Before to make an open beta, they probably had an alpha, they should include the guys who searched for security bugs in their next alpha...
Security bugs in an open beta has the potential like you said to ternish their Corporate Image and for a company like Apple Corporate Image is one of their best assets. ALthough the effect of this news will be relatively small since Joe and other casual users will never hear of this one, imagine if some huge security bug was found on a product related to the Ipod or one of their best sellers...
Even though some people have access to rumours earlier and have a better circle of friends, you can get yourself a Bloomberg and Reuters terminal and here you go you will have the same real-time news than the other traders !
It often comes down to the fact that some people are better at spotting/evaluating opportunities...
If you read the article and all the links, you would see that:
The original letter did not speak about what he did wrong
The second letter from the lawyer invokes a part of the agreement which is "... you may use the software only as expressly permitted in this agreement. In doing so you must comply with any technical limitations in the software taht only allows you to use it in certains ways... You may not work around any technical limitations in the software..."
It basically means that if the software has limitations you may not be allowed to hack it to use the tool beyond these limitations.
In this case one could argue that there is no exactly defined limitations since the tool contains the addin functionality and he did not hack the software in question. That Express is delivered without this functionality and that the lack of this functionality is not exactly a limitation...
Personally if I was him I would just withdraw my project all totally, there is nothing to gain from being sued by Microsoft aside from some personal ego...
One of my coworkers has still his Apple notebook from 2004, since he got it he used to throw it on the ground regularly to show us how sturdy it was (I know, he is a strage fella), it still works aside from some cracks because of the repeated shocks...
learly spam works, so the amount of spam being sent would only continue to grow. Would this lead to increased vigilante action? More privacy and restrictions imposed by administrators? Decrease in the use of Email as the signal-to-noise ratio continues to degenerate? All of the above?

Yeah see what you mean, I thought about it while typing and thought that it wasn't that bad of an image, but, still, he became kind of a legend with this quote : )
You should see it as an attempt to reconciliate both parties, they could just say "you broke laws about monopoly therefore I declare your products illegal in the EU..." or charge them an extravagant amount of money since they cannot enforce a split of the company.
Of course, it will never happen since because of the monopolistic situation about Microsoft, it is almost impossible to do work in many of the actual jobs nowadays without Microsoft tools.
You can speak about OpenOffice if you want, but, if you just take Excel as an example:
you would need to pay major retraining across your company, since Joe and Susan are still trying to find out where are the Pivot Tables (replace here anything which is quite specific about Microsoft), just a slight change in the interface causes nightmares to these users...
Alot of the spreadsheets are using VBA and you would need to rewrite all of this
In my area, we are using alot of C++/C# addins used in Excel, I do not think we would be ready to rewrite all of this code or to even try to encapsulate it in another application
So whatever happens, the EU will never be too restrictive towards Microsoft.
> They made a new battery which last 10x longer than the older generation
Isn't it why you can change batteries and carry 2 or 3 of them in your bag ?
That's exactly what I thought when I read the headline ...
...
Take a look at this article which tells us how the US porn webmasters have to hide from the public

You may hug synthetic children with synthetic arms
I found this link ...
It discusses this point about the EULA and how Microsoft probably kind of break TestDriven.Net EULA.

I think you should always look at both versions ... Basically the soviets reacted to the Jupiter bases in Turkey.
They removed the missiles in Cuba because the US also agreed to remove the Jupiters in Turkey.
Don't forget Switzerland

I think we could classify that in the category "laptop can damage men genitals" ...
*ouchy*
Emacs is a waste of ressources, go Vi, or Vim if you want some advanced GUI ...
You would then target a fraction of a smaller customer base.

I think that we would be doing fine without Hitachi and or Apple.
Besides that EU without Microsoft = Open Source or Apple will win over time.
