    There was a recent case where a local proscutor argued that taking a shooting class was proof of premeditation for murder. I wonder if he has the same views about traffic school :-)

    This kind of use of a song is most likely covered by one of the many compulsory licenses. Music is used all the time in adds on TV, Radio and so on ... it woudl be silly if you had to get permission every time. You don't need permission to record a cover version of a song you just have to pay the appropriate licensing fee.

    The feds take the view that it's an aggravated felony which would bar an immigrant from ever gaining citizenship and may lead to them being deported. Even though most states don't charge it as a felony.

    Volvo (If I remember correctly) patented the three point seatbelt that's in almost every car ... they then licenses it for free to every car manufacturer.

    Ha ... XM was just trying desperately to come up with a new feature after Sirius added : dolby surround, streaming stock quotes & sports scores and more the first day of CES.

    Unfortunately for DirecTico owners, there's still no home media option which leaves us without such fun features.

    I have Sirius ... I'm very impressed ... I've never tried XM so I can't compare. The sound quality is very good, probably not as good as a CD but then I'm listening in a car so it doesn't matter as much. It's certainly better than FM radio in quality terms.

    Football fans will be interested to know that Sirius will be carrying all sunday NFL games starting next season at no extra charge.

    There were warnings over a year before columbia fell apart that cost cuts from successive adminitrators were eroding the safety margins of the shuttle.

    It's not a question of NASA running it in a safe manner but rather funding the program to the degree that would allow the risks to be reduced.

    Even Bush's new Nasa budget allegedly to pay for safety improvements for the space shuttle offered little in the way of new money, he just moved funds from one nasa program to another.

    Oxygen doesn't catch fire ... but liquid oxygen is really efficient at getting other things to burn ... do a google search for light barbeque lox or similar.

    I thought the lack of CC sourced stations was because neither XM or SIRIUS are licensed to carry any local content.

    XM has more repeaters because having geostationary satellites over the equator the signal is coming in at a 45 degree angle. Although the sirius satellites move they are closer to being straight overhead which makes more sense for reception in cities. Also as the main market for both services is for car audio the fact that the satellites move is not near as important as the fact that the car has to be able to move.

    Having said all that, I have no problem receiving sirius indoors, despite being in an area not served by a repeater and being on the first floor of a two story house.

    One thing to try, is get the car antenna and try that in place of the "home" antenna. The car antenna is not directional and often works better in weaker signal areas.

    I bought 4 16U predrilled and tapped rails on ebay for about $30. Then I build a wooden frame for the rails. I didn't enclose it yet. I used some existing rackmount equipment I had as a guide for spacing the rails.

    If you using compaq's cable management thingy then you need to have a depth of 29.5 - 30 inches between the front and rear rails. Without the cable management arm 24 inches will work.

    Common words can only be trademarked where they are not descriptive. ie Apple Computers has nothing to do with fruit. Apple Corp. is a record company and not a fruit company.

    Windows is not a valid trademark because it is purely descriptive.

    They have not ceased direct sale -- although their site does show them as temporarily unavailable. You can get the same $99 deal at Bestbuy or Circuit City, I called and asked directv where I should get one if they're out of them.

    Nope again. You're getting confused between the predecessor networks ... Arpanet etc.. which predated the current commercial internet.

    Without the tax dollars it would have been very much different.

    So why did the RIAA fight so hard to get congress to recognize music as a work for hire ? ..... because most of their contracts give them the right to publish a recording for a fixed number of years (typically 30) after that time the rights revert to the artist.

    Had the RIAA succeeded and congress had passed the work-for-hire amendment then the rights would remain with the record label after the contract expired.

    Remember also ... it's only the sound recording that the label has rights over ... the actuall composition still belongs to the writer.

    In the Napster case there was a classic moment where attorneys for napster pointed out that the RIAA owned *NONE* of the copyrights it claimed to, and the judge had scheduled a separate hearing on the matter... but then napster filed bankruptcy and the whole thing became moot.

    Works for hire can only be within the narrow range of types of works specified in the copyright acts. The RIAA knows this, they tried to get congress to change the law, which they did, and then immediately reversed the change.

    My cd's that I checked plainly say copyright 19XX bandname. Published by XXX Recording corporation.

    The difference is that the the computer code in your example is "A work for hire" your employer owns it.

    In the case of music, the songs are licensed by the artist to the record label who sells them to the public. The artist retains the copyright ... some labels try to get an assignment of copyright from the artist but I don't think they've gotten away with it very often.

    Not true .... The World Wrestling Federation had an agreement with the World Wildlife Fund not to use the initials WWF in place of the name World Wrestling Federation. When they violated this agreement they were sued and ordered to stop using WWF per their prior agreement.

    Perjury is a crime ... unless you are the president.

    Perjury in a civil case is rarely prosecuted, mainly because the losing party in any civil case could be accused of lying.

    Support is extra with all MS products. So I don't see how paying a higher license fee is paying for peace of mind.
