I think a better analogy is the bank analogy. Suppose there is a big bank with layers of thick walls around it built by qualified technicians (the geeks). These walls are special, there may be cracks within the walls, and these cracks may be big, but they can only be seen by the qualified people (like the technicians, but some qualified customers can see them too).
Now suppose that in some obsure corner of the bank, the walls have a small crack in it not noticed by any of the technicians (or worse, noticed but not fixed), employees or customers. The crack can fit someone in easily, but it is not obvious to laymen that it can.
Now supposed someone is actively looking for these cracks in the bank walls and finds them, slips in and does something to prove that it is possible to go in. He slips out of the bank and tells bank management that there is a hole in the wall.
Management denies there is anything wrong with the walls (but they aren't even qualified to inspect it), so the guy shows him proof that he was in the bank and left a few marks. The bank arrests them for tresspassing.
I guess they have the legal leg to stand on since it is unauthorized access, but it is certainly not breaking and entering; he's not even testing to see if the door is locked. He just slipped in a crack in the wall.
Don't make an example of this guy. Give him a slap on the wrist and let him go. There are worst offenders out there.

It easy. Just run X in cygwin with the -rootless option. Remember to update your cygwin installation though. You will still need to run a window manager though.
Note: WineX uses AFPL. Wine uses LGPL, and the old Wine (ReWind) uses X11/MIT
The real reason that the license change was made was that Transgaming has made some really nice improvements and promised more work to be done. They also promised to release most it back to the main WINE tree. So far, only very select portions have been. TG argues that if they released more, there will be no incentives for additional subscribers. Thus, TG has a promise but NO RELEASE DATE for a free versions of their code.
What this does is preempt most of the development in these areas in the main WINE tree. For example if TG is working on improved DirectSound support, and has *promised* to release the code *later*, will you be motivated to work on improved DirectSound support in the main WINE tree? I wouldn't, and that's the problem.
TG has made promises without any dates. They just say that, "Oh we'll release it back when we recover our costs", but it's hurting WINE development by doing that. It's not only encouraging redundant work, it's also hurting the incentive to make a free version (by their empty promises). By changing to LGPL, they are hoping that WINE developers have an incentive to make something that is not preempted by TG (TG has stated it will not release stuff as LGPL).
I used to have WineX subscription, but I cancelled it. I also brought Crossover plugin from CW. Pressing a button on my KVM switch to my windows box is not a big deal. The only reason I subscribed was because I thought that I was contributing to WINE development, and playing games on my Linux box was the added bonus.
The US/UK/"Insert your country here" postal service is inherently insecure as it allows you to spoof your return address. Let's blame all the problems on them. What good did they do for us in the past few centuries anyway??

Sharp has always been a innovative force in consumer electronics. You just don't see the good stuff here in the Americas. The Zaurus hardware has been out for a while in Japan. What they are doing new over here is to load Linux on it.

That is why the UN creates war tribunals and why the USofA is opposed to creating a permanent one. They are afraid a permanent tribunal will undermine the ability of America to take the easy route out and play dirty once in a while.
You know what? For most users, the os *is* the pretty graphics. If these people want to make a xBSD with graphical integration of all the elements and distributed separately under a different name, that's great. It's a good experiment for BSD desktops.

There is no way to enforce that that if it is a real service. Software is not classified as a service. Music is not classified as a sevice. What is happening is that software and music is being packaged as products, and sold as such, thanks to copyright laws which are designed to protect source materials.
There is a difference and a very big difference. Your favorite band will not hold a concert for one fan, and charge the others later. It is not possible, and the sale of the "fractionized" services (tickets) must occur before the service was commited.

Trust has to be earned. Science is by default skeptical, you have to prove that your theory is a good approximation of the phenomena that you are describing, or else it is bunk. It must be predicatable and repeatable. I do not put faith in scientists, as I trust them, since they describe and predict phenomena much better than say, David Koresh ever would.
The header files may represent many months of reverse engineering, but it certainly didn't look it.
I would compare this more to a student that used code example from a textbook, but forgot to attribute it. There is clearly no malicious intention to plagurize.
The Mozilla browser is far from a failure. Recent releases preform very well against konq and opera. Mozilla is the only serious alternative to IE. Although Netscape 6 may be a failure in the market due to questionable positioning of product release, it should be a force to reckon with if Windows loses grip of the market.
