While interpretting laws is definitely part of the purpose of the judiciary it is hardly "the" singular function. A primary function of the judicial system is to make laws. Note Roe v Wade as a prime example.
The Halo controls are actually very poor, at least if you are used to playing with the left analog stick mapped to free look and the right analog stick to the z-plane movement. In this configuration it is nearly impossible to run and jump or to quickly pick up a weapon or enter a vehicle since you have to take your thumb off of the movement stick to hit any of the buttons. A problem they would not have had if d-pad were able to be mapped to the commands on the A,B,X,Y buttons. Hardly "intuitive" to make an entire control setup unuseable because of something so stupid, though I seem to be about the only one left playing in that configuration.
That's not anything like what is going on here. In your example the VFAT implementation is completely irrelevent. Since you wouldn't be trademarking it, you would be trademarking the name that you use to resell a version of that VFAT implementation.
It's much more similar to you being a reseller of HP computers and applying for a trademark on their case design.

Didn't we all just learn from microsoft that passwords are insecure and should be instead replaced with more reliable, yet equally easy to remember pages/chapters from novels?
Perhaps if Apple had better trade secrets than that they were releasing a 500$ headless mac with stripped down ram and that they were putting out a flash mp3 player maybe someone would care? But leaking that kind of information should hardly be considered a trade secret. I mean, it's like Joe in accounting leaking that The Lord Steve Jobs shall be eating eggs and bacon for breakfast with a glass of orange juice.
They didn't shut down their sports division because they got shut out of baseball and football. In fact they aren't shut out of baseball at all, being as how they are a first party developer. The reason they shut down their sports division is because their sports games blow and were getting spanked all over the place by the competition.
Also all of the games are designed with one button in mind at at best you get some weak after-thought functionality on the additional buttons you add to it. Not that this is necessarily bad, since 2600 owns all of you and your moms.
And in fact we need copyright laws to protect open source software. Otherwise someone would steal it and find some way to roll it into a proprietary package of one sort or another.

Man, let's compare the TCO for the entire microsoft "distro" to any Linux. You're looking at a couple grand just to install the system and you'll still be missing a lot of software that microsoft just doesn't make.
