    Ummmm, guys, I know this is America where everyone is free and all and I know that we have not proven a thing in a court of law, but can you please get rid of this Open Source thing. Its making it much too challenging for us to do our business. Here are a few lies and sound bits I came up with to help you at your next press conference. BTW... let me know if you are interested, I have some great SCOX stock you can buy and I'm pretty sure I know the next time it will go up!!

    Given all of this plain evidence, why isn't the SEC up SCO's ass!!!! They should be involved in this because:

    SCO is breaking the law, and it is the SEC's job to regulate that

    SEC is a government agency and lets face it, it is governed by politics. You can't get much better press than taking down a company as unpopular as SCO.

    So who is McBride stroking under the table to keep the SEC looking the other way?

    I'm confused? Why are we still talking about that. Wasn't SCO suppose to show evidence last week? Did they? Or has the judge bitch-slapped them? Does anyone have the status on that ruling and SCO's actions to fufill it?

    Riiiggghhtt... Because SCO says "Stop, this is no fair. Linux is mine but I'm not going to prove it" the people who have spent the last several years of their life building google are just going to unplug all of their servers.

    Does anyone know what type of Linux Google uses? If it were a main stream dist like RedHat or SuSE I bet those companies will jump in to try and protect their big customer.

    I posted the comment below, but I think my question goes better here and I hope you can answer it (I know, I suck)....

    I have to admit, we are beginning to see several new discoveries that put evidence to the claim that SCO is full of crap. But I have to wonder, back in late 2001 and early 2002, when SCO and their legal team were deciding if they wanted to start this campain, how could they not see these discoveries coming into the spotlight?

    They knew this data existed (hello, the linux kernel and all of the CVS logs are open to the public, they can be read by anyone)

    They have the same copies of the contracts as everyone else (Novel, Sun, ect)

    They had to know that a judge was going to make them produce evidence and this "We can't show the conflicting code" thing wouldn't fly with a judge.

    I worked for a dot-com that provided a service to Corporate Law Firms and I know that they go through a lot of trouble to do their homework. Some of these things would have not slipped their radar.

    So is all if this (including us tearing up SCO's claims) just part of their plan? Are we missing the real target of McBride and SCO? I find it hard to believe that SCO and their legal team are, or have ever gone "Oh Shit" since this all started. More like they are saying "This is going exactly to plan".

    First off, this is a good post and a valid point. What have we forgotten? Second, I think SCO is full of it. They have already contradicted themselves by stating that they own files that were never written by them(errno.h anyone?).

    So in my mind this is just McBride trying to give his board what they want, a company whose stock is going up. He has even admitted this is his primary goal in several public speaking events!

    But what is really getting me mad is the fact that in the end, the people who are really going to suffer are people like me, the developers, system admins, IT professionals. After companies are done paying the huge legal costs and false licensing fees, and then the legal costs to re-collect the false fees, how do you think they are going to then balance their budgets? By shrinking their IT staffs. Not by firing lawyers and upper execs. And does any of us really believe McBride is going to Jail? No, he has corporate law on his side. SCO may suffer, but not him. In the end he will have given his board exactly what they wanted, a year or so of climbing stock prices.

    Just my bitching.

    I really wouldn't worry about anything UNLESS for some small and strange reason SCO wins.

    If SCO wins and goes to all of their clients and say "You didn't comply with my demands before I disclosed any proof so now I'm going to shut you down":

    A: They will loose all of their clients.

    B: That may actaully be against the law (i.e. blackmail)

    My advice to you, sit tight, and wait until the judge decides something. And you are right, you have no need to certify anything to them, and they have no right to ask of that. They are using their intimidation to boost their legal case, which will fall short in the end.

    So you don't believe in years of embedded systems, systems programming, pretty much all routing protocols, and all operating systems other than windows (I have no idea what MS Windows is written in).

    The employees of SCO (everyone except for upper management) really have nothing to do with how SCO operates. McBride and his board sets the tone and the direction of the company and the employees follow. A developer who works on SCO Unix is not to blame for the Linux/SCO battle. I believe most hiring managers know that.

    SCO has now publically made claims that are not only untrue but serve to damage another organization. Also,they have now proved that they are trying to make a profit out of something they do not own and are not following the licenses that protect that product.

    How are they not breaking the law??? Can someone with some legal experience explain this to me??? If anything isn't this slander?

    I have one thing to say. If the attacker isn't SCO, then PLEASE STOP. You are not helping. Infact, the only thing you are doing is proving SCO's attacks on the Open Source community correct (that we have no regards for the law).

    Please let the lawyers handle this matter and stomp SCO into the ground. Victory will be just as sweet.

    I disagree. As linux tries to move into the enterprise market, something like this does nothing to help Execs make that decision to base their company on Linux. I think the best thing for Linux is for this whole mess to go away quickly.

    Of course I would love to see this trial go on and see SCO punished for this, which I think may happen either way.

    Don't be afraid of what your kids find on the Internet. Be afraid what finds your kids. My wife is a social worker who deals with child sexual offenders. You won't believe the monsters that are out there. And please don't think "oh, my kids are smarter than that or I know them." Because it has nothing to do with them. These people are very good at what they do or they would be in jail by now.

    My advice, put all of the computers in the open and only allow your kids to chat while you are home. Otherwise, can you or your kids be sure Jill3004 is really a 15 year old girl or a 27 year old sexual preditor?

    Street smarts has nothing to do with it. My wife is a social worker who deals with children sex abuse crimes. Internet chat rooms can be a very easy way for an offender to find a victim without the victim even knowing what is happening. And just thinking your kids are too smart to fall for that is stupid. These people are preditors and very good otherwise they would be in jail by now.

    I know it sounds like I'm over reacting but you should hear about the monsters my wife has to deal with.

    My advice, loose the computer in the rooms thing. Put all of the computers out in the open and only let your kids chat online when you are home. Otherwise, you never know who that name is on the otherside of the program asking them if they would like to get together sometime or where they live.

    My wife is a social worker that deals with child sexual abuse cases. The Internet is a great thing, but it is a VERY useful way for offenders to find victims. And just thinking "My kids are smarter than that or I'm keeping close watch" is not even good enough. People who do these things are very good at getting what they want and sometimes all it takes is a chat program.

    My advice. Have one computer in the house and keep it out in the open. And only allow them to use chat programs when parents are around.

    It may sounds like I'm over reacting, but you haven't heard about the monsters my wife has to deal with.

    Geeze, its a freakin movie. If you want to see how the story plays out, or just had fun at the first 2, then go see this one. If not, then don't waste your time. But don't bitch about how this one didn't change your life like the first 2 and thats why it sucks. In the end its just a fictional movie and you, well I won't go there.

    Personally, I had fun at the first 2 and I'll go see this one for just that.

    SCO reiterates its position that it intends to defend its intellectual property rights. SCO will remain on course to require customers to license infringing Linux implementations as a condition of further use. This is the best and clearest course for customers to minimize Linux problems.

    God help SCO if they don't win, they just sold people something they don't own. Isn't there a law against that?
