Much software is written making the blind assumption that it will be in an environment with elevated access (my comment). But with yours (which is also true) some developers just assume that their SW needs it, and they act on that assumption, and then you end up back at situation #1.

As it was approved, one would presume that said court would find that summons service valid. So in short the precedent is 'when it appears that all else will fail, you ask for permission to take extraordinary measures.'
Email is *not* the first action, and would likely be considered invalid as the primary method.

One would presume that a bootloader is supposed to write in the boot area. One is not likely to presume a userland app in a high level OS is writing in the boot area.
If these apps are writing outside the file system, and doing so in an undocumented fashion, is this not; in some sense, a definition of malicious activity?

Didn't Blizzard argue that loading a game into memory to play is a copy? And then altering it in memory would be a DMCA violation. In order to play a video thats encrypted, you must work on the data, and thus to do so must make a copy of the data off the disk.
