    This lawsuit was not about a program to listen to US citizens.
    It was a program that tapped non-US suspected terrorists. Those suspected terrorists made phone calls to people in the US or someone in the US called them. Those phone calls were automatically record, and that is what is law suit and the complains are about. People also forget that the way this all came into the news was that the correct chains of command were informed(executive and legislative branches) and it came from that. BTW the program has been changed.
    Also once it was identified that the person was a US citizen they were passed on to legal methods. There were no US citizen directly wiretapped under this program.

    I will believe that when marketers stop by passing the technical office and going directly to non-CIO management. Also take a look at upper management aimed magazines, non-technical related, and they are filled with computer ads.
    For an other example in the mid-90s IBM, for one of thier servers, were doing a so-so business, they pulled all tech related advertisment and went to ads aimed at management, sales increased.
    Management is more worried about CYA and making themselves look good, same as everyone else. So they will pick a product if they are comfortable with the name and don't think it will hurt them, or to put another way while management may not care what hardware/software is being used they will go and pick out the products if sold a pretty picture.

    First don't use VMWare Player get the server version which is also free.
    I use Virtual PC at work and VMWare at home. Personally I find the VMWare faster in response, even if I take a Virtual PC image and take it home and translate it to VMWare, VMWare seems to respond faster.
    The VMWare Server version is different from the microsoft virtual server software. The VMWare server also includes an enhanced frontend that the plain player does not.

    Massachusetts kind of became important because it was the first state that really pushed for requing goverenment offices to use a non-propietary format for the storage of information. Other states then followed the laws originally written by Mass. Since most other laws are similiar to the Mass. one if Mass. allows the microsoft format the other states will follow.
    Since microsoft is going for ECMA and ISO standardization of thier file format, personally I think it should be approved; once the ECMA and ISO approval is done.

    What people dislike about SOE is that they have published two big games, Vanguard and Star Wars Galaxy, which have both been really horrid games. What they totally ignore is that the head developers for both of thoses games said that SOE gave them free control of the products. SOE just required updates and for them to stick to time schedules that the developers agreed to. However theses people are mainly fanboies and don't want to recognize that people they have been saying could do no wrong and would produce the best MMORPG in world made sucky games.
    Alot of other people are joking because SOE has been buying up a lot of on the verge of failing MMORPG: Vanguard, Matrix and some others, and then using them as content for the SOE all access pass. So that this game is coming under SOE could mean that it is a horrid game that is basicly finished but the developers need money so they are bringing thier creation to SOE so it can live since it could not survive on its own. Or it could be a really good game and SOE has a good history as an MMORPG distributor. SOE has been taking those failed games that look to have some future and changing them around based on users, not fanboies, comments in hopes making a profit off of them.
    SOE does have some problems, customer support in game can take between 1-2 hours during prime time and are generally clueless on the games(compared to people who play it 3-4 hours a day) and they have no problem in allowing the game developers to nerf a class if it is needed for future balance.

    Gallileo got in trouble because he disagreed with the scientists of the time, and that he could not prove what he was saying. He published works based on the copernicus model with the Pope's blessing, and the threats of the scientists. It was when he started saying that it was the truth that really got him in trouble.
    He had an audience before the Pope to prove that what he was saying was the proof, he could not and got thrown into house arrest, part of the crimes he was inprisioned for was lieing basicly going against the scientific consensus of the time.

    Cheating will still be wide spread because you need to download the program and other information down to something under my control.
    You already have cheat programs that do not modify the original, on disk, in any form they just are run before you start the other program and then add thier hooks and cheat into the running software.
    The only way to advoid this would be everything is run on the servers and all the users computer does is act as a dumb terminal; full circle from the old multi-player games from Compuserv, Prodigy,etc. Even then you would have aim-bots, and other cheats that allow the cheater to more quickly do something.

    I found an easy way to deal with services like that. Call them up and when they say someone else is already at that address tell them that person died and you just moved in.
    You can try to explain that the other person has moved, etc but when you add that the other person is dead it seems to clear most problems. People want to be a little more helpful and with the other person dead it cuts off most avenues that they can take.
    This also works with paypal, if you forgot your password don't want to go with the hassle of sending in the paperwork to prove who you are and don't have any money in the account send them a email telling them that the former holder at that email account has died and you want them to kill that account from thier records. Wait a day or two and the account is gone and you can resign up. I have done it twice with my own account and once with someone else; since then I have started to use Bruce Schneier's Password Safe.

    Depends on the state, but from what I have read, most states just require that the summons have a way of uniquely identifing the person, most common being the name and residential address of the person.
    You have had instances where DNA, from a rape, has been used then once the owner of the DNA was identified they served that person. I would guess this would be the same kind of thing, they have filed with the court that they are suing LawGuy69, then they would request that a judge give them the right to identify LawGuy69 from the files off the server. Until they could actually define who the person was they would not beable to continue the trial but at the same time since the paperwork was filed the time limit when you could file would not expire.

    The original forcasts was by hurricane forcasters, they said we are now in a period of increased numbers. According to the National Oceanic and Atmospheric Administration, the Atlantic has kicked up an average of 7.8 hurricanes and 3.8 major hurricanes per year since 1995, compared with an annual average of just five hurricanes and 1.5 major hurricanes over the preceding 25 years. But most scientists agree that the increased frequency is caused by a natural cycle, not global warming. Also the number of hurricanes in other parts of the world is decreasing so the global number is staying around the same.
    That we are in a cyclical pattern was widly talked about until Katrina at which point the global warmists start talking about how global warming was causing the increase, then you had Al Gores film which pushed that global warming was the cause of the major hurricanes.
    One thing when looking into this is to check what definition they are using for major hurricanes. So places use the force and length to determine you will also find sites that determine it based on the financial damage caused by the storm. Personally I think the finantial definition is a joke because more people are living on the coasts tehn before so the damage caused by theses storms will increase.

    That lawsuit is mainly about the sign in the shop saying "Satisfaction Guaranteed" and "Same Day Service" he is doing so under a stupid provision under a Washington D.C> consumer protection act. If this was just about the pants he would just be eligible for the money to replace them, you could make the case for replacement of the whole suit.
    The U.S. and Europe are pretty much the same with just actual costs for the loss of property, it is the punitive damages in the US that are killing them. The punitive damages laws are around in Europe they just need the scum of trial lawyers to start profiting from them, and they are starting to do that.
    On the topic of property damage you do have a major difference, in most of the US the replacement cost is only for the item, in alot of places in Europe that cost also will include future profits.
    For example you hit a chicken in the road and are require to pay damages. In the most of the US it would just price to replace the chicken with a comparable chicken, if that chicken was a great egg layer you would have to pay the amount to purchase a new great egg layer. In most of Europe you would have to pay replacement and future profits from that chicken, so that with that great egg layer you would have to pay for the chicken, the amount the owner is out because it will no longer lay eggs and in some cases you would have to pay an additional amount to cover the future generations that chicken will no longer produce.

    If what you were describing was the whole case I would aggree. However microsoft is also requiring that you have installed and running microsoft desktop search so that you can perform searches in other microsoft products. With them tieing in thier Operating system search with other products they are requiring that you use that product if you want to use the functionality of non-OS products.
    Since I want to beable to search while inside Office 2007 I have to have microsoft desktop search installed and running. Now if I want to use another product for desktop searching I still have to have microsoft's operating system product running just to use the functionality of a non-OS product.
    With that being the case it now becomes a factor because microsoft has a monopoly, good for them, but as part of having the monopoly they cannot use that monopoly to get a monopoly in another area. With the way they are handeling the search from a layman perspective it looks like they are tring to do that.

    Microsoft desktop search is used by other microsoft products for its searching. For example if you want to do email searching in outlook 2007 you have to go and download microsoft desktop search, this is on windows XP.
    So if you want to do searches in your email and also use google desktop search you are in trouble since both search engine now have to be running and scanning everything.

    The Express versions are all free for the download, Microsoft's complaint is that they disabled the plug-in abaility from the for free one and he should not write code to get around that disabling.
    On the code side he could of just downloaded the developer version of the .net framework from the microsoft and compiled using that(comes with a compiler, no GUI) which would ment he never saw the EULA.
    Part of the reason he guy wrote the hack was because he was using the Express version, it was not until he was givin the MVP goodie bag that he got the full blown version.

    Express has plug-in semi-disabled, the back-end code is there but the client interface is removed. To get his software to work he has to link into the software and then has written his own software which duplicates the plug-in interface. It is a little more then that but this is not a case where the software just happens to work, specific software is written into the software just hack around the parts which the express version do not normally contain.

    Heard an interview once from a BBC writer who was talking about this, small number of episodes per year, small number of years,etc.
    He chalked it up to that in the UK most series have one or two people as writers, the same number as producers, directors,etc. In the US your average show has 10-20 writers, a bunch of producers, directors,etc. So the writers for the BBC quickly go through all thier ideas and after that the series is over, in the US with all thoses writers they get alot of ideas and can write alot more episodes. According to him the bad thing about that is in the US you get alot of poorer episodes while with the BBC you get thoses core episodes written by the person who thought up the idea and the show goes out before it has jumped the shark.

    I live over in Germany.
    That number is per gallon, a liter is currently around $2 and there are around 4 liters to a gallon.
    As for public transportation and class snobbery, it is the same over here in Germany. This is outside of major cities, here like in the US you get all class of people riding the metros. There are no people in suits waiting in lines for the local bus it is all the poorer people and thoses without cars. The biggest different would be the longer range trains there you all sorts of people using them, however price wise they are not that big of a savings. Even with a 50% discount on ticket prices, once you hit 3-4 people you are better off taking a car then the train.
    Where they do get alot of usage is with school children, there are very limit amounts of dedicated school buses, instead the kids use the local buses and trains to get to schools. Excluding those times of the day when a local train comes by it is rare to see more then 5-10 people in it, and they only come by once an hour.

    The Wiki numbers were written by people agaist the drilling and are a very low guess based on 35 year old technology. Just checking the wiki entry again they have the Department of Interior numbers, which are usally deleted, but scientists who stuff that stuff most consider that a low number. Then you have the guess from the people who will be investing thier money and thoses are alot higher, and when they do show up in wiki are quickly deleted.
    If you want the exact number they are unknown.
    That is part of the problem, the laws that were being discussed for drill are initially to allow test drilling. This would give us a exact number and from there it could be considered if drilling would be worthwhile. Any drilling that would take place is still many years in the future because there is no delivery method available. Until there is a pipeline to get oil from the wells to a port there is no value in doing the drilling and until they are allowed to do some test drilling to measure how much oil is actually there is not going to be any money available to do distribution system.

    It is not the Whitehouse that deleted the mail. The problem is there are two laws.
    The first is that all executive and presidental information will record forever, this law has no real penalty and the whitehouse server are setup to store all information forever.
    The second law says you will not use government systems for party and personal related email and communication. To solve this the political parties supply thier people with blackberries, email accounts,etc for this use. This law has penalties, primarily after the Clinton administration ignore the previous law.
    So you now have people who have crackberries and other easy to access tools that go through a non-government system. Who does not think they are going to also use them to send official communications? If they have a crackberry next to them and want to sent a piece of email off to someone they are not going to wait until the next time they are in the office. IF you think that is hte case do you also not use your work systems for personal use, email surfing various web sites?
    So you now had official communcation going over systems that were not setup for heighten storage. Theses systems lost the messages and that is the problem.
    The original post is not factual it is being carried by other new sources, however most are warning people that based on Greg Palast past history the story is suspect. As for this story if you read some other article on this you see that it looks like some messages were set to a cyber-squatter who took all mail and forwarded it to Greg Palast and this is his claim that all mail is not missing. Not sure if he is sitting on the email for the story or if he has already forwarded a copy to the people originally requesting it.

    SWG was messed up from the beginning, the design for it was just terrible not to mention the bugs.
    As for Vanguard SOE has been purchasing failed MMORPG, such as Matrix online, and combining them into thier all access pass. If you are to plan SOE and not Brad. SOE saw an MMORG with a large fan base that was being dumpped by Microsoft, purchased the rights to support gave Brad money(aggreements on this was before SOE signed on) and expected him to know what he was talking about. As some others have put it SOEs blame is that they gave Vanguard a second chance, they should of just let it die.
    Now that they have purchased it they will probably go invest money and people it in and attempt to grow the user base. In reality the only people to blame are Brad and Raph and lets hope no-one else spends money on thier "plans" or designs.

    According to the law the theft of the type of item does not really matter. While you would likely get off with stealing the food it would be because the judge, the person stolen from or the jury decided to ignore the law and give some mercy. In the example with the killing yes you would get less time with the cheating because you did not plan before hand to commit the crime. With the insurance plan, that you were thinking to kill him for the money would probably be used as evidence it would not get you an extra time on the murder then if you were planning to kill the next person who knocked on your door, you still have the insurance scam to deal with. Yes there is some thought about it but you actually have to work into planning.
    With the thought crimes if you are guilty of the crime and then it is found out that 1 day ago you said "Kill all whites" then you get extra time. You cannot prove that it was the motive it is totally based on what the person what thinking or if you do have evidence then it only comes about because the person was using their 1st amendment rights.
