    Hell, Thomas Dolby is about the only artist I can think of who has re-worked the same material only to come up with essentially the same thing.

    I just want to make the point to all you non-lawyers out there that property is not just physical objects.

    Well, at one point it was, in the sense that it had to be tangible (as in a tangible asset). This changed and the world got screwed up in the process.

    15+ years ago, I was dealing with IP issues (going through patents even though I'm an engineer, not a lawyer) to give my "opinion" if it was valid. Today, there are engineers that do that as a profession.

    One only has to ask "are things getting better or worse?".

    When a company spends time, money, and resources to refute a bogus "C & D letter", who do you think pays?

    Does the airline have the right to know who's on board their own airplane?

    Sure. And let them do it with THEIR money. If I don't fly, then there is no reason for me to subsidize them. Nor is it any good reason to argue for strict new laws.

    But instead, our tax money is being used to create high security zones around airports. Much of that money could go into infrastructure (and paying the folks that are getting layed off - like health workers, police, and firefighters).

    Hell, let airlines institute anal probing for all I care - but do it on their own damn dollar!

    What BBI is suing over is a name THAT AIN'T USED ANYMORE.

    If the Alamo (which I am VERY familiar) were still using it, it would be an issue. But they aint (pretty much the whole fucking point of a C & D - you know, braniac, cease and desist which is, oh, yeah, to CEASE AND DESIST).

    BUT NOOOOOOO, they are NOT using the name probably because of Trademark issues (again consistent with a C & D and consistent with legal bullshit). Hence the "used to" as in "used to be named this but was determined to be too close".

    So, no, it is shakey. Period. Now, for the kicker - Austin is known for allergies, so it IS a fucking joke (SINUS... ALLERGIES... get it?).

    As for the humor, last I checked Trademark law had nothing vaguely dealing with that -- tough titties for BBI. Their suit is lame at best. They are just pissed that someone is using a concept, that they didn't invent, in a LIVE show.

    BBI had more than enough of their 15 minutes of fame. Now they just need to go die (in the sense that the biz needs to die).

    I haven't used it, just bought a product that used it. I've used it for a while (till I get around to writing my version). The problem has been stability for me. Now, granted, it may be the author's fault, but he continually talks about how they keep changing their API... Frankly, since you would have to learn an API anyway, I don't see why he didn't use Cocoa and be done with it. I've written some stuff with it (not production quality) and it really isn't that hard. I just see RealBasic as something that was cool when writing code for the Mac was hard, but man, it is just too damn easy now!

    Oh, wait, I DID READ THE BUGGERING ARTICLE! Note where I said "Mr. Sinus only vaguely sounds like Mystery Science" because, in fact, it DOES only vaguely sound like it. Perhaps your phoneme set is like Bush's, but mine STILL makes them out to be distinct and different.

    Best Brains is suit is weak at best. No one would be confused that Mister Sinus is in any way, shape, form the same group of folks. It is just another way to grab someone elses cash.

    Since WHEN did MST3K (which I loved) have a "copyright" over three people sitting in a theatre making fun of movies?

    Mr. Sinus only vaguely sounds like Mystery Science and that is about as close as it gets. This is like suing a band named "The Bartles" because it sounded "pretty damn close" to the "The Beatles". Never mind the fact NO ONE would be confused.

    At best, "Best Brains" only has the right to sue them if they are ripping off their material. Suing them for something that is vaguely similar only makes sense if you have no career, haven't had anything original for a decade and want to cash in on someone else's success...

    Yeah, well I've bought and used a product written in RealBasic. Keep away from it. Frankly, had the developer written this product using Cocoa he would have had far fewer problems and a much more stable product.

    RAD it is, but production quality it is not.

    Rubbish. This is along the same lines as CBS's "we don't take advocacy ads" -- but beer ads ARE advocacy ads (they advocate that you drink a particular beer).

    Commercial speech quite frequently is political speech. When ADM has commercials that indicate "we feed the world" -- that is political. Absolutely no way do they really feed the world. What they are intending to do is leave you with the impression that they are good guys. Therefore any bills before Congress are "to help feed the world" -- and ADM got a LOT of money out of Congress (but as a rancher I didn't see one freakin' dime).

    Anyone who buys the "commercial speech ain't political speech" is living in the past. How many flags popped up in ads after 9/11? How many of these companies are actually NOT American companies (give you a hint: think Bermuda). How many companies tried to link themselves to the heroes of 9/11? I saw everthing from phone companies to soft drink. Not political?!?

    Only a simpleton would believe commercial speech is not political.

    Well, not useless, but rather misleading.

    I agree, the even 1 out of 25,000 is not impressive (perhaps not useless, but not impressive). The reason is that the firewall (and software in general) is unable to determine if the content is important.

    For example, if I miss that letter from Aunt Millie telling me about her frickin' rose garden which is doing better after I poisoned it (intentionally) -- that is pretty damn close to SPAM, but not close enough to warrant being targetted as SPAM.

    Hoever, if I get notification of $1,000,000 check OR someone has mentioned to the cops that they sqealed on me about said poisoning of Aunt Millie's garden, well, I would consider that a whole lot more important.

    Importance can not be determined by software, only by people. There are some things that can be determined by software, but anyone who is looking for a magic bullet, is buying snake oil.

    For example, I would be very curious if I could put the so-called "spam firewall" in 100 installations and get the same 1 in 25,000. Or is it YMMV? Or "only after it has been critically tuned". I am also wary of marketing gimmicks. Usually means snake oil lurks somewhere nearby...

    Speaking of snake oil, I've got a 5 gallon jug of it on Ebay starting at $500 dollars. Guaranteed to stop, uh, all but, uh, lets say, 1 in 50,000,000 SPAM. Just takes a little tuning first...

    Well, yes. After implementing any system, you review after a period of time, and correct mistakes/problems. Also known as "The Microsoft Approach". Rather than bother to test and retest to make SURE that it has few/none false positives, we decide to just go ahead and implement it (also known as the "Missile Defense Approach"). Sadly, this administration has been quick to implement bad law and bad practices and slow to address the problems resulting in said laws and practices. Testing? Who needs it! The kicker is that NONE of these "preventative" measures do anything but further terrorize the populace.

    About 20 years ago. It was interesting. Nothing happened. Altho the static foam did an interesting light display. Scared the shit out of us!

    Smashed a 7404 in incremental steps till it ceased to function. It was amazing how much of the silicon was showing while it was working. That was prior to the nuke incident.
