And our murder rate....wait, damn, it's gone up over the past 20 years....

Then let's get into the ethics of the matter. Is it really right to single one individual out of x number of people and shitmahher them for something, especially when it's something like MP3's....come on, you are going to tell me that under these circumstances these two should lose 5 years of their life and be put in the same group as pdeophiles, murderers, rapists, and other violent criminals?

Theft is illegal, and should be punished, but to me, if I don't see PROOF, damn good proof too, that they REALLY lost money DIRECTLY by his actions, I am NOT sold on sending them to prison for 5 years of their adult life.

Erm, how is it someone elses service? They bought that "someone else" so it's THEIR service. The point here is that D&M don't HAVE to make their own service, because they bought someone elses service, so all that infrastructure work with channel guide updating, and so on, and hardware design, os customization, menu building, it's already done. Otherwise they would have just made their own from scratch.

There is absolutely no reason to buy a company who's assets contain everything you need from top to bottom to get a functional PVR out the door, and then change crap so it becomes "yours".

It already IS yours. Any changes you make to the system (outside of new features and whatnot) is just making life harder for you than it needs to be.

It would be like me buying, oh, GM, then changing the engine bays so they don't fit the standard GM engines anymore, then making my own engine just to put it in the car and say it's "my engine".

Why dothat? It's stupid, just use the engines and bays and layouts you paid for.

  20. Major occlusion from the article. on Man Jailed for Selling Modchips · · Score: 1

You know, the tiny bit of info regarding the fact that he also was involved in selling DSS hacking equipment.

I bet that had a pretty big role to play in his arrest.

Also keep in mind that the XBox BIOS isn't, really, a copyright protection mechanism. It's primary (and I don't count using a ATA spec. hard drive lock to be a copyright protection mechanism) function is booting the PC. Not making sure you can't play copyrighted games. As a matter of fact the XBox doesnt have any real copyright protection. Which is going to screw them on this one. Because ALOT of the modchips for the XBox do NOT come shipped with a MS based BIOS, the Xecuter II lite does, the enigmah (which sucks) does, and a couple others, but the Xecuter II Pro, Matrix, and that Aussie one, donn't come with a BIOS or come with the Linux Boot only BIOS. It's pretty damned hard to imply that a modchip that, as sold, only lets you boot Linux and nothing else is a device for bypassing copyright protection (if, as I said before, you want to really call it that).

In short, the "end of XBox modding" approach some articles have suggested is far from the case. But maybe the stock the retailers carry will change a bit :) or maybe they will stop advertising them as XBox modchips and instead call them "replacement backup BIOS's" or some such BS, and only ship chips without BIOS's on them, that way, as advertised they are nothing more than a generic BIOS replacement for....whatever really. The problem comes in when you start SAYING "plays backups". And when you start SAYING your product will mod the XBox. If BMW startedmarketing their cars with the feature "High Performance breaking to help you in your bank robberies" they'd come under fire too :)

  21. What I think people don't realize.... on Sell Your Computers, Keep Paying MS For Licenses · · Score: 3, Insightful

Is that even if MS went away tomorrow, we wouldn't suddenly have a great new OS to replace them. I mean, 12 years later Linux, while having made great strides, is NOT ready for mainstream yet.

    Sad but true.

Once Linux becomes capable enough to make it mainstream MS won't be able to keep it out. Because there is little real financial burden on Linux. It's an open source product where ALOT of the work is done, in essence, for free. So MS can't bully it out of the marketplace by putting pressure on their vendors until the OS suffocates itself for lack of funds like a competing comppany would surely do.

It's here to stay because nobody is paying for it, and nobody is financially burdened by it. So it developson it's own, with TONS of fierce competition from MS. And it does nothing but grow and grow.

People should STOP complaining about Ms being a monopoly and START contributing to Linux/GNU.

One of the above posters said if you don't like it, don't use it. Thats dead wrong. As with everything else in life, if you don't like it, do something to change it. Do something to enhance Linux and/or its acceptance.
