Once you are convicted, tweet away, but until you are convicted the 'state' should honor the spirit of the law, where you are presumed innocent and not go out of its way to wave your name around in the media.
Beyond that, i think that all records of an accused should be destroyed if they are shown not guilty by court.
Personally, i think they knew this sort of nonsense would be the outcome. They had no chance in hell of killing all enough of us to make a real difference, but knew a carefully executed 'media oriented' strike would cause us to be our own worst enemy for decades to come, and effectively kill our way of life ( which they despise ).
But if I were in their shoes, I'd say: "I'm sorry sir; we've exhausted our diagnostic capabilities without more closely examining your server. Without the root password, there's nothing more we can do for you."
If it was my data center i wouldn't even host you. ( tho i would at least inform you first, unless it was via court order. you know i am responsible for whats in my building, regardless of the fact I'm selling services.. )
Aren't most virtual now anyway ( jails, etc ) and you are 'rooted' by the nature of how things work? Its THEIR hardware, their datacenter remember... ( unless you have a special relationship and you bought your own box )
If you don't like the way things are done, change providers or host it yourself.

He should provide direction, help facilitate, directly assist when needed, but mostly stay out of the way. If he has to 'babysit' his employees, then there are other issues at hand that need to be dealt with.
