How can you acuse one of theft if they never intended to buy a file they downloaded for free? If a person downloads a file of which they are completely ambivalent to in terms of buying or downloading how does this become theft?
Say I download a Britney Spears mp3 that I never would have bought regardless of price but because she is the greatest entertainer who has ever walked the earth I downloaded the mp3 just to have a listen and then forgot about it on my harddrive. How does this constitute theft?
Software companies have always factored in their loses with overly inflated numbers of lost sales which include monies from sales they would have never had. Just because so and so downloads a program doesn't mean they would have bought it. When you have programs that are $1000's of dollars then it's obviously prohibative for the average person to buy so they might download it to try it out.
What I'm getting at is how can a company over inflate loses to "piracy" and I use that term loosely and convince you of the same? Who's fooling who?

If one cannot find the song/cd because it is not longer released or available online or by any other means then how is it theft. Yes it might be copyrighted but if someone wants it and has no other means of which to purchase it then why isn't it legal to download it?
In looking at the linked site I noticed that their port includes a "Quake 2 Radar". This is actually constitutes a new cheat. There was a cheat w/ a radar called the "Z-bot" as well as the ZR-Bot. If you have a radar and no one else does then you can frag them right as they turn a corner befor they know what hit them. The radar is a huge advantage.
If you play halflife and you have played against wall hackers then this would be the equivalent done in a different manner but with the same end result.

Until Linux or any of it's derivatives can get the word out to the average uneducated user then they'll have no hope for making any inroads in this area. Windows, albeit crash prone and such, althought XP is heads and shoulders above the rest, is the most well known and simple os out there. Yea I know Macs are simple too but they are over priced and have no where near the software that Windows does.
What any form of Linux needs to compete on the desktop level is name/brand recognition, a good pr strategy, and massive advertising. I know this can be misconstrued as selling out but if you wanna compete on that level then you have to match the Windows effort which is massive to say the least.
Linux rules on the server front IMO but on the desktop is needs more work for Joe Average. Most of us can get whatever we need to work on Linux but Joe Average doesn't want to have to mess with compatibility issues, be it, hardware or software. This would be the key factor in a lot of people's decisions but there's also the simple fact of why fix something that isn't broken in their eyes. If they are happy with Windows, which most are because they know nothing different, then they won't switch regardless
Windows has the apps, games, and most market saturation.
Mac has the design niche
Linux has the uptime, loyal user base w/ Mac, and dependablity but needs to incorporate something major on the desktop level that the other's don't have. I'm not sure what it is at this point either:) In my eyes the dependability is major but people want something major in terms of bells and whistles. If there was true cross compatibilty with Windows apps then Linux would be a true contender. Until then it's desktop market share will be flat.

I just state what I believe and refuse to be tied to one OS over another because of all of the fanboy flames I always seem to encounter. With all of this DRM talk it seems as if it's the most important subject these days. If anything was ever the epitome of "big brother" it would be DRM. You buy a product but don't own it and only have certain uses for it as stipulated by what ever multi-national conglomerate.
These corporations are yielding more and more power and with their deep pockets they are shaping our future laws. Most people are completely ignorant to what is transpiring and the ramifications as applied to all parts of life. I'm not full of paranoia but the truth is right before our eyes.
I find it beyond frightening when a guy is busted for releasing the new Hulk movie online and is sentenced to a longer jail term than a rapist/robber. That was a very powerful moment to me. It says everything about the type of power behind the DRM movement.
I can see it getting to a point where the DRM is embedded in hardware and people who are anti-drm no longer upgrade because of this. The people who are ambivalent to all of this are in for a world of hurt once DRM starts to permeate through all parts of society and it's products.
As said before our only hope for ridding ourselves of DRM and it's derivatives is to speak with your wallet. The sad thing is we are a minority. The majority has no clue. DRM, disposable DVD's, & game keys are only the beginning if we don't make a strong statement.
Sales are down for many reasons including the economy so using P2P as the posterboy isn't an excuse. More people realize this and aren't buying it...well except for Orin Hatch and that bastard has already destroyed 3 of my boxes!
