I'll admit it I am "incredibly naive" but this is just a start. It's not about poo pooing it because this or that won't work. It's about starting a dialog to correct the problem. Otherwise the problem will never get fixed. I brought up a constitutional convention because it's the sure fire way to make Congress take notice (that's happened before) and either act or as the framers intended the states, if enough can be brought together, can correct the problem.
I'm just going to repeat this until either it starts or someone makes a valid argument against it. The states need to call a constitutional convention and fix problems like these. Imagine term limits for Congress - the state reps would pass that because it would mean more churn and a chance for them to get there. Problem one solved. That's just for starters. Fixing problems like what this post is about would be on the table too.
In this day and age of social media and groups who have nothing better to do this should be easy to push right to the front. Just have to work hard to not have it be subverted. Just imagine how pissed off this would make Congress & the President. The founding fathers would be cheering! The world would see how it's really done right.
I think blaming the absence of a union here is misplaced. One could argue they charge a fee as well (dues). Often involuntary whether you want the union or not. Which could be considered like this. Someone figured there was a buck to be made somewhere in the process and took advantage. If it's legal I'm sure it will be corrected soon enough along with a lawsuit that will surely make someone else a bit of cash... They did it with gift cards now they are just going at it from another angle.
You are facing your accuser. You just don't have the security clearance to view the evidence. And because such evidence will raise nasty questions about how it was collected. Like what's happening now...

He new darn good and well he was spamming, oh but he denied it, and in frustration claimed freedom of speech. Good luck with that governments can deny speech we're not the government. Boy was he upset. Fun times. Sad these days spammers don't seem to get burned so easily unless they are dragged into court by someone big company...

The (the big players) will however leap to the effort to squelch it. If Google wants to make this happen which would change the landscape they are going to just have to do it and drag everyone kicking and screaming. As well as give their lawyers something to do.
Wether they know it or not consumers really want a tablet they can what they want with it. Not what you just give them. Which is what everybody is doing.
Why on earth do we have to do the work of the FTC? It's not enough that they have a cozy government job they now farm out, in the form of a contest, their work. I do have to give them credit. They probably would have just hired some consultant company to do the work and get charged a few million dollars for the plan. So it's at least cheaper... Why on earth do we have these agencies that can't do their own work is beyond me...
And the malware that they're installing continues to evade antivirus software
Support: Hello this is anti-virus/malware company XYZ how can I help you. Caller: Yes I have this software called Anti-something 2010 that just popped up on my screen. I have your software installed and it still came up. Support: You can call our 1-900-BLAH number and they can assist you for $39.95 a minute to remove the software. Honestly any company that buys another always wants to get rid of the old ways. No matter how well they worked. If it ain't broke don't fix it.
They still have claims 39-44 and those are enforceable? What! Those are dependent claims. You break the parent and the dependent ones fall apart. At least that's what I was always told. Am I wrong on that or do they just want to keep hope alive?
Big whoop that this patent has 171 claims. At a quick glance 168 of them are dependent claims. That means you find the main ones (1, 96, and 129) and look for holes there in what they claim. The other claims depend on those so they don't matter if you can break the parent.
