This only would work to prevent mildy technically competent people from getting stung, which would be a *small* percentage ( truly technical people dont fall for it now so they arent even part of the target market for these scams ). Most people would never understand and the crime would go on.
This is just one step away from controling ( then eliminating ) the entire 'underground economy' we call bartering. Sneak it in using something the unknowledgeable comon folk believe in " we are helping the starving artists" until we all get used to it as 'normal'.
Next you can expect books to go this route. Computers.. Food.. Everything will have to have a registered purchaser 'for our protection'.
It places a bad precident where our citizens could be hauled over the border to other countries for violating their laws when doing a legal act here, something they ought to care about..
But its not their fault the OS has holes. Nor should they be 'techie' enough to understand how to avoid them.

In the long run it would be a better world. Sure there would be some bumps along the way and some people would take advantage of things ( but that is happening now, so that is nothing new ), but overall it would be a good thing for everyone.
Its also one of the oldest, and most used ( i would imagine anyway ).

Correct, but thats 'elsewhere', where the laws are different. In Sweden its legal to link, regardless of content. ( which it should be, or you get dangerously close to censorship ). Also sometimes its just not worth the effort to fight ( it does cost money, even if you win ), so many roll over on the first contact, regardless of legality beacuse they cant afford to fight.
And of course the *AAs can pay ( err lobby ) to change the laws to be more favorable to them. Thats what they are trying to do now in order to criminalize it at any level, so they can stop expending resources to go after people and rely on the government's resources to do it for them.
My personal feelings about the matter are not even coming in to play here.

In todays world its not safe to connect to the outside world without one. I dont see 'safety' being an 'obsession'.
Especially when 1/2 our house is run on an internal IP network. i DONT want someone managing to turn off my heat or something..
If it was spelled out in the contract, then there is no issue here. ( perhaps bad for business, but nothing more )

Matters of freespeech are far different then potential copyright infringements.
One is a civil issue, subject to interpretation, another is a guaranteed right ( in this country at least ).
Though that said, i think the ACLU should get involved with defending the kid from down under. thats really uncool what is going on there.
As far as im concerned, they have the right to do that too.
