(5), (A): Notwithstanding the provisions of section 106, the following are not infringements of copyright:
except as provided in subparagraph (B), communication of a transmission embodying a performance or display of a work by the public reception of the transmission on a single receiving apparatus of a kind commonly used in private homes, unless
(i): a direct charge is made to see or hear the transmission; or (ii): the transmission thus received is further transmitted to the public;
On the other hand, under 17 USC 114:
(d) Limitations on Exclusive Right. -
(2) Statutory licensing of certain transmissions. - (v): the transmitting entity cooperates to prevent, to the extent feasible without imposing substantial costs or burdens, a transmission recipient or any other person or entity from automatically scanning the transmitting entity's transmissions alone or together with transmissions by other transmitting entities in order to select a particular sound recording to be transmitted to the transmission recipient, except that the requirement of this clause shall not apply to a satellite digital audio service that is in operation, or that is licensed by the Federal Communications Commission, on or before July 31, 1998;
So it looks like The Law has the iTunes 'transmitter' by the balls there...
I caught a blurb-mercial on TNN last week featuring two mock 'TNN suits' video-conferencing with Kricfalusi through a 60's TV set.
Not only are they bringing back Ren and Stimpy but the 6 brand-new episodes are purported to be more adult-oriented than the originals. Good. Fucking. God.
Because a mouse/keyboard/joystick only needs so much bandwitdh... And for every conceivable USB 2.0 peripheral that requires the bandwidth of USB 2.0 there's a non-CPU-dependant FirewWire alternative?
Oddly enough, apparently Apple's actually using USB 2.0 controllers on the newer MoBo's, just hobbling it to 1.0 in the firmware. I guess it's hard to find supplies of new 1.0 parts nowadays:P
I agree somewhat about Bakula's acting. T'Pol on the other hand makes more sense to the show.
Consider for a moment that a Vulcan female who is attractive by Human standards might be somewhat of an outcast amongst Vulcan society... Hence the High Command assignment? Now if only Jolene Blalock could actually act Vulcan
Ensign Mayweather quite possibly speaks that way because he grew up on a transport vessel surrounded by his blacksploitation-nostalgic family and crew (you know, like the rennaisance geeks of our era?)
Lastly, if you try and take my Ensign Sato away I'll jump through this internet and slap you up like a bitch!
Are we talking about the same guy who chmodded the file permissions to see what happens? Surely not. How about the guy who tried using the cable-loop-free digital --> analog --> digital software to convert the "DRM'd" AAC to mp3?
...users would prefer to go for the cheaper platform that performs just as well or better...
No, the chief argument is that all of a sudden you've got millions of people expecting to get "the Mac experience" by loading OS X on:
[Motherboard T] + [CPU U] + [Video Card V] + [Audio Card W] + [RAM X] + [HDD Y] + [Power Supply Z] (where variables T --> Z are a wide array of possibilities)
You no longer have a series of machines that 'just work' - instead you have "that other OS thingie that flakes-out almost as much as Windows - and has the window buttons on the wrong side - but sure looks and acts nice!"
To release OS X for non-vertically-integrated x86/AMD64 would be to evaporate the Mac platform's strongest selling point.
I would have believed that iTunes for Windows would have been started months ago...
We have every indication that they did start the Windows port months ago. Jobs made a statement along the lines of: "[Windows Music Store version] software is a little less... predictable" in his presentation.
They're probably looking for a veteran Win32 bug-hunter.
Yeah, I know, "the one that's pre-installed". We may still be globally screwed, but at least Apple's trying...
Being that AOL still comes pre-installed on plenty of x86bawksen - and being that there are strong rumors of AOL leveraging the Windows iTunes port for music management and purchase - it's not a long stretch to imagine a good % of future plebeMachines shipping with iTunes. We can always hope that Apple and AOL work out a series of deals with the vendors to leave iTunes separate from the AOL install (or at least not requiring an AOL account to access/use it - that's the long stretch)
AOL could be the 'Trojan Horse' Apple needs to ferret their way in.
Right, which is why I'm lead to believe that VPR keyboards are the most shoddy of the bunch
While I doubt that the average user would be prone to stress the keyboard to the same degree (barring a 2 year-old in their daily environment), I should think it indicates that a VPR would be more highly prone to snapping a random key due to carelessness etc.
Hey, who's shopping? Best Buy lets me play with x86's for an hour every couple of weeks so I can see what I'm not missing over here in the Apple camp:P
Every time I drop by the local Best Buy (Woodside, Queens, NYC) the VPR laptops are missing more-and-more keys from the keyboard. Doesn't say much for the quality of the components on the things.
The speakers are also pretty deplorable (after demoing the Beethoven sample that comes with XP on various display laptops)
That's just my point... I would be lead to believe that AAC has better algorithms for encoding analog audio (among others) as compared to.mp3 and vorbis. It's been a while since I researched MP4 standards, so this may or may not be the case...
Considering that they would likely have included optimization for THX/Dolby Theater Surround (as AAC is Dolby's puppy) it's not hard to imagine that AAC is better at compressing a wider dynamic source spectrum? At least compared to AIFF/ADAT?
Well then that bolsters my original reaction, which is that regardless of the original source of these 'test samples', you'll be hard-pressed to lease the master and rip directly to.ogg or.mp3 like Apple has done with the AAC's available off their service.
How do you know it's ADAT rather than analog 1"? Probably is ADAT in alot of cases, but nevertheless, I recall Jobs' statement (for whatever it's worth) in which he claimed: (paraphrased) "Sometimes they sound better than CD's themselves"

It's like there was a catastrophic magnetic polar reversal that turned good cartoons in to teh suck!
Haah! Chalk up another "person who grew up in Switzerland" to that list ;D Though, in the early 80's I'd say half our plugs were plastic/metal shafted.
:P
Boy do I miss the days of being zinged by 220... The wimp-ass current back here in the states just doesn't make the grade

Go read Jef Raskin's The Humane Interface
It's filled with the 'numbers' and science you so pedomorphically demand.

Every time someone suggests that, God kills a pygmy marmoset. Please, for the sake of the marmosets, stop.

Not entirely offtopic. Show me where I can find an equivalent MP3 or Vorbis service and let's compare those files against one another.
