I would like to know of an algorithm that allows for the fair use of a work that does not allow someone to pirate it as well; unless you expect us to hunt down & request clearance every single time we want to make some fair use of a copyrighted work.
Frankly, the schemes are untenable because if I can see or hear it, I can copy it (until all devices that can do so are made unavailable, at least...) and if I can copy it a piece at a time from some algorithm, a bunch of us can copy the whole thing, eventually.
As such, these schemes simply won't work, unless you can violate any of the assumptions made above.
These are, of course, the rarest/most "collectable" games, rather than the best. Despite being the only porno NES game, Bubble Bath Babes is CRAP. It's just another derivative 'line up the colored ___s' game with pr0n in the background. Of the lot, Phantasy Star was one of the few that stood out as actually being a GOOD game.
If you don't mind, I'll go back to playing all the FUN classics now (all the Marios, Zeldas, Guardian Legend & the good RPGs) somewhere that supports our right to fair use (consoleclassix.com)...
That's a lot of trouble to go to for Tetris (if I went to that much trouble, I'd rather play it with the lights of a building or something geekier like that:)

Well, spamhunters try to raise those costs by getting the spammers ToS'd off their service providers; the problem is that that doesn't cost them *enough* to make up for all the suckers they rip off:/
If more providers would have a 'spam clause' in their ToS that allowed them to collect damages, we might be able to get somewhere...:/
... why don't they just collect the 404s off the requests to their site? No need for spiders; if someone puts up a bad link, they can find out as soon as someone clicks on it. *sheesh*

Where, exactly, will that precident be binding (if anywhere)?
Since it the case was never lost, I don't think it was made by any court whose decision could be a binding precident, but IANAL, so...?
