well i wont talk out of my ass by saying that i know for sure, but if we want to split hairs on it, if i were stuck in court forced to defend myself, i would argue that making a file available on my pc for downloading is not the same as making a copy and giving it to someone, as until the downloader initiates a connection, there is no copy being made... the copy doesnt exist until it arrives complete at their computer.
the file is on my computer, just as the cd would be in my house.. the person enters my computer, requestes the file (asks me to borrow my cd), and the file being transmitted to their computer is the process of me lending them the cd, then when the file is complete, they have made the copy themselves, because none of this requires any intervention on my part...
the fact that the copy and send process are in the same step is where the companies are trying to wiggle out a court rulling making it ilegal.. if a p2p process actually moved the file from my computer to theirs, then made a copy, and then moved the orriginal back, there would be no room to split hairs and call it any different than me lending the person a CD.
thats where you get into semantics.. who is copying for who? when i share on kazaa or whatever, im not actually making a copy, you are when you download it from me, you're copying it from my computer down to yours.
it is neither ilegal to be the copier, or the lender of the copy.. i dont know the specific wording of the law, but i cant see how borrowing a cd or whatever and copying it can be legal while lending the cd to be copied is ilegal.
will the courts uphold the previous laws passed about fair use... we pay tarrifs on media as a result of the laws that give us the right to share and copy music.. you cant charge someone a fee like that and then sure them for excercising their rights.

i have to disagree with that.. medeocre movies are seen only once.. good movies last forever.. for example (and all you matrix haters will probly flame me) the fist time i saw the matrix was when a friend of mine brought over a telesync of it, i basicaly watched it because where i lived at the time wasnt going to be showing the movie for another 2 months...
when the movie was showing, i went out and watched it on the big screen too... and then when it came out on dvd, i bought it as well.. i now own the first matrix movie, the behind the scenes dvd, and the second one, and when the last one comes out, i'll buy that one too.. (i dont want to digress into a discussion of which sequel sucked, etc, but the first one was so good, i feel that its strong enough even to support the 2 sequels)
maybe some day they'll have a burner that takes an inserted block of plactic, mold it into a cd, burn it, lable it, and then mold a labled case at the same time huh?

we fix things.. just like your $40/hr mechanic, like your $200/hr lawer or doctor.. something's broke and you dont know how to fix it. everythign you said could be aplied to in house lawyers. if they're in-house, they're really not making money for the company, but theyre there to fix any legal problems that arise. if there were no in-house tech support agents at a particular company, they'd be calling me everytime they have a problem, paying me $50/hr for the support, and $100 just to show up at said location to see whats wrong.. and then i would be earning my company some money..
your views are really out of context, when you should be comparing the role of in-house support versus call-and-pay-for support. just liek if your company had in house lawyers over hire-and-pay-thru-the-nose layers..

well you only worked there for 4 months.. my first 4 months we fine too, in fact i enjoyed my job for at least the first 6 months... once you get closer to a year, or 2, or 4, well i can only repeat what one poster wrote how it will wear a hole in your soul. it drains you, you have draconian rules, support policies, and call stats on one side, and screaming pissed off callers on the other, none of which is your fault, and basically your job is to be dumped on all day, having the life sqeezed out of you from both sides.
after being laid off, i now only make half of what i did before, strugling to make ends meet, and yet im happier and heathier now than i ever was in that job. things taste better, i have more energy, and i rediscovered my lost ability to smile again. i dont see it as being laid off so much as being paroled early for good behaviour.

Now the script thats provided is designed to work in a certain amount of time, as well as the huge list of things we wont support. i had a choice, go with the not so helpful and make you call more often script, or go with my own learned knowledge of troubleshooting and get you working as best i can.
at the end of the month, buddy who doesnt know that much, but follows the script to the letter, pisses people off (but since he followed procedures, his ass is covered), wastes a bunch of callers' time.. well he gets an award at the end of the month cause his call times ae so low. I on the other hand who spent the month bending over backwards (helping you find that mac address to your router instead of having you call the manufacturer, then call us back and waste more of your time) well i get a warning letter that if my stats dont improve, i will be let go...
the people you talk to on the other end of the phone are people too, and its not their fault that they have to be so unhelpful. in alot of cases they arent ignorant unhelpful bastards, they're just told that customer satisfaction and first call resolution takes a back seat to call times and call volume handled.
