My (non-troll) question - how is illegally duplicating a copyrighted tape or disc different than "fair use" of recording off-air broadcasts?
Seems to me if you had an analog copy of something that had ever been broadcast, you could claim fair use.
I can see the argument that those offering files are depriving the record label of potential sales, so you could estimate some sort of "loss".
However, can some legal mind comment on the general concept: An individual has illegal copyrighted material that he would otherwise not possess, what are the damages to the copyright holder?
Does it matter the reason the infringer "otherwise would not possess"?
I don't have that much money (e.g. really expensive software, facsimile of copyrighted art, etc.)
The material is not available (old TV show, old game ROM, etc)

Seems to me, the OS cost is in the noise on most reasonable systems (not the "$200" ones). When I buy computers, they are frequently no-OS white box PCs. For retail outlets, most people want an OS, so it is "included". Sometimes, it is cheaper to buy a system bundled with an OS you don't want. So what?
Sometimes I buy the 20 lb sack of potatoes at Costco, knowing that I will end up throwing half of them away (or give some to neighbors) - because it is still cheaper than buying them in smaller quantities.
Last time I bought a $1600 Dell notebook, it came with WinXP. First thing I did was reformat the disk and put Linux on it. Would Dell have sold the thing for less w/o the OS? I dunno, the notebook had the hardware features I wanted at a price I was willing to pay.
There is a lot of duplicated functionality, package overlap in the Linux distros, too. Pick the bits you want toss the rest. Bits don't take up much space in the landfills.
Just looking around, say dell.com and eracks.com - compare two comparable (hardware specs) laptops and I don't see the Linux OS costing any less.
Where you pay a lot is when you don't have a MSFT OS and you actually want to buy one, the retail price is much more than the small delta you pay with a new system that "just comes with" it.
I am not saying it is "right", or that there aren't "odd" agreements in place to make it so, I just don't think that it is affecting the economics of your hardware purchase that much.
I don't know about you, but once I watch a movie, I am good for 10 years at least before I want to watch it again (if ever). I own very few movies (a few "classics" at $5 on sale). I have not converted any of them to other formats. Normally I let Blockbuster or Netflix store my movies for me.
Long plane trips are perfect for reading a new novel. No batteries required.
So, where do you get this video content you want to watch on a plane? Is it legitimate, or a copyright infringment?
Nothing implied here, I am just looking for worth-watching content just as much as the next guy. Where is it? Is there a Blockbuster like place for PDA downloads?
I am sure I purchased Microsoft products during the covered period. I don't recall feeling ripped off, nor do I remember anyone making me buy the products.
