    Read the bill:

    1.Provides that any person, except a minor, located in California who, knowing that a particular recording or audiovisual work is commercial, knowingly electronically disseminates all or substantially all of that recording or work without disclosing his/her e-mail address and the title of the recording or work, is guilty of a misdemeanor punishable by a fine of up to $2,500 and up to a year in county jail.

    So what's the problem? If it's legit why would you care?

    2. Provides that if a minor violates the above provision, he/she shall be punished by a fine not to exceed $250. Any minor who commits a third or subsequent violation is punishable by a fine not to exceed $1,000, imprisonment in the county jail for up to one year, or both the fine and imprisonment.

    It still is up to the DA to choose to prosecute. I see no problem.

    3. Provides that upon conviction for a violation of this section, in addition to the penalty prescribed, the court shall order the permanent deletion or destruction of any electronic file containing a commercial recording or audiovisual work, the dissemination of which was the basis of the violation. The provisions do not apply to the copyright owner or to a person acting under the authority of the copyright owner.

    Duh.

    4. Does not apply to a person who electronically disseminates a commercial recording or audiovisual work (a) to his/her immediate family or within a network accessible only to individuals in that person's immediate household, or (b) where the copyright owner has "given permission [for the] work to be freely disseminated electronically by or to anyone without limitation."

    So this doesn't apply if the author gives you permission. Big deal AND provides protection for multiple PCs in a house. Sounds good so far.

    5. Defines "audiovisual work" as an electronic or physical embodiment of motion pictures, television programs, video or computer games, or other audiovisual presentations that consist of related images that are intrinsically intended to be shown by the use of machines or devices.

    Blah Blah definitions here...

    6. Defines "commercial recording or audiovisual work" as a recording or audiovisual work that the copyright owner has made or intends to make available for sale, rental, or for performance or exhibition to the public.

    This seems reasonable.

    7. Provides that a recording or audiovisual work may be commercial regardless of whether the disseminator seeks commercial advantage or private financial gain.

    Protects unreleased works. Just because I don't plan on selling that sex video does give you the right to distribute it.

    8. Defines electronic dissemination as initiating a transmission of, making available, or otherwise offering, a commercial recording or audiovisual work for distribution on the Internet or other digital network.

    Key word INITIATING. A passive distributor (ISP, P2P "middle man", etc.) is protected. Only the active sender is a target.

    9. Defines "e-mail address" as a valid e-mail address, or the valid e-mail address of the holder of the account from which the dissemination took place.

    Again if it's legit this is simply providing a point of contact so questions can be asked. Doesn't have to be an address with your name. root@provider.com would work just fine.

    If you read the bills and quit listening to others you find out these laws are as "far out" as they seem. CBS taught us that just because the news says A doesn't mean A is true. Just because the /. headline says A doesn't mean the content says A.

    Wow too bad that isn't what the article says, only requires store to post about ratings and offer borchures. What's the problem? Sounds like the only ones bitchin are kids that don't want mom and dad to know that that Postal 2 games isn't about delivering mail....... How is that limiting the sale of videogames? I wasn't aware that borchures LIMIT sales? How is this limiting? To be intellectually honest this should have read at least: ..bill to limit the sale of violent video games...

    Speaking of mail btw it's mail, not mails. You don't go to you mail box and get your mails. So why do people insist on saying EMAILS. EMAILS IS NOT A WORD ;) Think about it Electronic Mails? It makes no sense! If Emails makes it into a dictionary I'm switching from english to esperanto.

    The way primary and secondary education is going these days:

    A: We'll need to first consult with the UN to get permission to test engines that will get us there.

    B: We'll need to simulate in a computer the long term effects on Mars because animals have more rights then people and animal testing is bad.

    C: We'll need to make sure our Mother Earth grants us permission to use all that air and make sure we don't cause injury to her.

    D: It will take 30 years to recycle the materials to build the craft and remember, we can't use electricity because the coal fired power plants pollute our Mother.

    E: We'll have to outsource all our engineering to a communist country as we are too busy teaching self-confidence and self-esteem rather then Math and Science.

    F: We'll have to find a way to blame any failures on those stone age conservative types as their are doing this solely to destory our Mother Earth.

    G: We'll have to write an essay on why Bush is an evil man for suggesting we head out to Mars to rape our "Mother's Little Brother". (Yes at Castle Elementry in Oakdale MN I overheard the science teacher referring to Mars as stated)

    H: We'll have to hold hands and hold a candlelight vigil protesting the shameful endangerment of flocks of birds that the shuttles may hit during liftoff.

    I: The government will have to hire thousands of small, mom and pop shops, to build the craft as we wouldn't want to favor large corporations that might actually get the job done. The government will spend the next 30 years trying to sort out the details and keep the 400+ companies on the same page when it comes to construction.

    J: An artist will have to design the look & feel of the shuttle to represent the spirit of community ignoring practicality and expense. Engineers spend another 10 years trying to make the giant abstract artwork safe to fly.

    K: 80% of the originally approved budget for the project will be appropraited for welfare programs for people suffer the latest disease called Labor Deficit Syndrom, a horrible disease affectting 90% of the population. Formerly known as "Lazy"

    L: After 60 years of buracracy, silly politically correctness, and apathy the US will be overthrown in an Islamist extreamest revolution backed by the communist. The resulting civil war after the Isamunism victory the commies and Islamist Radicals start a civil war. Islamist win. Cue theme music to Dune and proceed to appoint the first Padasaw Emperor.     Ok, I just wrote a song and have submitted a violation of the work. My song is every key on the piano played in staggered sequence. ANY SONG THAT INVOLVES A PIANO NOW VIOLATES MY WORK. Chords on the piano are a violation as they are several of MY samples overlapped. My fee is a mere 1 cent per sample. Thank you.

    It's how they answer that is key. Concerning the Trick Question, its far from a trick question. If you tell someone to turn of 1st ave to get to a meeting and they turn on 1st street I'd seriously question their ability to critically think. If you tell someone that there is ammonia in the blue bottle and there is clorine in the blue bowl are you telling me its a trick question for them to not pour bleach into the bottle?

    With those missing states Nader cannot win the electoral vote as far as I can tell. His staff will do the count and if he can't win he'll still stay in to draw votes from the Dems. The republicans cannot afford Nader to drop out if the race is as close as it looks. This puts Nader in a position to get F'ed by either party but if he wants to garner favor with the left he'll drop, if he wants conservatives he'll stay in.

    30 years of socialist vauled pumped into a closed education system with no checks and balances. You expected education in government run daycare services? I was a teacher and I'll never go back, they're (the administration) only concern was enrollment and profit, protecting their own jobs.

    Fact: Staffing is based on a student to teacher ratio. In fact democrats and republicans alike try to tell use that the quality of education is directly related to this ratio.

    Problem: If this is in fact true then it presents a conflict of interest to the educators as by failing students that should be, they reduce the student population, and thus work themselves out of a job.

    Fact: The universities and colleges generate revenue (profit) based on student enrollment.

    Problem: This motivates colleges to lower entry standards and retain more failing students in order to retain as much revenue as possible. Special education programs serve as an additional "safety net" to retain students.

    Fact: The dollars spent on college and highschool education, and the increases each year, are not porportional to the increase in student grades and drop out rates.

    Problem: Teaching, just as many government jobs including law enforcement (including lawyers both civil and criminal), and emergency care (doctors, nurses, emt, fire dept.) have ethically and socially moved from "callings" and "public service" fields into "just another job and\or business." Teachers are no longer motivated by a higher calling of educating people, passing on knowledge, and bettering the intellect of the world. Teaching is now just another job and profession and the quality of the education system as a whole decays relative to that attitude change. If you need an example just look at the legal system's decay including Intellectual Property Law and Tort law. It's not about justice it's about the business of being an attourney.

    Fundamental Core Failure in Education
    "The fundamental failure of education is the belief that everyone can be saved, that everyone is an A student."

    College specifically was to weed out the weakest and graduate the best students. Just because you go to college and do your homework doesn't ENTITLE you to graduate. Look at the graduation rates in history. You were damn smart to get into college (or wealthy, lets be real here) and then to graduate you had to rise to your best. Back then when you graduated college you HAD the skills to work in your field as a professional, now college only offers the entry level requirements. I can't count the number of people that graduate college and I still have to show them how to do their job. They know where to find the information, they know what they need to do once they start, but few know how to apply the shit they learned to REALITY.

    Simply put college education was the bell-curve system where only the top students were A students. Students had to compete with themselves and fight to be the best not only in day to day life but in the classroom. That kind of hunger fueled REAL teachers and REAL education. I can quite easily say that I don't trust an A student from Harvard to know his ass from his face. I've worked with hundreds of Ivy league students and countless community college students. They're all equally lazy and foolish in HOW they think. What they "know" means little if they can't apply it.

    YOU CAN SUM UP THE PROBLEM AS FOLLOWS:

    The current student works with 3+3=?.

    Students of oldschool and high quality information work with "Three apples plus 3 oranges equals how many pieces of fruit?" this not only tests wether they know what 3+3 is but also what and apple and orange is as they relate to fruit. Think of current school like isolated weight training versus cross-training.

    Make sense? You want to fix education ELIMINATE MULTIPLE CHOICE TESTS AND REPLACE THEM WITH FILL IN THE BLANK TESTS! Force students to think critically and form educated guesses rather then affix them a probability of A-E on a test. Br

    Well for all you complainers about American Politics being the focus you need to remind yourself that in many countries (apprently not yours) that those countries in fact do have political parties and plently of drama that the rest of the world might be interested in. Yeah the US is huge and the rest of the world does tend to watch our politics with more interest than their own but you never know maybe some of us would like to know what's going on politically with the EU and copyright law, the UN's insaine attempts to tax international flights and space accesss, and will Tony Blair sleep with Shania Twain after a change encounter on the deck of the ISS station! Politics is sooo good to follow but like a soap opera you have to hang around for a while till things make sense. Case in point, what's gonna happen in Cuba when Castro dies? What are the political ramafications with the botched Russia indicdent? How close are we to the return of the USSR?

    Can't wait for the new category to start rolling out news!

    I think that counter-strike has found an near perfect formula that follow the KISS standard. GAMEPLAY is the real core of a game. The graphics are just icing. The have a perfect sense of gameplay so there is no need to fix it. Just to make it pretty for the new generation.

    Because with the knowledge that they need bullets they may attempt to make bullets without understanding the technology behind it (to stay in the metaphor). I person that understands the concept of a gun for instance by try to make their own with a small amount of knowledge but without a firm understanding they might end up blowing themselves up. Think of teenagers left unchecking in a chemistry lab versus and adult versus a trained chemist. Varying degrees of knowledge (and wisdom) and varying results.
