Civilized people don't have the death penalty; But have to deal with VERY "uncivilized" people in a civilized way.
I'll also add this: - It's used as a deterrent, a punishment, protection and vengeance* for the community.

Not too sure that "Civilized people" must accept immoral authority. A lot of cases you read in the press would have the "people" as immoral and "the system" - (a judge judge who has seen a number of these cases over the years) being the better person.
I believe "the people" (me) would be ok with Anders Breivik being tortured for years and years with a doctor on standby to make sure he doesn't die. Civilized people can't be civilized 100% of the time when faced with something so horrific. The aim is to have a civilized authority/system. OR to put it the best way i've read -

So long as they learn from each one it doesn't really matter. We got off the ground in 1903 and we are now putting nuclear power cars on another planet 100+ years on. It would be great to get to a stage when probes and rovers are really standard in the next 50 years.
I'm looking at the list of films I can go see at the cinema today. None of them are worth this level of intrusion. Stop making films and music it's bad for freedom.:)
