You know, I'm not an MS fan by any means, but please, that's gotta be the most over-used line in the universe! It would seem that any company that isn't doing so well decides to use the "let's sue the MS monopoly route" rather than trying to improve themselves by, oh I don't know, innovating!
Microsoft isn't a monopoly by any means. If you don't like it, get a Mac. Or, better yet, get Linux and quit complaining.
ESR defends his position that 'Open source would be succeeding faster if the GPL didn't make lots of people nervous about adopting it.
Considering large organizations even consider the move to Linux (thanks in part to IBM and their pretty commercials) today and the fact that even a large Microsoft competitor moved their core operating system to an BSD base, I'd say open source is moving along pretty darn well.
Then again, I should probably watch what I say, otherwise my username will appear under the jargon file as a new, ESR-arbitrated, slang word;)

Frankly, I'm all for this method of distribution, as I barely watch 'regular' TV anymore.
The only two channels I watch are the Discovery channel, and the Cartoon Network (Adult Swim). There is a definite need for more intelligent programming, other than the garbage that American Idol, The Crapelor, or whatever shi'ite that the big networks decide are "good" for the masses.
Then again, the morons that watch this crap raise the ratings, and the networks follow the new trends. Maybe this leads back to education. Educate people more, make them less stupid, and maybe we could get higher quality programming that would actually be enjoyable (as opposed to "reality tv").
Personally, I find the need to disable more and more RBL's, because today a user might come thru OK, tomorrow, they're stuck in SORBS and considered a HIGH risk.

In the UK, when somebody files a lawsuit and loses, not only do they have to pay for their own court expenses, but also those of the defendant. This isn't the case in the US, which is why we are the most litigious country in the world.
Now, let's look at computing. If we just let the asshole hackers get away with their crime without a fight, they will keep on hitting us hard. But, if we had a mechanism that would "fight back" and destroy a 15 year-old script kiddie's computer that mommy and daddy bought, well, maybe they'd think twice.
You know, you DON'T HAVE TO UPDATE. I haven't updated my XP box for almost a year now. I'm still running SP1 and no anti-virus (I know how to use the TASKLIST command). Guess what, I have no problems, save for the occasional crash due to Photoshop being a bitch. The difference between my unpatched Windows not getting spyware/viruses is that I'm not a dumbass and try to download Buddy Handjob Bar or whatever it's called. That, and I use FireFox, which has NEVER failed me.
I find it interesting that in the early 90's, Apple fell hard because of the difficulty of creating hardware or software for their machines. Microsoft Windows, on the other hand, was based on IBM PC's, a format that encouraged third party support.
Now, Microsoft is trying to once again get that third party support by allowing it's music to be played anywhere; as opposed to Apple's iPod only being able to play iTunes music. I don't know if this tactic will work the second time around, but it will definitely put a big gorilla against Apple, that's for sure.
I'm still waiting for the time when I can "see" the computer code, via a green monitor that displays a shower of code. Then, I will have a plug that connects to my spinal column and allows me to "enter" the computer and manipulate the code using my brainwaves.
It'd be very efficient, I could then just think of finding a file, and there it would be. Or better yet, I could imagine a beowul...NO CARRIER

Most likely, Intel will take that performance throne with their "secret". They have a way of doing that (like HT); but, we'll see something better come from AMD. And so the cycle continues...and we all benefit!
