Ya if M$ managed to get any amount of manufacturers to sign on to this I could see this happening. Lol, now it won't be a matter of wipe hard disk, reformat, reinstall M$ OS. It will be more like buy new mobo? Great! So when does M$ become liable for damages to hardware, nothing like having the server go down forever - or until you get a new bios chip.

    But seriously. Wasn't W2k3 part of Bill's new secure software initiative? I feel really bad about all those locked in end users. They don't understand this stuff and all they know is that that new OS from M$ is no different than the previous version - unsafe at any speed.

    Ok so Bill Gates essentially fulfilled his promise related to making an OS that everyone can use. Ya, Joe and Jane Average can do all their music, and movies, and web content, and IM chat, etc... But they spend long hours on the phone with tech support. Now a worm is out that circumvents the patch. Most people wont likely be able to fix the problem and get online to get the patch before they're hit again.

    With all the time and money average users spend trying maintain, fix, and update their system they might as well make the switch and learn to run Linux or change to Mac.

    This ain't gonna get better and will probably get worse. Oh, and don't think for a minute the Longhorn, Palladium, and WinFS is going to fix this either. Cut and Paste coding is the status quo at M$ and their corporate culture is as much to blame as shotty product development.

    Linux and/of OS X won't bring M$ down, they'll do that all by themselves. Having an alternative will just hasten it in all likelyhood.

    I'm not saying M$ will drop of the map, but they will lose market share - it's inevitable.

    Look up the work of Wernicke and Broca. Both are involved with the study of speech centers in humans. Broca studied the motor abilities and Wernicke studied sensory abilities. As a neurologic nurse I have seen the effects of damage done to these areas of the brain. When a patient has damage done to Broca area the are unable to generate speech due to the inability to form phonems. They ability to comprehend spoken and written language is unimpaired. They often resort to using pen and paper to communicate - but spoken words are unintelligible for the most part. However, as the patient recovers some degree of ability it is often observable that syntax is undisturbed and intact.

    Wernicke's aphasia is more debilitating. This is the area for literal comprehension. Damage to this area results in to aspect of the same phenomenon. Patients can neither generate sentence in a coherent manner, though speech generations, phonems and words are unchanges. It is in the area of syntax that the patient is unable to communicate. Their sentences come out as a dissociated mix of complete words. Sentences like "the car is with bananas green, be large dog apples and far away cups". Each word is complete and well generated, but the patient is unable to make any sensical statements. The same holds true in auditory stimulii. The patients generally become very very frustrated because they can neither understand spoken or written language. It has been reported by those that recover that in the same manner in which they themselves spoken non-sensical statements and sentences that what they heard was as the same - people seemed to talk gibberish at them.

    There are many degrees to these pathologies with varying and quite interesting results. Like the inability to speak sensical references to people, but to construct perfectly (or near perfectly) sentences about inanimated objects or circumstances, or vice verse.

    So, what does this have to do with primates? Think about other studies that have been done with communications in Kentucky (IIRC) with chimps and abstract symbols for communicating desires, wants, needs, states of being, and memories. Or at Berkeley with gorillas with sign language in the same basic manner. It has been shown that these primates do possess the ability to communicate in very limited but congent manner. They have been able to express emotion - fear, happiness, anger, affections, confusion, as well as memories of such things as dreams and past incidences and experiences in a contextual manner.

    What put the human being in a adventatious position was the ability to both speek and write. To relate thoughts and experiences via observations and memories to one another. By being able to construct a form of coherent communication via abstract symbolism and sounds the human species can retain, pass on, and hence build a knowledge base. In this fashion each generation can more fully benifit the experiences and knowledge of the previous. The "lower" primates have this ability but only in a very very limited fashion and only in non-verbal/language context - such as observation and mimickary as in the case of using a grass reed to extract ants from a hole or to build a bed of leaves.

    The subtle but dramatic development of a group of neurons on the (generally) left side of the brain has been the difference from being just another relatively smart ape or a human. If it were not for speech and language we would most likely have been killed off by more phyiscially endowed competitors.

    How do you know they don't have macros or something executable. MP3's aren't just 1s and 0s for digital representations of analog sounds. They have all sorts of information in them. They have things like the date, tittle, copyright, etc. So, say a Brittany Spears song ripped directly from the CD is 4.3 megabits, depending on the bitrate, etc. One finds files of varying size on the net all the time for the same song. Can you absolutely say the a destructive worm couldn't be placed in a mp3 file? So, you look at the same Brittany Spears song, one is 4.3 Mb. another is 4.8, and yet another is 3.98 all depending on the bitrate it was encoded in. So, I'm a clever Joe, embed a worm in an mp3 that activates via WinAmp vunerability, then change the internels of the mp3 so it reads that it was encoded at on bit rate when it was encoded at another one. Why would I do this? So you would not be suspicious about the size of the file vs the reported bitrate.

    This is one of the oldest tricks for inserting trojans. Find a file that is essentially not going to be missed (if it's a sys file all the better) and that has a size bigger than the trojan your trying to insert. take the file that's the trojan and add X's to it at the end until it matches the size of the original file it's replacing. Virus programs will more often than not even make a glance at this file. So, I have effectively turned you machine into a zombie and you sit there scratching you head as to why your cable modem seem to be having such dismal throughput this night, or why is my computer running like a pig ever since I dl'ed those last few mp3s of Gnutella (if Joe LUser even makes the connection). Unbeknownst to the user, the file is dl'ing all the activity related to the users activity with their network, the file sharing program and the file names of all the mp3's.

    How do you know that this scenario is so far fetched?

    I think it's safe to assume that they have effectively and officially be ./'ed. Now the real challenge is to see how long we can keep it up. I think 9 months to a year would be a good target :)

    Another point is that it's not so much that fact that the downloaded files (read mp3, avi, etc.) are the real cause of the virus. The reason why these virus spread is because they are exploiting vunerabilities in the OS. If the OS is coded correctly then the majority of the viruses written would have been in the first place. Another point is that the vast majority of virii are spread via email, and to a point malicious websites. Ya the risk of getting a virus via a downloaded mp3 or movie is there, but far less then just check you email (pertaining to Windows based OS overall) and a popular rumor preports that the labels are the ones spreading many of these virii by embedding them into the files themselves (as yet unsubstantiated) IF the MPAA had a brain they would open a subscription service and have MD5 checksums to verify these files as legit.

    Yes, the real issue AFAICT is the manner in which the civil courts have been hijacked by big business and corporations. This seems part and parcel to the "my lawyers are bigger than you lawyers" paradigm. In otherwords, large companies and corporations can afford to have a very skilled and large team lawyers, or afford to go to an outside firm that perhaps others couldn't afford to employ.

    What happens is that it's not so much about evidence and merit as much as it is about injuctions, motions, and various (if not endless) court room tactics that win cases. Even more to the point is the manipulation of the system. It often appears to me that the clowns are running the circus. The lawyer often run roughshod in the court room. And then the issue of the jury. Take a technical issue, confuse and overburden a group of people with limited technical knowledge and then once you have them beaten down steer them to the direction or decision your seeking.

    Take the pending case with Open Source's favorite problemed child. They (or more appropriately Boies) have opted for a trial by jury. Why? Simply put because they have a better chance of winning the case. Why? Becuase they rely on the fact that most people won't understand the technical and complicated nature of the case and therefore can be led by the nose to the decision desired - hence why someone like David Boies doesn't need facts as much as he needs to be adept at the art of persuasion.

    Persuasion is a part of the equation, but the overlaying burden should be based on fact and evidence. Too often it is not, it's based on clever courtroom tactics and convincing a jury that your right - regardless of whether of not the evidence supports your claim. How often have we read or heard about a jury rendering a decsion that seems to fly in the face of the facts or evidence? All too often IMHO.

    The manner in which the courts handle private cases (as in civil torts) has been entangle with contrary and confusing laws that it isn't about right or wrong, its about good lawyers verse better lawyers and how they can manipulate the courts and juries.

    And the legislators that keep arguing that putting caps on damages will curtail this is sorely mistaken. Indeed, awards often outwiegh the crime. But often times it's more about the fact the the system is broken in many places and needs an overhaul - which would translate into actually having to put some thought and effort into this problem instead of throwing a quick fix solution like limiting damage awards as a way to thwart frivilous lawsuits.

    Wasn't this case presented before SCO announced that they had filed a tort against IBM. I do believe so, in fact didn't I hear about the intertrust case on /. - I believe so again, as well as a couple of other sites.

    So, M$ is being SCO'ed by InterTrust, Linux is being InterTrusted by SCO. LOL,... Has Daryl McBride ever had an original idea?

    SCO expands to making car parts. Then we should all expect this in the mail about three years after they start this new venture. Long enough for the various car makers to have all their products "tainted".

    The letter would read as follows:

    Oh I see how it is! They can use the OSS stuff at leasure, but better not
    have anyone outside of SCO using anything they claim is UNIX code base. So
    in otherwords they benefit from all the free development and expect all those
    that contributed (and most likely - before SCO, during Ransom Love days and
    Caldera) to pay for their generous offer of their code (if in fact any of it
    is there - that they won't let us see)!!!!

    And rumor has it that they won't let anyone see their Unix code because they
    are frantically porting anything useful that the OSS devs do to fold into their
    products (aka UnixWare and associated code) - Can anyone comment on this?

    Just more FUD but I'm really getting pissed off (like fantasies of knee
    capping, etc.). And someone clear something else up... Wasn't the 2.4.19-xxx
    series released after SCO started this shit???? If so then how the hell do
    they justify the kernel as tainted while folding in the new "tainted"
    developments/code into their products all the while screaming foul.

    GAWD these guys have balls.. They need to be squashed slowly with much pain.

    That's exactly the purpose of the interview. I'm sure the these "interviews" are conditional and that in order to get one the so called "reporter" must agree to McBride's "go list" of questions.

    Hence why this whole freaking thing is a sham. The claims unsubstantiated by SCO and the nature of the reporting make it out and out sensationalism and little more.

    Oh and the line about SCO not being interested in being bought out! Like McBride has never heard of a hostile take over? Ya, Right!

    ...and watch as they figure out fun and more creative ways to continue doing what they're doing without getting caught. I can see it now. The new users developed mod for Kazaa - the MASK, or perhaps the SPOOF. Just install this into your Kazaa directory and and change the line in your RIAA can kiss may ass file to "bite me".
    Then reboot your computer (unless your running Linux, then type "ldconfig" in the nearest console).

    Seriously, this will only garner more hate and angst toward the RIAA, and we all know the bottom line. The RIAA is hopelessly outclassed.

    Agreed! I came to many of the same conclusions. One thing to consider is the hardware. Windows cannot install and operate on the Mac architecture and vice verse. However Linux will run on both. If one is thinking of leaving the M$ haven of familiarity and conventions then the question could be asked - do I want to buy a whole new set of boxes (e.g. Mac boxes) or do I want to use a different OS on what I've already got or can cheaply build.

    Let's face it. OEM's and IHV's must have two sets of hardware devices, at least for things such as video cards, soundcards, etc. (harddrives withstanding). Bioses and chipsets need to be specific for IBM vs Mac requirements. However, Linux runs on IBM compat hardware so this is essentially a non-issue except in the case of drivers and ancillary programs that might accompany the hardware (bundled software).

    My wife is an artist and, yep you guessed it, uses a Mac. I have a couple of computers that I built myself. They have/had fairly current state of the art hardware and it was relatively inexpensive to build compared to buying a ready made - pre-installed Windows box from an OEM. So, in corporate sector the question is begged - do I need to buy new hardware and change OSes or just change the OSes?

    What is the cost of buying Windows, with or without new hardware/pre-installed verses buy a Linux OS (eg. SuSE, RH, etc) and then getting the support package?

    We've all seen the numbers and heard the arguments regarding the cost of M$ wares - the OS with per-seat-licenses, the support packages, the ancillary software needed such as Office, Exchange, etc. But if one already has Office and the licenses, and the cross-over plugins provide a functional use of these programs then why would I want to pay all those extra $$$ in the form of an quasi M$ tax? If my budget is tight (and these days most are) then it's a safe bet that I wouldn't want to spend more than I absolutely have to.

    So, I agree! It's not the Mac that is so much threatened by Linux on the Desktop - IT'S M$ WINDOWS ON THE x86 THAT IS!! And I'll bet the author is all too aware of this.

    What this article represents to me is the latest in a series of subtle and subversive FUD publications and articles. An attempt to shape perceptions. Why? Because in the market place and Wall Street - Perception is reality.

    Yes, nice attempt at inflammatory and subversive writing indeed.

    FYI. There have been several people that have contributed to the kernel from SCO/caldera. Just a word though. Just because they were from Caldera/SCO doesn't mean that they are part and parcel the contributors to any of the "tainted code" the Mr. McBride is claim was "stolen". But, you may find more SCO contribs around the time frame when SCO and HP were working on their Unix project - the one that got dumped in favor of going 64bit Linux - then look at the Linux 64 bit code. I have been search the archives, lkml posts, and many other sources (pun intnded) to see if any other SCO devs have there name on anything - they do. But it still doesn't mean they did or didn't give anything improper or at least in the eyes of any sane person (pretty much excludes McBride).

    Christoph Hellwig has also contributed to the kernel for some time. He worked out of the German office IIRC. He's one of Linus' trusted and in the inner circle - so I'm told. I seriously doubt that he has given anything that could substantiate McBrides claims as well. Oh, and he don't work for SCO anymore either.

    So, I can fully understand looking at any dev/contributor that had associations with or was employed by SCO that also did work on the kernels. But just cause they had this, doesn't mean the did or didn't give anything that would give SCOs claims credibility. Frankly I still thing McBride is playing and angle and this is alot of smoke and mirrors.

    OK, some of you might recall a story about the Indian (as in country of) finance minister (I believe that was his position) that got trapped in his Beemer becuase the M$ driven computer that BMW had decided to let control the car, well..... Crashed (what did you expect?)! I further recall that it was a particularly hot day in his section of India and that it could have been potentially injurious for the occupants if not for a group of locals that smash in the windows and allow the minister and the driver to vacate the vehicle.

    So, I'm supposed to let gates and company wire my house in a similar fashion? I DON'T THINK SO. Nothing like a BSOD or spontaneous reboots in the middle of farscape reruns on my M$ controlled HDTV. Or all my electronic doors locking me in or locking me out, or my smoke alarms keep going off at 3 a.m. becuase the Longhorn based system can't tell the difference between changes in ambient temperature and humidity and smoke from a fire. Ya, sure Bill's "home of the future" probably works like a charm. It had better. He is after all the founder of M$ and one of the richest men in the world (I'd hate to be the admin for his home system should it fail). But I don't have the same glowing confidence that my Gates designed "home of the future" would be as reliable. Not to mention getting spam in on my microwave and refrigerator screens.

    Oh, and a side note. Do you think the Indian ministers BMW incident had anything to do with India decision to sponser state supported Open Source and Linux development? Just a thought.

    Ok, so your claiming the company is in deep fiscal shit. So first what would the impact of a mass defection/departure of your departments personnel have on the company. If, as you contend, that it is essential and an integral part of the company's ability to conduct business, and hence stay solvent then it might be assumed that your people are in a position of some power.

    Now, if it proves correct that leaving would cripple the company in a meaningful way look at those in upper management. Do the CEO, department presidents/VP's, CFO's, CIO/CTO's, etc, etc, yada yada still get compensations like quarterly bonuses? Is the CIO and CEO salary on a scale that equals x times so many workers?

    The point is this. IF your department is getting done to them what so many corporations are doing as SOP. That is they are scaling down the work force to cut expenditures while mandating more responsiblity and increasing the workload. All the while kicking out bonuses and financial percs to the upper echelon with a continuing stream of revenue and returns for the share holders, then it may very well be time to send a message to the whitest of collars that it is unacceptable to continue with this form of exploitation of the work force.

    All too often we have seen companies and corporations that force layoffs, increase work loads, mandate overtime without compensation while the executives continue to experience the same, if not increasing, profits and percs. It must be realized that if upper management or the market has taken a hit to a company that putting the thumb to the work force without having the share holders, board members and chief executives share in the hard times is unacceptable. Often times the bonuses and other percs, like plump retirement packages, amount to the cost of a whole division. This is done on the perception that a qualified CEO can benefit the company in a way the garners both a lucrative and competitive edge. However, if the company is failing financially it can be construed that management has failed as well. So it needs to be realized the punishing the workers for the captains inability to guide the ship is no longer going to be tolerated. Until this becomes a trend expect CEO's and other high end execs to get richer regardless of their or their company's performance and workers to be expected to do more for less.
