Doesn't matter, the DMCA has a specific provision excluding/protecting broadcast radio stations. They're allowed to even make a digital copy of a song.
Do you think ClearChannel didn't have it's $$$ being delt out to ensure it was protected. Modern IP rights merely benefit the powerful wealthy. They seldom have clauses of protection for general public and are seldom upheld for smaller individuals. Often are too expensive and inaccessible as well.
But the radio station conglomerates (ClearChannel, Cox, etc) made sure they had clauses to protect their age old business model when the DMCA was written.
And in fact, real radio now DOES buffer the broadcast. They're called digital delays. When you talk on the radio it is often recorded with a 2-5 second delay.
However, because there was no way that broadcast radio stations (a very large corporate entity itself) was going to start paying RIAA royalties over such. The DMCA put a clause to specifically exclude traditional broadcast radio from such royalty claims.
Actually, there are LAWS against such agreements between record labels and radio stations. It's called "Payola"
The giving of money, perks, gifts, or additional servicing for "radio airplay". It's very touchy and in truth a lot of "payola" goes on. I worked as a DJ on a college station and we were constantly warned about such. For instance. We could receive CDs from labels but we could not promise to play them. Nor could we accept for instance "we'll send you extra CDs if you play ours". Or any of the sort.
Of course, RIAA does it quite a bit....and periodically gets hit for it with a small slap on the wrist.
Radio NEVER has had to pay RIAA. Radio broadcasts were deemed "public performance" and had to pay their licenses to BMI/ASCAP/SESAC (the performance royalty companies). In fact, all these royalties RIAA has demanded from satellite radio, web radio, etc. Are completely new previously unheard of royalties. And it's all based on "caching".
For instance, you play music over the web. Your PC "buffers" the stream. RIAA made a case saying the buffering is a recording and therefore they need to be paid.
The issue is not violence or sex, I believe both have their place....to me, the issue is "degradation & abuse"
I believe sex is a wonderful thing shared between people who love each other. Even in terms of pleasure shared amongst friends or consenting casual acquaintances for the more liberal thinking.
Nor am I an absolute pacifist, I believe violence should be avoided when possible and used as a last resort. But I believe there are times when one must be violent; when one must defend themselves against the school playground bully. I believe there are times one must be violent to protect the weak from abuse.
A violent game like DOOM caused little issue for me. Shooting monstrous demonic creatures....no problem. Shooting each other in a gladiator style arena. Still not much problem. Not much reality there.
But there is a big difference between such and a game which exemplifies, even glorifies, the rape/killing or other abuse of prostitutes. That degrades women as objects. That outlines a fundamental philosophy that stealing/killing is acceptable.
I do not have children, but when I do, I want to instill in them that sex is a good thing...but to enjoy it wisely. That violence is a last resort but that there are times you need to raise your fists. Likewise, I do not want my son to be abusing & degrading women. I want him to be the type to respect women. I want him to be the type of guy who refrains from violence, but at the same time would be willing to use it to prevent some scum from being violent and degrading to a woman or anyone for that matter.
The issue, is "right vs. wrong" "good vs. evil" sure it get's grey sometimes. But how often is "rape" a grey issue? or mass genocide? or racism?
There is a difference between playing a character in a game such as a cop stopping violent criminals with violence, or even a vigilante who does such to protect more innoncent individuals than say "playing" the perpetrator. Sure "Wolfenstein" was violent with lots of gruesome death. But you were killing NAZI's and their evil creations.
So, no, I don't want my children (which I do not have) playing a game that displays such behaviors....not until their sense of morality and right vs. wrong has matured. Likewise, I don't even really want other children to play such. If I have a daughter, then no, I don't think I'd be too keen on a game that had kids "rampaging" a school shooting classmates and raping girls in the school bathroom. I'd be afraid of what influence that might have on a teenage boy and what risk that could pose to my daughter. Now, I don't think we're at a level were such a game would be tolerated by society. But it does pose the question of where does one or where should one draw the line?
I think most parents bringing up such issues are not concerned about their children, (as they're probably not letting them play GTA) but are more concerned about their children encountering children influenced by such games - and being harmed.
Now, is there conclusive proof of an association of violence. No...but it does not mean we should wait till there might be.
So my point in this....I don't know if there should be a law. But IMHO, would it really be wrong to list certain games as Mature and denote that such require the purchaser to be 18+ ??? This was commonly accepted for film.
The following is just my personal opinion:
General Audience (means content acceptable for all) Teen (denotes violence, guns, deathmatch, etc.) Mature (denotes strong sexual content, immoral violence, illegal acts (ie: drug usage - not powerup mushrooms but use of real life drugs), essentially, anything that is portrayed in a virtual environment of our modern day society which is illegal & felonious to the extreme. (ie: driving very fast would not be listed but driving drunk would, murder, rape, etc)
All of this is to say "there is a difference" between say a game called "8mm" in which a character plays a detective (a.k.a. Nicholus
Mind you, most classical music is in "public domain" and very little interest exists in "new" classical composition as it is not a top genre.
For example: very few classic rock and roll albums that are new hit the billboards but Elvis still sells quite well.
So we are either speaking of a classical performance of some dead composer's work, (in which anyone can perform said work and there are thousands of small symphonies playing mozart as opposed to a single Switchfoot playing Switchfoot songs) or a neo-composer of which there is very little interest for such.
Yes, this will be a redundant post...I am sure numerous others are pointing and questioning WHY this was a legitimate newsworthy Slashdot entry when thousands of unheard of unsigned bands have been doing the same thing. And yes, I am sure some people have heard of said band but it's not of any major noteworthiness. Had this been say "Metallica" releasing an album free to download - than it might have been of news note.
This seems more like someone trying to promote their friend's band than anything else...
Frankly, I think many more people would have been interested in my rejected post regarding Tim Burton's use of commercial/consumer Canon digital SLRs for filming the movie "Corpse Bride". But nope...

"Apple Computers may not be used to produce or modify or effect in any way, any recordings to be licensed to RIAA members. Any use of Apple computers to do such is a violation of the Mac OS and will be prosecuted to the full extent of the law as applicable in the DMCA. Including, pursuit of the right to distribute said creative works."
*ha ha*
That'd be funny as 90% of music studios utilize Mac's.
How long until Apple simply approaches all of the musical artists and licenses "direct" for digital. RIAA actually has made a mondo mistake. They have licenses to distribute the recordings. Correct.
However, RIAA has also put much effort into distinguishing "analog" from "digital". Enough so, that a good lawyer could argue a case for the artists that RIAA was not granted the right to collect "digital" royalties.
(This actually came up with the lawsuits against "web radio" and the creation of a "digital royalties" collection agency.)
However, it could be pushed by the artists that they are distinct. And they could then license the "digital distribution" exclusively to Apple. Even if the case is lost or held up in court for years of debate. Apple could sign "digital distribution rights" with new bands. Keep the price $0.99 cents and split $0.25-$0.50 with the artist. Artists would see much more profit from Apple's model. While at the same time the record labels would see a loss of revenue. Eventually, the record labels will go bust and Apple will be able to buy their portfolios (just like RIAA did with MP3.com & Napster).
The issue, is that a lot of scientists do not believe that man's influence is in fact the major cause of global warming. Many believe that we'd see very similar temperature increases even if we were not producing any greenhouse gases.
However, there is an extremely vocal group who pushes groupthink (dismissing any scientists who oppose) and trying to skew the interpretation of all articles their way. (I believe there was a recent case where a 1,000 articles were pointed to as demonstrating global warming and was later rebuffed as a second look into their articles determined that like 1/2 of them merely stated climatic change and did not prove it was due to man's doing. And many more said there was a slight inference but no definite. But it gets pushed all over the media and in high schools but with no real balance or insight.)
Now, take into account a recent article about the Mars polar ice caps reducing in size. Now, I've seen numerous people declare our polar ice cap reduction as a de fact sign that we are destroying our planet and to blame for all the warming. But if Mars is undergoing a similar "temperature increase" we must, if we are to call ourselves "scientists" conclude that a significant portion of our current warming is of an orbital solar nature and not a localized chemical nature.
There have been numerous warm periods in the history of the earth. Most of the quotes on temperatures refer to recorded temperatures (as in the last 200-400 yrs). But the vikings explored North America during a 50-100 yrs warm cycle. Warmer cycles are believed to have occurred a few thousands years ago. And much warmer periods tens of thousands of years ago.
Now, this does not mean I am not for the reduction of pollution for the reduction of pollution's sake. But too me...this dogmatic groupthink in the name of science is nothing more than a modern day religious episode. I do not even deny that our pollution may be having an effect. But I believe we need a much more honest approach. It was only a few decades ago we were being told we were headed toward a new ice age and that our pollution and gas exhaust was going to plunge us into the next ice age.
20-40 yrs and we've come full circle and we're once again told to believe this is "scientific fact" and not the mere "dogma" of groupthink?
I'm for science...but if we're going to blame the christian right for "pseudo-science" we should also bear the same mind against extreme leftist "pseudo-science".
On the flip side, I believe mankind's goal should always be to reduce his impact on the earth and his surroundings.
I am very suspicious that the broken screens and the scratched screens are due to the same problem. And as such are merely polar ends of the real issue.
Could it be, that the manufacturer's "hardener" levels were off. Certain polycarbonate batches receiving too much "hardeners" (resulting in cracked screens) and other batches receiving too little "hardener" resulting is extremely easy scratched screens.
I find it interesting from a chemical engineering stand point that both problems could be directly related to a fluctuation of hardener levels but not a single article or post I've read has mentioned the possibility of such?
The main problem of the ISS was that it is essentially a low-orbit station. Good for a few "lighter gravity" and "pigs in space" experiments. It is a venture doomed to failure.
What should have been built was a launching point. Situated between the earth and the moons gravity wells. It should be much larger. It should designed as a stop point between the earth, the moon, and a venture point for missions to Mars.
Continually expanded while at the same times endeavorings to mine the moon for radioactive propulsion supplies. These could be safely launch from the moon without fear of mass human hazard (main opposition to nuclear launches being done from earth). Nuclear propulsion rockets could cut the time of transit to Mars by several months.
This is what should have been done. You can read this essential concept in numerous science fiction novels. And you might wonder "how we'd build such units". Well space is a vacuum. We often simply let the "external" fuel container shells drift. When in fact these might provide external shells for non-pressurized storage modules.

QUESTION 1: Why do you think there are so few online strategy games for systems like the Xbox?
If simply the cumbersomeness of controllers. Why is there no innovation? Do you think the Nintendo Revolution controllers might lend nicely to strategy games? Where one could easily draw a circle around their units and then hit a button to select an action option?
QUESTION 2: With the advent of "multi-player" internet games...do you think we'll ever see multi-faceted intertwined games?
For example: A hybrid of Civilization & Battlefront style games. Where certain players are playing strategically. And other players are fighting the actual battles?
Look...if you and your pseudo-scientists spouting every little sign as global warming evidence would hold off...then so would we.
I think it's very interesting. Do you realize what rate of climate change Mars would need to noticeably lose ice in the polar caps in a mere few years?

After that time. If there is a better alternative chip it would be minimal work to allow for using an AMD x86 as opposed to an Intel x86.

No evolution is the arisal of new unbefore observed "population characteristics" where as adaptation is the observance of existing characteristics in use.
If you have a bacteria and you use anti-biotics to reduce the population. Those persistant resistant bacteria are not a new bacteria...not a new species...but rather are a new breed.
For example: if I took dogs and kept breeding the fastest, I would result in a greyhound. It is still a dog. The difference is I have emphasised existing qualities to the exclusion of other qualities.
That same anti-biotic resistant bacteria may in fact be weaker to say chlorine poisoning.
What you describe is in fact more "selective breeding" than anything else.
Very much akin to the moth example commonly sited where the moths used to be more in population of the white variety but we pollution darkened the bark of trees so the moths become more commonly of the darker population because the white ones are more easily spotted and eaten.
That is NOT evolution, simply an example of "selective breeding". The both characteristics already exist within the gene pool.
They're already are allowances within their genetic code for such deviation. As opposed to a new feature previously not found within the genetic code. Which is what evolution dictates.
I just after 29 yrs of waiting found a beautiful young woman...and I just asked her to marry me and gave her a diamond ring containing what was then the hardest substance known to man...
And no sooner than I buy the ring and give it to her does it become outdated.
Question, even considering the iPod as prior art...but I have a frickin Rio (you know before the iPod) the original MP3 player manufacturer. Um, it seems to meet all those mentioned items:
Portable MP3 player, pocket fit, displays name, artist, etc.

I've looked at this and basically esclaimed it's almost everything I want. In fact, if they added two features I would drop the $2,000 for it.

You know, this sucks...
I just after 29 yrs of waiting found a beautiful young woman...and I just asked her to marry me and gave her a diamond ring containing what was then the hardest substance known to man...
And no sooner than I buy the ring and give it to her does it become outdated.
*I can't win!*
Everything I buy is outdated a week later...
Question, even considering the iPod as prior art...but I have a frickin Rio (you know before the iPod) the original MP3 player manufacturer. Um, it seems to meet all those mentioned items:
Portable MP3 player, pocket fit, displays name, artist, etc.
Plays music...
WTF?
