They are obvioulsy referring to Linux as a whole and not just the kernel. In fact there original suggestion was that none of the coppied code was in the kernel. If this is the case then there is probibly aso copywrite code in *DSD and OSX.
The problem is that many people allready use JBOSS. Probably more than use WebSphere and BEA combined.
I agree that you should try to conform to standards but if the stardards authority deliberatly tries to shut you out then there isn't much you can do.

When IBM first created AIX they licenced some of the technology from SCO (or whoever owned the unix IP at the time). I assume one of the conditions of the licencing was an NDA which prevented IBM from sharing the technology with third parties.
SCO is now claiming that the improvments that IBM are making in Linux is derived from the original IP and thus violating that contract. This is how they can threatening to stop the distribution of AIX.

Dell started announcing Linux pre-installed at about the start of the anti-trust case. The must have been benificial to microsoft in showing that there was compitition around.
Now that MS is off the hook, an announcement saying Dell is dropping Linux because lack of demand is perfect for MS.
Could Dell is nothing more than a Microsoft puppet?

The GLP gives you rights that you would not normally have. i.e. You would not normally be able to take someones source code and modify it to use for your own purposes (copyright infringement).
If I was a windows user I would worry about when the next version of windows arrives. Will they still be happy to re-activate your software when you update your (by now 1/2 year old computer).
What happens to the unfortunaly people who live in a country that does not have a convenient Microsoft 0800 number to call when product activation foes pair shaped.
