This is not a troll. "First Sale" doctrine means EULAs are meaningless. The publisher cannot restrict my rights to do whatever I please with the software (copyright not withstanding) after I purchase it. A purchase is not a license.

While I agree with your premise, it's not quite as bad as you make it out to be. Most low-end manufacturers use the same chipsets, so finding that driver isn't all that tough in most circustances. In fact, you can buy a whole wafer of any of their embedded legacy chips if you want to do your own packaging.

Lately, I've been getting strange delays/failures that seem DNS related. Ping times to their own DNS servers (when I can ping them, ehe...) is 500ms to 900ms. It also appears that the driver downloads the firmware to the card at boot, so good luck getting a linux version.
Sometimes, when I'm running downhill with the wind at my back, I get close to ISDN speeds. That's the exception, not the rule. I do have to say it's pretty freaking cool to jump online where ever I happen to be. If the service was more reliable, I'd recommend it.
