While I don't disagree with you on the knee-jerk-ocity of the story, your side example isn't really the same as what happened in this case. If there's a bug in my software, I can't be held liable as long as I write out in the license "I am not responsible for blah blah". If there is some rather nasty bug though, and I choose to release the fix for a million dollars, there is definitely room for debate as to whether I should be able to charge money for my own mistake.

Strangely (and scarily), Miers has never been a judge. She's been a landshark for years though, chairing the Dallas Bar and Texas State Bar. She was also appointed a job in Texas by Bush (W) during his stint as Texas Gov, so she's obviously not been swayed by any political party ever.

I realize Slashdot isn't really a "news organization" with "real" journalists and such, but seriously. If the guy submitting the article is from the site that is linked, at least put a blurb like Someguy (of pcwhatever.com) writes "(summary)". Well, as the shift of commercial software seems to be shifting more towards "services" and things you connect to via browser or app, MS may be a bit touchy over losing something like Exchange. I realize that their current strategy is still a complete Windows lock-in (Client, apps, server) but if and when they change (my bet is that it'll happen eventually), their money will be made more on things like Exchange.

Although I've never heard or read about someone who is the tech guy trying to leverage the internet to help the content industry make money off of it (I know, I know, NDAs), I'm pretty sure there are a number of skilled people whose job it is to find new ways of distribution.
