    Let me clarify that the legal hold likely applies more specifically to the university employees rather than the students, but I am assuming they are using the same email system.

    Agreed outside of saving the mail logs and bodies. This is a college, not a corporation. At mine, they preferred to log nothing to avoid getting pulled into legal disputes. AFAIK, it isn't required by law, so it's all headaches for no gain on their part.

    This argument won't hold water for long. 2 reasons:

    1. The university is most likely also a corporation (or even more likely a set of may corps). The set of rules the are subject to are WAY to broad (state, federal, union, blah blah blah) to be summarized into a single line document retention policy ("log nothing to avoid getting pulled into legal disputes")

    2. Choosing not to archive on an ongoing basis doesn't remove the need to have a "legal hold" when an organization learns about pending litigation. Being able to not centrally manage this is no longer an excuse that any court in the US will accept

    Ok, lets make this clear

    Hourly and Salary do not equal exempt or non-exempt

    Houlry/salary is the way an employee is paid.

    Exempt/Non-exempt determines if an employee is eligible for overtime.

    You can be an salary/non-exempt employee. You get a fixed weekly salary, and overtime based on work over 40 hours (or 8 hours/day based on your state)

    You can also be an exempt hourly employee. Exempt/non-exempt status is based on goverment regulation, hourly vs. salary is based on employer choice.

    It was proposed to strap giant slabs of hot buttered toast to the back of a hundred tethered cats; the two opposing forces will cause the cats to hover, spinning inches above the ground. Using the giant buttered toast-cat array, a high-speed monorail could easily resolve Vegas Gridlock!

    I used FreeAgent.com and was very disappointed with their services. I now use ZeroChaos. I have found them responsive and caring. They actually assign you to a individual service rep who will take care of everything.
