The bad spammers will not be affected by this, just like pirates will not really be affected by any DRM.
