    Sure, Boies is getting paid, but that's hardly a win. Lawyers like to take cases that do more than just pay the bills. They like to win cases, for a variety of reasons. The short of is is that lawyers do not always win - but they usually manage to get paid, which can sometimes be a decent enough consolation prize to endure the loss.

    As for Microsoft, well sure they like the situation and were happy to pay licensing fees, knowing that it would help fuel SCO's fire. No conspiracy here, just taking advantage of the situation at hand. Hell, Sun did exactly the same thing, for exactly the same reasons. I don't think these two companies put Canopy up to anything - Canopy was already brewing this baby when the licensing fees came in.

    The biggest mistake Boies made was to continue letting McBride et al to continue to speak publicly. So much of what they have said is now coming back to haunt them, especially in the Red Hat case.

    It seems pretty obvious that McBride can stall this through his 4 quarters of profit, but his big payoff comes one year after that - I wonder what tricks he has up his sleeve to hang on that long?

    And that is just what is happening. Red Hat filed, SCO filed a motion to dismiss. Red Hat filed for discovery, SCO filed a motion to stay pending the decision on the motion to dismiss.

    Bad news for SCO is their executives keep making damning press releases, thereby strengthening Red Hat's case and increasing chances of it going to court.

    How nice of the US Attorney's Office to publish the defendant's FULL NAME, CURRENT ADDRESS and DATE OF BIRTH prominently on the web, for all to see.(See linked PDF in topic) Even better, this guy is going to be out of the house for a while, so it should be no problem to pick up his mail.

    I swear, the only thing protecting this guy's ID now is his new-found criminal record.

    Come on people, am I the only one who sees this? A 4 month delay is just enough time to complete a successful witch-hunt, fire the source of the leak, hire and train a new worker bee and complete the project, including new 'features' that make the leaked source incompatible with the release. As an upshot, QA gets the extra time to polish up a few extra bugs.

    This isn't so much of a conspiracy theory as an obvious knee jerk reaction by some executives.

    Does this now open the possibility of a Linux client? With Valve's stance on only making the game for a minimal number of platforms (linux excluded) perhaps now a proper, working client can be created.

    There are still some things that do not add up for me. One of those things is SCO's continued distribution of GPLed code on their site, even after every tech/geek site has raved about how this is in violation. They obviously know that doing so would open them up to this type of action - even if the execs were oblivious to the fact (and I hardly think that is the case here, despite the 'creative' press releases) the sys admins would surely know to take it down to cover their asses.

    So why leave it up? Because they WANT this kind of lawsuit. Why would they want it? Because they want to kill the GPL once and for all, and hopefully take Linux along with it.

    What I haven't pieced together yet is how they think they can pull this off.

    I can't believe the parent to this was modded +5 Insightful. Insightful my ass - more like +5 Isolationist. First off, the H1B is hardly about India - it is used by people from all countries, including Canada, Britain and Australia, to name a few.

    But the real question is this: As an american, would you really WANT to live and work in India?

    I agree with this. By separating out the cargo, the personel-carrying missions can actually become more predictable (less variance due to cargo weights) and are unencumbered with the reusability goals. This means Safety can always be the primary goal for person-carrying missions.

    Cargo missions are a much more appropriate area to experiment with reusability or cost-lowering goals as the failure costs are significantly lower. NASA would have a much easier time explaining how they blew up a $40 billion cargo payload to the press compared to the media frenzy created when an astronaut dies.

    Just look at the media attention given to this last disaster - how much was covering the loss of human life and how much was covering the financial losses incurred?

    Can any of us be surprised about this? Diebold's chronic lack of security in general has been discussed at length here on Slashdot and other places for a while now.

    The only accountability this company has been held up to so far is the public disclosure of their lack of procedure or policy governing these very important aspects of their product. However, in a totally predictable fashion, their customers are still purchasing their product in a headlong rush into this 'new' form of voting.

    So to sum up, Diebold has been embarrassed on this issue publicly, but behind closed doors (where the deals are made) it appears to be business as usual.

    - Warrior Kings - released for Apple
    - Warcraft III - released for Apple
    - Master of Orion - released for Apple
    - Unreal Tournament 2003 - released for Apple
    - The Sims - released for Apple
    - Quake III Arena - released for Apple
    - Civilization III - released for Apple


    Obviously the list goes on. So there are more games released for the PC. It could be said that there are even more games released for the console market. It seems to me though that games that tend to be commercially viable tend to be ported to the Mac. So next time you want to troll, please, at least have a specific gripe instead of spouting off on something you couldn't care to look into.

    Actually, by purchasing a G5 you aren't locked in to Apple's platform. Yes, they are the only vendor for such equipment, but that will change once IBM begins to ship their version of the same processor. Even with purchasing an Apple branded PowerPC computer, you are still free to apply whichever operating system you like - there are many versions of linux (Gentoo, Yellowdog, RH,) there is Darwin (Apple's BSD clone) or OS X. Lots of choices for lots of different platforms.

    That's not to say the Opteron isn't a cool-ass chip tho...just saying that between the two, we consumers have great non-intel options these days. I champion both companies.

    For all of you who were wondering why IBM wasn't more vocal throughout all of this, McBride has given you the reason. IBM has been very careful about what/when they say anything about this case. Had they been more aggressive, Darl's latest attempt for public sympathy may have fallen on more than deaf ears. But because IBM's only real action has been to counter-sue, it seems odd that SCO would suddenly start complaining about being 'beat up' by IBM now.

    Then again, SCO seems to be forming a pattern of crying belated woes...

    I can't help but to wonder what their policy would be on locally (as in Palistinian/Israli) produced content, and how ES5 is percieved by those in the entertainment industry over there. Do they support it, believing it will help spread their product to a greater audience, or are they also against it, believing it will stifle their efforts?

    I have to agree. The research here is valid and will most likely result in a more effective search engine. However, since it is being done by MS, it will most likely be yet another closed source revenue stream for them to draw people back to their proprietary OS.

    Good and valid research unfortunately doesn't mean publicly shared results.

    I agree there is a lot of bluffing going on. However, for the SCO execs to continue down this path with nothing to substantiate a valid point of contention is ridiculous. SCO probably thinks their case will fail, hence the FUD, but they obviously feel there is enough strength in their case to fire off a lawsuit at IBM without incurring barratry, or criminal charges. It is one thing to get counter sued and have your company go bankrupt (which it is slowly doing anyway) and quite another for executives and lawyers to face personal criminal charges. They must think they have enough to cover their asses in case it goes bad for them or they would not have had the balls to pull this in the first place.

    After all, a whole lot of bad press can be a great thing if you know how to spin it.

    OR, SCO strongly believes that they have an unbeatable case and are proceeding along this path with the certainty of a lemming marching toward the sea.     My guess is that this company will be the third in line (behind IBM and RedHat) to sue the ass off SCO once this starts to unravel a bit. Selling a bogus license to a fortune 500 company has got to have some serious repurcussions to it.

    In many cases, yes. You don't often get lengthy gameplay, but for mild entertainment, this is a great cottage industry. It's gaining a lot of momentum with handheld devices (Palms, Java phones, etc.) where quick and dirty 'distractions' are the order of the day.

    I remember interviewing for a QA position at Diebold last year - what I remember then was that the single SW Tester they had was very overworked and not able to keep up on the basic QA tasks. I don't blame the tester for this - she really wasn't being supported by management. So it comes as no surprise to me that they have let serious security issues slide for as long as they have.
