    Those who mock the Shatner, those who dub him 'cheesy' or 'over the top' should ask themselves this: at what point during his performance of Kirk do you ever, even for one second, doubt that you are watching the captain of the starship Enterprise?

    Shatner - like Doohan - is a method actor. When the camera is on him, he actually believes that he is in command of a starship, and his belief is what drags us kicking and screaming along with him. Love him or hate him, you could never catch him playing it at one iota less than warp 9. This new guy? Pwwwpt. He's just an actor. He's not the captain of the Enterprise.

    Shatner. Is. Kirk.

    Star Trek: The Documentary Series era. Is. Shatner.

    And apparently completely speculative regarding whether they're actually being used or not. One interpretation for poor software sales is that the consoles aren't being used; another is that people are actually playing the games they already own. One statement from an anonymous "software house president" does not constitute evidence, particularly if he bet and lost the farm on porting RoboSlayer VI: The Gibulating to a platform that's better suited to and is bought to play other games.

    All patents have to (or at least are supposed to) list similar but distinct prior art, in order to distinguish their own unique invention. You can't point to the disclosed prior inventions on the patent application itself and go "Ah hah, gotcha!". I mean, unless you like to pretend that you're a lawyer on Slashdot.

    She should have gone for a guilty plea, but then majored on mitigation.

    The jury should have been asked to consider this:

    • Have you ever created a mix tape? You're guilty of copyright infringement.
    • Have you ever taped a song of the radio? You're guilty of copyright infringement.
    • Have you ever played a CD in your car with the windows down next to a busy bus stop? You're guilty of copyright infringement.
    • Have you ever sung Happy Birthday To You to a friend or loved one? You're guilty of copyright infringement.

    What matters here isn't the facts, which are clearly against the defendant, but the law, which is clearly against the people.
