    I really think the solution is for someone to use the DMCA to sue the movie industry and all their licenses for producing equipment which CAN bypass the copy and access controls.

    Actually... all the cops shows talk about chain of custody for the evidence.

    The Police will have to show that the photo they received of her is in fact not altered, etc and does show her nude in a 'public' place.

    If she signs a letter admitting that it is authentic then they would be have way there (or maybe a little more), otherwise they will probably need to track down others that were there and have them bear witness.

    On a side note, I remember watching a program about Las Vegas and how they still used analog film in the majority of cameras because there was no 'something or other' that allowed digital pictures to be certified as 'original/unaltered/etc,,' and admitted, so I wonder if they even have the original (assuming the picture wasn't taken with a digital camera) photo to use as evidence.

    No, i don't think this is any where close to open/closed case.

    Though, I do think that her best bet would be to work out a deal where she pays the fine and gets to keep the picture on her site and posts the ticket/etc... as "proof" that she is authentic.

    Find a new company to do your DNS, and e-mail and

    Seems to me that it it's aimed towards detecting sources that aren't published, that somewhere there needs to be a list of 'published sites'. If you're web, ftp, mail, cvs, filesharing software isn't on the list then it will flag everyone who connects to it for futher study.

    First thing I would do as is ask them if they logged any of the MAC addresses or just IP addresses. I would also ask them if they have any other logs from the same timeframe showing connections from that IP address to any other systems, and if those systems support user logging, do they have the associated logs. (check mail servers, samba, etc..) Also, check dhcp logs, some OSs renew leases more often than required.

    Since it's easy to quietly steal/borrow an unused IP address that isn't being used, but if it's being used it can create a lot of logs on routers and servers that consistently get messages about IP address conflicta. In either case, any records of MAC addresses from the same time frame will hopelly tie it back to the actual machine using it. ( I say hopefully because MAC addresses can be faked but that would be a whole lot of extra work to do it)

    Also, if someone borrowed your IP address and wasn't carefull (or was lazy ) they may have continued to check e-mail or access other networked resources, maybe even logging into a unix system from the borrowed IP address using their own account.

    They your system normally checks/renews the dhcp lease every hour (unlikely, more like 4 hours) and there is a gap in checking then it could indicate that your machine was down. Also, if you leave your e-mail up and it checks mail every 10 minutes during the day/night and there is a gap there, it could also indicate your machine was down.

    In short there isn't any one big item, but a lot of small things that can be pulled together. This could all also be used against you if they all seem to point back to your machine, but you might also want to ask if they have checked your machine for backdoors or viruses, etc...

    It worked for against the child porm rap (twice).

    Probably the best advice is ask them to keep you informed of their investigation and ask them for a letter clearing you as soon as they actually do clear you. Also, ask them what kind of reference you can expect before they actually do clear you.

    My best guess is that they are baddly in need of money and/or they realized that they have been
    following the long tradition of ignoring their baby and the longer they ignored it the worse the case against them would be when they started to try and collect. Probably more the first than the second.

    Interestingly Enough, SCO has admitted in various interviews that they don't own the IP ( Patent/CopyRight) that IBM put into linux, IBM does. They just believe that IBM broke it's contract with them when IBM did it. So, if they don't own it and they terminated IBM's license doesn't that mean that they will have to remove the IP from their code since IBM owns it?

    Shouldn't the best case for SCO be, IBM losing and needing to pay them for breaking the contract. Then SCO either removing the IBM IP or licensing the IP from IBM?

    If you're community offers services like tax information on computer ( see about connecting a dedicated terminal to provide access for Community Members)

    Provide some system for Reference (think online or off line Encycopedia, etc... Think School Projects... talk to your local library to see if you can complement them )

    Provide Education. Offer Educational Software for use and sale/resale. Think all Ages, talk to the local School to complement them )
    Offer intro to computers, Intro to Internet, Intro to Office (not MS office, generic Office products { star/open office ) computering, intro to programming ( Java / Html ) Offer more advanced class or allow users to suggest classes.

    Get people into it, get them hooked and cater to their needs.

    How about any of the translation programs.... I used a number of them to type in one language and talk to another instantly.....
    I even type in one window in one language and presto.... different window a different language....

    So where do we send our prior art too so that they can be seen BEFORE the application is approved.

    How about all the of equipment that they use to master the cd's and DVD's in the first place.

    I have often wondered about this issue. If intent does not matter only the ability.... then... who controls the limits? If I produce a Cd or DVD that is protected by some means as the Big Boys ( CSS, etc..)

    Does the ability of the the mastering and production equipment (licenses by the Recording Industry, not BY me) to access the content and copy it violate the DMCA? I own the copyright of the material, do I need to own access protection too?

    Or, can someone license equipment which can violate someone else's copyright... ie, can the owners of an access protection scheme license a product which bypasses the access control without regard to the wishes of the content provider?

    How about this idea.
    CopyRight Holders register and must update their record Annualy or else if someone files an inability to contact Holder, the goverment shall attempt contact and if that fails the Goverment shall administer as it sees fit untill CopyRight Expired or proper Holder shall reestablist contact at which point they may claim fees collected and establish on going administration.

    Automatic Copyright should be limited to ONLY 2 years unless a piece of work is registered. If a piece of work is Registered then atleast every 5 years the the items registration must be updated with current Holder(s) information as well as information about who/how to licence usage/purchace of the item, and Optionally rate information. In the event that a registry is not updated and it's current 5 year period expires, a notice should be sent to the current Holder(s) and they shall have 5 years to update the record before the record shall be marked Public Domain.

    In the event that none of the Holders wish to make the item available for distribution they may decide to have the item marked Public Domain, or if they can convince a court that the item should not enter the Public Domain then a court can rule that it should not enter the public domain until the limit of all CopyRights expire (burdon of proof on Holder). This issue can be revisited if Someone can show just cause why an item should enter the public domain and not be allowed disappear (burdon of proof on Holder).

    Should CopyRight Holders wish to continue to make a work of art available for license/sale then that record should only expire at the End of all CopyRight protections.

    Some inital fee to register Holder (once per holder)
    Some small fee for each collection of work ( may contain multiple items which can be licensed independently but share a common list of Holders and timeline -- Since Automatic CopyRight lasts two years, small authors can file articles together as a collection and photographers can also file collections of work)

    Updates should be free.
    Actions which require Goverment action should have listed fees
